AN ORDINANCE AMENDING VARIOUS SECTIONS OF THE
CODE OF ORDINANCE5 OF THE VILLAGE OF PLAINFIELD
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND THE
BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY,
ILLINOIS AS FOLLOWS:
I. That Chapter 1, Article 2, Sec. 2-9-2 (d) is hereby
amended by deleting the word "employment" from the first and
second lines of said section.
II. That Chapter 10, Article 8, Sec. 8-3 is repealed in its
entirety and the following is hereby inserted:
"Sec. 8-3: Chief's Duties. The Chief of
police shall be head of the police
department, subject however to all ordinances
of the village and the board of trustees.
The chief of police shall cause the public
peace to be preserved and shall see that all
laws and ordinances are enforced. He/She
shall superintend and direct the officers of
the police department generally and from time
to time give such directions as he may deem
proper and necessary for the preservation of
the peace and good order and enforcement of
the laws and ordinances of the village. He
shall instruct all patrol officers and
special police concerning their duties and
see that a record is kept of all complaints
made and arrest tickets issued, and shall
make an oral report at each regular meeting
of the board of trustees concerning the
affairs of the police department."
III. Chapter 10, Article 8, Sec. 8-4 is hereby repealed in
its entirety to read as follows:
"Sec. $-4: A ointments. All
recommendations for the position of police
officer or auxiliary police officer shall be
made by the police committee from those
applicants who have passed the examination(s)
as provided for by the police committee
and/or state. law. All appointments shall be
made by the president and board of trustees.
Each appointee before entering upon the
duties of his office shall take and subscribe
the oath of office prescribed by law. Such
oath shall be administered as required by
law. The oath, shall be filed in the office
of the village clerk."

IV. Chapter 10, Article 8, Sec. 8_g is hereby amended by
deleting "thirty (30) days" on line 4 and inserting in its stead
"five (5) days".
V. Chapter ~.0, Article 8, Sec. 8-10-2 is hereby repealed
in its entirety to read as follows:
"Such auxiliary policemen shall not be
members of the regular police department of
the village. Auxiliary police officers of
the viJ.lage may reside outside of the
corporate limits at the time of their
appointment and while serving in such
capacity. Identification symbols worn by
such auxiliary police officers shall. be
selected and chose by the chief of police of
the village. Auxiliary police officers,
prior to entering upon any of their duties,
that require the carrying of a firearm shah.
receive a course of training, in the use of
weapons. Such training shall be~ in
compliance with the Illinois local law
enforcement officers training board
standards. Upon completion of the course of
training, the chief of police shall file a
certificate attesting to the auxiliary police
officer's completion of the course, with the
village clerk."
VI. Chapter 5, Article 5 is hereby amended by the addition
of the following:
"Sec. 5-5-5-1. Stagnant Water. Any stagnant
pool. of water in the village is hereby
declared to be a nuisance. zt shall be
unlawful for any person to permit any such
nuisance to remain or exist on any property
under his or its control,"
VII. Chapter 4, Article 4, Sec. 4-12: Permitted Time of
Scavenger and Garbage Collector Pick--up. It shall be unlawful
for any scavenger or garbage collector to collect, pick-up, or
dispose of refuse or any other material within the corporate
limits of the village of Plainfield from ten o'clock (].0:00) P.M.
to six O'clock (6:00) A.M.
VIII.That Sec. 11-3-3 and 11-3-4 of Article 1]., Chapter 9 of
the Cade of Ordinances are hereby repealed.
IX. That Sec. 5-28--1 of Article 5, Chapter 9 of the Code of
Ordinances of the village of Plainfield is hereby repealed.

X. That Sec. 9-17 of Chapter 9, Article 9 of the Code of
Ordinances of the Village of Plainfield is hereby amended as
follows:
That the number "15" is hereby deleted from
the last line on the first paragraph and the
number "10" inserted in its place, and that
the second paragraph of said Section is
hereby repealed in its entirety to read as
follows:
"Any owner or operator of such a vehicle may
settle and compromise the claim against him
for such illegal parking by paying the
applicable fine for each such affense within
ten (10) days of the time such alleged
affense was committed."
XZ. That Sec. 9-9 of Chapter 9, Article 9 is hereby
repealed in its entirety and the following inserted in its place:
"Sec. 9-9: Street Cleaning. It shall be
unlawful for any person to park any vehicle
on any public street nr portion thereof in
the village at any time when such street is
being cleaned, or when road repair work in
being performed. Signs indicating such
cleaning or repair shall be posted before
such work is done."
XII. That Sec. 10~-2-1 of Article 10, Chapter 9 of the Code
of Ordinances is hereby amended by deleting "Six (6) months" and
inserting "Seven (7) days" in its place in the description of
inoperative motor vehicles.
XIII.That Chapter 10, Article 12 is hereby amended by the
addition of the following:
Sec. 12-5: Nuisances.
Sec. 12-5-1: Definition. For the purpose of
this section, the term "nuisance" is defined
to mean any condition of use of premises or
of building exteriors which is detrimental to
the property of other or which causes or
tends to cause substant~.al diminution in the
value of other property in the neighborhood
in which such premises are located. This
includes, but is not limited to, the keeping
or the depositing on, or the scattering over
the premises of any of the following:

