October 21 , 1991
In accordance with the Warrant , the Fall Yearly Town Meeting was held in the
Brewster Elementary School Cafetorium , on Monday, October 21 , 1991 .
The meeting was called to order at 7 : 00 p . m , by the Moderator, Stephen L .
Doyle , The Tellers were June F . Gallant , Edwin Blease , Ruth Hanlon , and
William Nielsen . The checkers were Dorothea Dugan , Helen Allen , Patricia
Kelsey , Carl Scrivener, Lois Curcio , Mildred Unger and John Unger.
A quorum was present .
The Town Clerk , Joan K . Cole , read the Fall Yearly Town Meeting Warrant , and
the Return of the Warrant . There being no objection , the Moderator dispersed
with the reading of all the articles .
A moment of silence was observed for the loss of Dorothy Grenier who had
served the Town of Brewster for many years in many ways .
ARTICLE 1 . RECALL BYLAW
ARTICLE 1 . To see if the Town will vote to authorize and direct the Board of
Selectmen to petition the General Court of the Commonwealth of
Massachusetts to enact a special act providing forthe recall of elected officials
in the Town of Brewster, or to take any other action relative thereto .

SUMMARY
AN ACT PROVIDING FOR RECALL ELECTIONS IN THE TOWN OF
BREWSTER
SECTION 1 : Any holder of an elected office in the Town of Brewster may be
recalled therefrom by the registered voters of the town as hereinafter provided ,
for reason of lack of fitness , incompetence , neglect of duties , corruption ,
malfeasance, misfeasance or violation of oath .
SECTION 2 : Any twenty-five registered voters of the Town of Brewster may
initiate a recall petition by filing with the Town Clerk an affidavit containing the
name of the officer sought to be recalled and a statement of the grounds for
recall . The Town Clerk shall thereupon deliver to said voters making such
affidavit copies of petition blanks demanding such recall , copies of which
printed forms he shall keep available. Such blanks shall be issued by the Town
Clerk , with his signature and official seal attached thereto . They shall be dated ,
shall be addressed to the Board of Selectmen and shall contain the names of
all the persons to whom they are issued , the name of the person whose recall is
sought, the grounds of recall as stated in the affidavit , and shall demand the
election of a successor to such office . A copy of the petition shall be entered in
a record book to be kept in the Office of the Town Clerk . Said recall petition
shall be returned and filed with the Town Clerk within twenty days after
notification by the Town Clerk to the moving party that the affidavit has been
certified by the Registrars of the Voters , and shall have been signed by at least
twelve per cent ( 12 % ) of the registered voters of the town , who shall add to
their signatures the street and number, if any , of their residences .
The Town Clerk shall within one working day of receipt submit the petition to
the Registrars of Voters in the town , and the Registrars shall within five
working days certify thereon the number of signatures which are names of
registered voters of the town .
SECTION 3 . If the petition shall be found and certified bythe Town Clerk to be
sufficient , he shall submit the same with his or her certificate to the Selectmen
within seven working days , and Selectmen shall forthwith give written notice
of the receipt of the certificate to the officer sought to be recalled and shall , if
the officer does not resign within five days thereafter , order an election to be
held on a date fixed by them not less than sixty and not more than ninety days
after the date of the Town Clerk 's certificate that a sufficient petition has been
filed ; provided however, that if any other town election is to occur within one
hundred days after the date of certification the Selectmen shall postpone the
holding of the recall election to the date of such other election . No persons
shall be subject to recall if his term of office expires within ninety days of the
certification . If a vacancy occurs in said office after a recall election has been
ordered , the election shall nevertheless proceed as provided in this section .
SECTION 4 . An officer sought to be removed may be a candidate to succeed
himself , and unless he requests otherwise in writing , the Town Clerk shall
place his name on the ballot without nomination . The nomination of other
candidates , the publication of the warrant for the removal election , and the
conduct of same , shall all be in accordance with the provisions of law relating
to elections , unless otherwise provided in this act.

