HomeMy Public PortalAbout1992-05-11 ATM 2 Pow Report of the ANNUAL TOWN MEETING May 11 , 1992 In accordance with the Warrant , the Annual Town Meeting was held in the Brewster Elementary School Cafetorium , on Monday, May 11 , 1992 . The meeting was called to order at 7 : 00 p . m . by the Moderator , Stephen L . Doyle . The Tellers were June Gallant , Ruth Hanlon , Eleanor H . Nielsen , and William S . Nielsen . The Checkers were Dorothea Dugan , Helen Allen , Mildred Unger, Carl Scrivener, Patricia Kelsey , John Unger , Lois Curcio , and Sherry A . Ryder. A quorum was present . The Town Clerk , Joan K . Cole , read the Annual Town Meeting Warrant and the return of the Warrant . There being no objection the Moderator dispensed with the reading of all the articles . On behalf of the Board of Selectmen , Paul Saint presented a proclamation in memory of Paul Sylver . PROCLAMATION AND RESOLUTION WHEREAS We, the inhabitants of the Town of Brewster, assembled at this Annual Town Meeting the eleventh day of May 1992 "to act and do upon the whole as the inhabitants of said Town of Brewster shall think proper ; " and WHEREAS It is appropriate for good citizens to honor their loyal and faithful public servants . Therefore , the Board of Selectmen , on behalf of all the citizens of the Town of Brewster , extend to Mr. Paul Sylver a standing vote of thanks for his years of dedicated service as Chief of the Brewster Fire Department . Paul took over as Chief after the resignation of John Gage , during a time of great transition , as the Town of Brewster grew from a sleepy rural town to a town requiring a more suburban scale Fire Department . He oversaw the construction of the New Fire Station and updated procedures to reflect expanded operations . In true Brewster fashion , Paul always took care of the little things . He was willing to go the extra mile and do the things that others may have felt he was not responsible for. We are grateful for Mr. Sylver's dedication and the countless ways in which Mr. Sylver protected the Town over the years . His memory will live on in the hearts of all who knew him . THEREFORE We extend our profound thanks and express our deepest r appreciation to the widow of Mr. Paul Sylver . While this expression of gratitude comes late , we hope that it will ease Mrs . Eddy steps down from these positions this year , she maintains her active participation in the Brewster Conservation Trust , and The Brewster Ladies Library . In the past , she has served as Town Clerk and Treasurer/Collector and as a member of the Golf Commission . Throughout the years she has given the Town invaluable support and involvement in more. areas than could ever be mentioned here . Ms . Eddy's ongoing devotion to the citizens of Brewster has been seen in all that she and her family have done for the Town . We are grateful for Ms . Eddy's unending sense of dedication to "all things Brewster" and her generous willingness to share her time and knowledge with the Town . Hughes a standing vote of thanks for her three years of dedicated service as a member and as Vice-Chairman of the Board of Selectmen and for her years of service on the Board of Assessors , the Land Acquisition Committee , the Growth Study Committee , the Hazardous Waste Committee , the Water Quality Review Board , and as Co- Chairman of the Route 6A Corridor Study Group . We are grateful for Ms . Hughes 's profound insights and her great sense of responsibility to the Town of Brewster . She has always generously shared her vast knowledge of the intricate workings of systems , both natural and procedural , to the benefit of the Town . Ms . Hughes has always been counted on to summarize the related issues , point out potential impacts , and raise important perspectives which may otherwise have been overlooked . Her membership on each of the boards and committees which she has served has helped to lead the Town to wise and appropriate courses of action . One cannot adequately present the invaluable contributions that Ms . Hughes has given to the Town of Brewster . Mrs . Favreau has never shied away from any problem facing the Town . She has always been willing to tackle the difficult tasks assigned to the Town 's various committees with energy , optimism and determination . Her ability to reduce even the most complicated issues into concise steps and objectives has helped the Town to determine the most rational courses for action in countless situations . It would be impossible to list all the areas in which Mrs . Favreau has contributed to the Town over the years . We are grateful for Mrs . Favreau 's commitment to Brewster. THEREFORE We extend our profound thanks and express our deepest appreciation to Mrs . Alyce Favreau for her many years of dedicated service to the Town of Brewster . He serves on the ' Nickerson State Park Advisory Committee , the Bikeways Committee , and the Brewster Conservation Trust . Over the years the citizens of Brewster have come to rely on Mr . Grueninger to simplify Town Meeting questions by bringing up the related issues and firmly expressing his opinion . Citizens have found Mr . Grueninger' s unwavering sense of ethics , fairness and rationality a dependable guide for collective decisionmaking . Throughout the years he has given the Town invaluable physical and mental assistance in more areas than could ever be mentioned here . INTRODUCTION In reviewing the budget and warrant articles proposed