(a) lumber, junk, trash, or debris
(b) Abandoned, discarded or unused objects
or equipment such as furniture, stoves,
refrigerators, freezers, cans or containers.
(c) Unsheltered storage of machinery,
implements, and/or equipment and personal
property of any kind which is no longer
safely usable for the purposes for which it
was manufactured, which hereinafter are
collectively described as said 'personalty,'
for a period of thirty (30) days or more
except in licensed junk yards within the
corporate limits of this village."
"Sec. 12-5--2: Duty of Maintenance of ,Private
Property. No person owning, leasing,
occupying or having charge of any premises
shall maintain or keep any nuisance thezeon,
nor shall any such person keep or maintain
such premises in a manner causing substantial
diminution in the value of t$e other property
in the neighborhood in which such premises
are located."
Sec. 12-5-3. Abatement of ,,,
" Nuisance by
owners. The owner, owners, tenants, lessees
and/or occupant(s) of any lot ,within the
corporate limits of this village upon which
such storage is made, and also the owner,
owners and/or lessees of said personalty
involved in such storage (a11 of whom are
hereinafter referred to collectively as
"owners") shall jointly and severally abate
said nuisance by the prompt removal of said
personalty into completely enclosed buildings
authorized to be used for such storage
purposes, if within the corporate limits of
the village, or otherwise to remove it to a
location without said corporate limits."
"Sec. 12-5-4: Premises. It shall be
unlawful to permit any building structure or
place, to remain in such a condition as to be
dangerous to the public health in any way.
Any such structure, building or place is
hereby declared to be a nuisance."
"Sec. 12-5-5: Refuse-Depositinq. No persan
shall deposit or place any refuse or garbage
in or upon any street, alley, sidewalk,
publicly owned property, or other public
place except as provided in this case."
"Sec. 12-5-6: Barricades.
(a) Any person laying or repairing any
pavement an a street, sidewalk, ar other
public place, or making an excavation in any
such place shall maintain suitable barricades
to prevent injury to any person or vehicle by
reason of the work. Such barricades shall be
protected by an orange light at night. Any
defects in any such pavement shall be
barricaded to prevent any such injury, and
any person maintaining any opening or
excavation in any such place shall guard
such opening or excavation while the same
remains open by proper barricades and lights.
(b) It shall be unlawful to disturb or
interfere with any barricades or lights
lawfully placed to protect or mark any new
pavement or excavation or opening in any
public street, alley or sidewalk.
"Sec. 12-5-7: Private Use. It shall be
unlawful for any person to use any street,
sidewalk or other public place as space for
the display or sale of goods or merchandise.
No person shall write or mark any sign or
advertisements on any street or sidewalk."
"Sec. 1.2-5-8: Advertisements ar Notices. It
shall be unlawful for any person to attach
any sign, advertisement or notice to any tree
or shrub in any street, parkway or other
public place."
XIV. Chapter 3, Article 1 is hereby amended by the addition
of the following:
"Sec. 1-5: Crueltv. No person shall cruelly
treat any animal in the village in any way.
Any person who inhumanely beats, underfeeds,
overloads, or abandons any animal shall be
guilty of an offense.
"Sec. 1-6: Wl.d__or Dangerous Animals. It
shall be unlawful far any person to permit
any dangerous animal or vicious animal to run
at large within the village. Exhibitions or

parades of animals which are (ferae naturae)
in the eyes of the law are prohibited. The
members of the police department ar any other
person in the village are hereby authorized
to kill any dangerous animal of any kind when
it is necessary for the protection of any
person or property."
XV. Chapter 3, Article 2, Sec. 2--3-10 is hereby repealed in
its entirety and the following is inserted in its stead:
"Sec. 2-3-10: Dogs and Cats Which_,,H_ave
Bitten Persons. Any dog or cat which has
bitten or otherwise injured any person so as
to cause an abrasion shall immediately report
said bite to the Wi11 County Public Health
Department, Animal Control Division.
(a) If the dog or cat is a stray, or the
owner is not immediately known, said dog or
cat shall be impounded at the Plainfield
Township pound or may be impounded directly
with the Will County Animal Control Division.
(b) If the owner is known, said owner must
report bite to the Animal Control Division of
the Will County Health Department and keep
dog confined as required by state law."
XV2. Repe,a,„l,er. All ordinances and parts of ordinances in
conflict herewith are to the extent of such conflict hereby
repealed.
XVII.This Ordinance shall be in full force and effect from
and after its passage, approval and publication as required by
law.
This Ordinance shall be numbered as ordinance No. 1151 .