SECTION 5 . The incumbent shall continue to perform the duties of his office
until the recall election . If then re-elected , he shall continue in office for the
remainder of his unexpired term subject to recall as before , except as provided
in this act . If not re-elected in the recall election , he shall be deemed removed
upon the qualification of his successor , who shall hold office during the
unexpired term . If the successor fails to qualify within five days after receiving
notification of his election , the incumbent shall thereupon be deemed
removed and the office vacant .
SECTION 6 . Ballots used in a recall election shall submit the following
propositions in the order indicted :
For the recall of ( name of officer) .
Against the recall of ( name of officer) .
Immediately at the right of each proposition there shall be a square in which
the voter , by making a cross mark ( X ) may vote for either of the said
propositions . Under the propositions shall appear the word " Candidates " , the
directions to the voters required by section forty-two of chapter fifty -four of
the General Laws , and beneath this the names of candidates nominated in
accordance with the provisions of law relating to elections . If a majority of the
votes cast upon the question of recall is in the affirmative, the candidate
receiving the highest number of votes shall be declared elected . If a majority of
the votes on the question are in the negative , the ballots for candidates need
not be counted . z
SECTION 7 . No recall petition shall be filed against an officer within ninety
days after he takes office , nor , in the case of an officer subjected to a recall
election and not recalled thereby , until at least six months after the election at
which his recall was submitted to the voters of the town .
SECTION 8 . No person who has been recalled from an office or who has
resigned from office while recall proceedings were pending against him , shall
be appointed to any town office within two years after such recall or such
resignation .
ARTICLE 2. BUDGETARY TRANSFERS
ARTICLE 2. To see if the Town will vote to transferfrom available funds and/or
appropriate from surplus funds in some departments an amount or amounts of
money to be used in conjunction with funds appropriated under the current
fiscal year budgets and to be used during the current fiscal year to pay
shortfalls that would otherwise exist in the Fiscal Year 1992 Budget of other
departments , or to take any other action relative thereto .

ARTICLE 4 . ROUTE 6A POLICY
ARTICLE 4. To see if the Town will vote to establish that the People of the
Town of Brewster are fond of the existing character and features of the
corridor known as Main Street , formed by Route 6A as it passes through
Brewster, and to express a general concern that all bodies governing future
development and /or roadway improvements on and along Route 6A be
directed to protect and maintain the unique visual and historic character of
this roadway in Brewster by avoiding , wherever possible , roadway
improvements such as additional lanes or road widening , and by reducing the
need for such alterations by appropriate controls on development generating
levels of traffic which exceed the exisitin capacity of the roadway , or to take

Airline and Setucket Road in West Brewster, being shown on the Brewster
Assessor's Map 37 , Lot 52- 1 and to place the same under the jurisdiction and
control of the Board of Selectmen , or to take any other action relative thereto .

Cape Cod Vocational Technical School , or to take any other action relative
thereto .

establishing a county-wide consortium that would apply for, receive and
expend Federal Home Grant funds pursuant to the provision ( s ) of the 1990
Cranston -Gonzalez National Affordable Housing Act , or to take any other
action relative thereto .

ARTICLE 8 . NON CRIMINAL DISPOSITION
ARTICLE 8. To see if the Town will vote to adopt the following general by- law
as Chapter 8 , Article II of the Code of the Town of Brewster , Massachusetts :
Whoever violates any provision of the rules or regulations of the Board of
Health may be sanctioned through the noncriminal disposition process
( civil fines accruing to the Town ) provided by Massachusetts General
Laws , Chapter 40 , Section 21D , as amended from time to time , if theIPA
regulation or rule prescribes a specific penalty for its violation . Resort to
this noncriminal disposition method shall lie within the discretion of the
enforcing officer, and this noncriminal option shall exist wholly in
addition to all other available enforcement alternatives .
Any enforcement officer who takes cognizance of a violation of a
regulation or rule subject to this noncriminal disposition procedure and
who elects , as an alternative to criminal process , to proceed with
noncriminal enforcement shall give the offender a written notice to
appear before the Clerk of the Orleans Division of the District Court
Department at anytime during office hours but not later than twenty-one
days after the date of such notice .