for fiscal 1993 , the Finance Committee found itself facing two contradictory objectives . Fully vlM l% recognizing the recessive economy and financial hardships faced by many residents , the committee also wanted to maintain essential levels of services provided by town departments and committees . Based on the increasing population , the costs of maintaining those services continue to escalate . The Committee concluded that the primary objective was to be able to provide essential services in order to maintain our town 's infrastructure , provide continued protection of person and property and retain a sound educational system within the limits of our town ' s resources . As reductions continue in both general revenues and anticipated State Aid , the realization of our objective was a task well - met . The presentation of a balanced town operating budget , excluding school expenses and continued debt service , was accomplished by the exemplary cooperation of all town department heads , commissioners and committees who agreed to cut expenses to levels which would allow absorption of increased uncontrollable costs such as insurance and contract pay raises . Further efficiency control was effected by the Board of Selectmen and Executive Secretary before ell < revised budgets were presented for review by the Finance Committee , II . PROCESS eel ell eeee ve %r Knowing full well , as a result of the Spring and Fall Annual meetings in 1992 , v ell 1 %v the Town ' s resources had been stretched to the maximum , Finance Ale Committee representatives to each department ( liaisons ) kept close watch on the budget process this year . Members attended and/ or received minutes from most department/committee/and commission meetings to keep the full eve committee abreast of special situations which could have fiscal ramifications . lee vvv lee Following review and evaluation by the Board of Selectmen or other supervisory commission / committees , major department heads and committee/commission members , along with warrant article petitioners were eel e% invited to present and explain their requests to the Finance Committee . The eel Finance Committee voted on each line item within the budget and each ell 44 warrant article . The results of those votes and comments on such are included ve in this report . III . OPERATING BUDGET The Finance Committee is proposing a final town operating budget of $ 10 ,088 ,467 . Exclusive of the continued increase in town debt service and school expenses , the town operating costs result in a 0 . 10% decrease from Fiscal Year 1992 . Town debt service ( representing previous decisions made by voters ) , has increased 19 . 28% which translates into an overall increase in the town operating budget , exclusive of school expense, of 5 . 9% . This increase in debt service is a result of the bonding of the balance of the authorized , but unissued debt ; which includes land damage settlements ( $2 , 373 , 000 ) 1 -77 - l lee recreation fields ( $ 230 , 000 ) , road betterments ( $ 31 ,000) , water projects ( $ 1 , 194 , 000 ) and the Septage Treatment Plant ( $ 175 , 000) . The decrease in town spending is not without its costs . Levels of services in many departments may be reduced . Some departments will be forced to close for additional hours ; however, we were able to proceed without personnel cuts . The proposed budget for the Nauset Regional School District results in an assessment to the Town of Brewster of $4 , 029 , 842 . Exclusive of our share of the increased capital costs associated with the Middle School expansion , the operating budget assessment reflects an increase of 1 . 38% from Fiscal Year 1992 , The Committee feels the Nauset Regional School Committee worked hard to keep its budget within reasonable levels considering the increase in school population and prior negotiated contracts . The reimbursement funds expected from the State for the Middle School expansion have not yet been appropriated at the State level , thus the high increase in our share of capital costs . Region officials still expect the reimbursement to be funded but a time line cannot be indicated . The Finance Committee has recommended approval of the Nauset Regional School District budget assessment to Brewster. Cape Cod Technical High School was able to present a budget with an increase of 1 . 6% in the total operating and capital budget for Fiscal Year 1993 . However, based on an increased enrollment figure of students from the Town of Brewster , the town 's assessment of the budget represents an increase from Fiscal Year 1992 of 27 . 66% . The Finance Committee recommends approval of the Cape Cod Technical High School Budget assessment for the Town of Brewster in the amount of $ 265 , 849 . The Brewster Elementary School has proposed an operating budget of $ 2 , 981 , 394 of which $ 123 , 731 will be presented in an override to Proposition 2 '/z election . The amount of the budget which is not subject to the override election represents a 1 % increase over Fiscal Year 1992 . The elementary school continues to struggle with increasing enrollments and increased mandated programs for special needs . The Finance Committee recommends the approval of the Brewster Elementary School operating budget . IV . FINANCIAL OVERVIEW A . Revenue Projects and Proposition 2 '/2 Limitations For Fiscal Year 1993 , the maximum levy limit ( or amount the Town maycollect from property taxes ) is $9 , 589 , 776 , including allowance for new growth . As of le Ile the time of printing , the total amount which may be expended by the Town in Fiscal 1993 is $ 18 , 204 , 964 , developed as follows : 1 . LEVY LIMIT : $ 91589 , 776 2 , ESTIMATED RECEIPTS : * 4 , 3691268 3 . DEBT PREVIOUSLY EXCLUDED FROM PROPOSITION 2 '/z : 31697 , 921 4 . AVAILABLE FUNDS : * * 547 , 999 $ 18 , 204 , 964 t -78 - eel I el lee I le III I Ile, ESTIMATED RECEIPTS : " AVAILABLE FUNDS: State Aid Stabilization Fund v Ile State School Bldg , Assistance Wetlands Protection Fees lee Town Receipts Pension Funds Golf Receipts Cape Cod Commission Water Receipts Water Surplus Cemetery Funds Highway Funds ( Ch . 