HomeMy Public PortalAboutResolution No. 23-105 - Rescinding Resolution No. 17-9301Sponsored by: Commissioner Kelley RESOLUTION NO. 23-105 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, RESCINDING RESOLUTION NO. 17-9301; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it was previously believed that the use of Elected Officials' pictures created an assumption that an event was City of Opa-Locka ("City") sanctioned when it may not have been; and WHEREAS, on January, 11, 2017, the City adopted Resolution No. 17-9301 to direct the City Manager to remove all signs promoting events within the City that utilize pictures of City Officials; and WHEREAS, the City now desires to rescind this resolution and allow the use of signs that utilize pictures of City Officials to promote City events within the City as a tool to notify the residents and business owners; and WHEREAS, the City Commission has determined that it is in the best interest of the City and residents to rescind Resolution No. 17-9301 and allow the use of signs that utilize pictures of City Officials to promote City events within the City as a tool to notify the residents and business owners. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: SECTION 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. SECTION 2. AUTHORIZATION The City Commission of the City of Opa-Locka hereby rescinds Resolution No. 17-9301 and allow the use of signs that utilize pictures of City Officials to promote City events within the City as a tool to notify the residents and business owners. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors, which do not affect the intent of this Resolution may be authorized by the Interim City Manager, following review by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. Resolution No. 23-105 SECTION 4. EFFECTIVE DATE This Resolution shall take effect upon the adoption and is subject to the approval of the Governor or Governor's Designee. Staff Summary: It was previously believed that the use of Elected Officials' pictures created an assumption that an event was City sanctioned when it may not have been. Resolution No. 17-9301 was adopted to direct the City Manager to remove all signs promoting events within the City that utilize pictures of City Officials. It is now in the best interest to rescind this resolution and allow the use of signs to promote City events within the City as a tool to notify the residents and business owners. Financial Impact - There is no financial impact associated with this resolution. Proposed Action: Staff recommends approval with the amendment that events promoted with City resources don't include the use of individual photos. Attachment: 1. Resolution 17-9301 Sponsored by: Commissioner Holmes RESOLUTION NO. 17-9301 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OPA-LOCKA, FLORIDA, DIRECTING THE CITY MANAGER TO REMOVE ALL SIGNS PROMOTING EVENTS WITHIN THE CITY THAT UTILIZE PICTURES OF CITY OFFICIALS; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, there are signs within the City of Opa-Locka ("City") that display pictures of City Officials to promote events; and WHEREAS, use of a City Official's picture creates an assumption that the event is City sanctioned when it may not be; and WHEREAS, the City believes that it is in the best interest of the City to remove all signs from within the City that use pictures of City Officials to promote events; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION FOR THE CITY OF OPA LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-Locka, Florida, hereby directs the City Manager to remove all signs promoting events within the City that utilize pictures of City Officials within 30 days from the date of the adoption of this resolution.