Each day during which a violation of a regulation or rule continues shall
eev be deemed to be a separate offense subject to the noncriminal
disposition process ; however, this provision shall not be construed to
' prevent separate incidents or episodes occurring on the same day from
also being considered separate offenses11 .

needed to extend a ten ( 10 " ) inch water main approximately one thousand
three hundred eighty ( 1380 ' ) feet from Route 39 to Grist Mill Road and an eight
( 8 " ) inch water main on Wayside Drive and Colonial Way , in the Meeting
House Village Subdivision ; to authorize the Board of Water Commissionersto
extend this water main in this fashion after the Commissioners have
determined that the requirements of the Brewster Water Betterment
Assessment Program have been satisfied ; to raise and appropriate and/to
transfer from available funds the sum of Ten Thousand and 00/ 100
($ 10 ,000 . 00) Dollars to defray the initial costs of this project ; to authorize the
Town Treasurer, with the approval of the Board of Selectmen , to borrow the
sum of One Hundred Thousand and 00/ 100 ($ 100 ,000 . 00 ) Dollars under and
pursuant to Massachusetts General Laws , Chapter44 , Section 8 and any other
enabling authority, and to issue notes and bonds of the Town therefor in order
to finance the total cost of acquisition , engineering , construction ,
reconstruction , and any related and incidental expenses ; to raise and

purpose of paying interest on the notes issued in anticipation thereof ; and to
raise and appropriate and/or transfer from available funds raised through the

MOTION : I move that the Town vote to approve Article 15 to authorize the
Board of Selectmen to acquire by gift, by purchase , or eminent domain all
water easement rights needed to extend a ten ( 10 " ) inch water main
approximately one thousand three hundred eighty ( 1380 ' ) feet from Route 39
to Grist Mill Road and an eight ( 8" ) inch water main on Wayside Drive and
Colonial Way , in the Meeting House Village Subdivision ; to authorize the

ARTICLE 16. To see if the Town will vote to authorize the Board of Selectmen
to acquire by gift , by purchase , or eminent domain all water easement rights
needed to extend an eight (8 " ) inch water main approximately two thousand
(2000' ) feet along Henry 's Way ; to authorize the Board of Water
Commissioners to extend this water main in this fashion after the
Commissioners have determined that the requirements of the Brewster Water
Betterment Assessment Program have been satisfied ; to raise and appropriate
and /to transfer from available funds the sum of Four Thousand and 00/ 100
( $4 , 000 .00 ) Dollars to defray the initial costs of this project ; to authorize the
Town Treasurer , with the approval of the Board of Selectmen , to borrow the

MOTION : 1 move that the Town vote to approve Article 16 to authorize the
Board of Selectmen to acquire by gift, by purchase , or eminent domain all
water easement rights needed to extend an eight ( 8 " ) inch water main
approximately two thousand ( 2000' ) feet along Henry's Way ; to authorize the
Board of Water Commissioners to extend this water main in this fashion after
the Commissioners have determined that the requirements of the Brewster
Water Betterment Assessment Program have been satisfied ; to authorize the
Town Treasurer, with the approval of the Board of Selectmen , to borrow the
sum of $45 , 000 . 00 under and pursuant to Massachusetts General Laws ,
Chapter 44 , Section 8 and any other enabling authority and to issue notes and
bonds of the Town therefor in order to finance the total cost of acquisition ,

carrying out its duties under the Wetlands Protection Act , or to take any other
action relative thereto .

Selectmen to the Brewster Golf Commission for use with the existing golf

Resolution : That the Town of Brewster should vote to oppose the current plan
of the MWRA to clean Boston Harbor by building an outfall pipe and
discharging up to 1 . 2 billions gallons of sewage effluent and toxic waste per
day into Massachusetts and Cape Cod Bays . We believe this will have a
devastating effect on our coastal and marine environment !