90) Ile Conspicuous by its absence under the heading of Available Funds is " Free Cash " . The Town of Brewster , at this time, has a negative or ( minus-) Free I Ile Cash position in the amount of $ 67 , 052 , As you can see from the noted derivation of available funds , the Finance Committee is again stripping the cupboard bare , if you will , in orderto provide funding for operating expenses without necessitating a general Proposition 2'/z override . It is unlikely our Town will be able to do this much longer . The department heads have been more than cooperative , but it is only a matter of time before it is very apparent to everyone what that cooperation has cost us in essential services . B . Expenses In addition to the town operating budgets , continued debt service payments and school expenses , other accounts such as court judgments , reserve accounts and state and county charges must also be paid from the above- captioned revenue sources . Those costs total $ 584 , 607 for Fiscal Year 1993 . lee vv Added to the town operating budget of $ 10 ,088 , 467 and the school assessments/budgets of $7 , 277 , 085 , this results in proposed expenditures of Ne e' $ 17 , 950 , 157le . V, WARRANT ARTICLES Ile Having worked to keep the Town operating budget within affordable levels , it Peel was apparent to the Finance Committee that warrant articles would need to be lee subject to equally stringent parameters to fit into our price tag , Assuming budgetary recommendation constraints are accepted and a portion of the Elementary School budget is subject to an override election , only $68 , 121 is left of the revenue projects for spending on Warrant Articles, There are 28 articles in the Annual Town Meeting Warrant which require financial expenditure - one in the Special Town Meeting Warrant. One article , although not requiring immediate expenditure , requires the reduction of estimated revenue , which would result in the same loss of monies for projected expenses as an immediate expenditure , eel Of these articles , the Finance Committee recommended for approval 20 either in full or for a reduced amount , In making its recommendations , the Finance Committee evaluated the need , timeliness and available funds . In many cases , the Finance Committee recommended alternate funding mechanisms or deferment until the Town 's financial condition was improved , . 79- VI . IMPACT ON TAX RATE Positive steps have been taken over the last several years by town officials to increase fees for services where appropriate in order to reduce the impact of increased spending on the overall tax rate . The Water Department is now considered a self-sufficient entity based on its most recent schedule of fees . In addition to expenditures authorized by Town Meeting action , many other variables are involved in the setting of the actual tax rate . However , it is broadly estimated that every $500 ,000 in expenditure results in 40 cents on the tax rate . VII . FINANCE COMMITTEE ACTIONIle A . This reduction is the result of the constraints imposed on the town by Proposition 2'/2 . Although we have recommended several necessary items be put on an override election ballot , failure to pass those items will result in non - maintenance of certain town properties and the ability to maintain a sound educational system . The cooperation of all town department heads and town officials in providing the Finance committee with affordable budget levels is appreciated . EDDY In planning for Fiscal Year 1993 the Town has been confronted with a number of financial problems which have led to the substantial use of our limited fiscal reserves , as well as a reduction , for the second straight year , in the level of Town Services in order to arrive at a balanced budget . The Board of Selectmen , after a review of estimated revenues for FY1993 realized that in order to avoid the necessity of a Proposition 2 '/2 general override , we would have to limit all operating budgets to no more than a one percent increase. With the support and cooperation of all our various boards , committees and departments, the Board of Selectmen was able to , ultimately , develop a town operating budget for FY1993 which resulted in a decrease from FY1992 by almost 1 % . Nearly all departments were affected by budget reductions ; however, the Board did provide some limited funds to Fire , Police , Water , Golf and the Library in an attempt to maintain reasonable levels of services . As many of those in the audience are aware , the Elementary School was not able to meet these stringent budgeting standards because of contractual obligations and increasing student enrollment . Because of these , and other factors the Board of Selectmen did agree to place an override of Proposition 2 '/z on the 1992 Annual Town Election Ballot in order to finance the proposed FY1993 Elementary School Budget as recommended by the School Committee . This , and only this , override will result in a permanent increase in the Town 's property tax level limit . Unfortunately , the Town 's total annual debt service continues to increase from $2 , 964 , 000 . 00 to $3 ,536 ,000 . 00 in FY1993 . This represents a 19 . 3% increase and is a result of the permanent financing of the balance of the Town 's authorized , but unissued , debt . Those items included in last fall , 1991 bond issue were for the Septage Plant ( $ 175 , 000 . 00 ) , Water Projects ( $ 1 , 180 ,000 .00) , Land Damage Settlements ( $ 2 , 463 , 000 . 00) , Miscellaneous Betterments ( $ 40 , 200 . 00) , and the Recreation Field Projects ( $ 230 , 000 . 00) . The gross affect of this and previous borrowing has increased the Town of Brewster's total bonded indebtedness to $ 19, 358 , 771 . 00 . In addition the Town is responsible for our proportionate share of the Nauset $ 18 , 500 , 000 . 00 Middle School Project . This expense line item has increased from roughly $500 , 500 . 00 in FY1992 to over $ 839 , 000 .00 in FY1993 . Unfortunately , we have yet to receive funding from the State under their School Building Assistance Program . Finally , the Board of Selectmen did vote to place four other Proposition 2'/z capital exclusions on the 1992 Annual Town Election Ballot . These ballot questions request additional funding for: 1 . $ 100 ,000 . 00 for the design services for an addition to the Elementary School ; 2 . $42 , 712 . 00 to relocate modular classrooms from the Middle School to the High School ; - 82 - VI I IA 3 . $ 100 ,000 . 00 for the installation of new fuel tanks behind the Police/ Fire Station and ; Vv 4. $56 , 100 . 00 for golf equipment and capital projects . These four items represent a one time increase in the property tax levy , solely to finance these specific projects . The Board of Selectmen , after serious and Lengthy deliberation , hope that the voters will agree to our recommendations . IV III n REPORT by the INTERMUNICIPAL AGREEMENT STUDY COMMITTEE 11 of the TRI-TOWN SEPTAGE TREATMENT FACILITY by the Members from the Town of Brewster Vv At the Town Meeting in May of 1991 , Brewster , Orleans , and Eastham voted to appoint a committee of three members from each town to study the efficiency of the Intramunicipal Agreement of the Board of Managers of the Tri -Town Septage Treatment Facility . VI IV The review and criticisms of the nine member committee has been completed . These recommendations have been forwarded to the lawyer for the Tri -Town Septage Treatment Facility, and upon further review by the Boards of Health and Selectmen , as well as the Board of Managers , the first report will be presented to the Town of Brewster at the Fall Town Meeting for their approval . REPORT of the NAUSET REGIONAL MIDDLE SCHOOL BUILDING COMMITTEE III IV As of May 1 , 1992 , Phase I & II of the Nauset Regional Middle School Renovation and Addition project have been completed and occupied by the students and staff . Phase III has been started and has a completion date of September 1 , 1992 . Timing is crucial on any construction project , but more so in a school that is IV being occupied during renovation and construction . Phase III is the cafeteria wing . The cafeteria must be on - line for the start of the next school year. The Building Committee has gone on record stating that the on -going educational process is a priority during this building project . The well being and safety of the students and staff are our major concern . The cooperation of the staff has been outstanding during some stressful periods . The General contractor has always addressed all problems put forward to them in regards to the preceding concerns . The Middle School project is on schedule and within the budget outline . As of January 1992 , $ 10 million has been bonded at an average rate of 6 . 3% . At our building committee at the end of April , our architect remarked that our building committee was the first he had dealt with that was not satisfied by staying on budget , but under budget by questioning and scrutinizing agenda items . We on the Building Committee take this comment as a compliment . In March , Gail Gibson and I attended hearings in Boston on SBA funding . We met with our representatives to voice our concerns . Last year , Nauset was next in line to receive reimbursement on this project . We have since learned that we have dropped from first to thirty- ninth on the list for the next fiscal year. We -83- Ww related these concerns to representatives of the member towns of the Nauset Region on our return from Boston . _ We are asking that our legislators support : 1 . A renewal of the SBA and to provide adequate funding for the program . L 2 . The stabilization of the priority list ( projects would move up the list as preceding projects are funded ) for 3-5 years . This will help towns with more accurate information in their budget procedure and insure that a Town or Region would not be waiting for an indefinite time for their reimbursement . 3 . The Governor's bill to eliminate racial imbalance as a criteria for moving to the top of the priority list . On behalf of the Nauset Regional Middle School and the Building Committee , an invitation is extended to an Open House on Sunday , May 17 , 1 -3 p . m .
