HomeMy Public PortalAbout1989-05-08 ATM Report of the ATM — 5/8/89 ANNUAL TOWN MEETING May 8 , 1989 In accordance with the warrant , the Annual Town Meeting was held in the Brewster Elementary School Cafetorium , Monday , May 8 , 1989 . The meeting was called to order at 7 : 00 P. M . by the Moderator, Stephen L. Doyle . The Tellers were Dorothy A. Grenier, June F . Gallant , Doris W . Powell , and Edwin J . Blease . Checkers were Carl Scrivener, Jean Gage, Antoinette Mara , Mary Tucker, and Mitsy Unger. A quorum was present . The Warrant was read by Assistant Town Clerk , Donna Luscombe with the ex- ception of the Articles which were read as they were being considered . RECESSED Annual Town Meeting in order to open Special Town Meeting at 7 : 15 P. M . RECONVENED at 9 : 00 P. M . ARTICLE 1 . To act upon the Annual Report of the Board of Selectmen , Town Officers and other Special Committees . REPORT OF THE SIGN REGULATION REVIEW AND REVISION COMMITTEE As you may recall , we were appointed as a result of a vote at the Annual Town Meeting of May 1988 . The members are as follows : Janet Francis , representing the Historic District Committee Joyce Libby, representing the former Sign Committee Frances Malone , representing the Board of Trade Alan McClennan , representing the Board of Selectmen Marjorie Pierce , representing the Planning Board John Sickman , representing the Moderator Jane C. Wagoner, representing the Board of Appeals At the organizational meeting , held August 3 , 1988 , Joyce Libby was elected Chairman , Janet Francis , Vice Chairman and Alan McClennan , Secretary . The Committee has met generally twice a month since its organization . We have reviewed the sign regulations of several Cape towns and State and national 85 ATM — 5/8/89 sources . We used the code suggested under Article 101 of the Annual Town Meeting of May 1988 as our editorial base . We have had our quarrels , each of gel us having had a different background and interest in signs . We have made ur Review and Revision work within a month major progress and will complete o or so . When that is done we propose to produce a number of copies to transmit to the several boards , commissions and committees and will be asked to hold one copy as a "counter copy " for review by the public . After a period of review and comment , the Committee proposes to send a final version to the Selectmen for inclusion in the next Special Town Meeting and to the Planning Board for presentation at a Legal Public Hearing . To see if the Town will vote to authorize the Town Treasurer , with the approval of the Board of Selectmen , to borrow money from time to time in anticipation of the revenue for the financial year beginning July 1 , 1989 of the General Laws , Chapter 44 , Section 4 in accordance with the provisions and to issue a note or notes as may be given for a period of less than one ( 1 ) year, in accordance with the General Laws, Chapter 44 , Section 17 . ADOPTED UNANIMOUSLY ARTICLE 3 . To see if the Town will vote to take no action regarding its Herring or Alewife Fishery . ADOPTED UNANIMOUSLY ARTICLE 4 . To see if the Town will vote to delete the Personnel Bylaw (Sections 1 through 31 ) now in existence with the exception of the wage scales and substitute the text of a new Personnel Bylaw , to become effective July 1 , 1989 as printed herein : PERSONNEL BYLAW SECTION 1 . PURPOSE AND AUTHORIZATION The purpose of the personnel bylaw is to establish fair and equitable per- sonnel policies and to establish a system of personnel administration based on merit principles that ensures a uniform , fair and efficient application of per- sonnel policies . This bylaw is adopted pursuant to the authority granted by Article LXXXIX of the Constitution of the Commonwealth and General Laws , Chapter 41 , Sections 108A and 108C . 86 i lee I ee eeev vee ATM — 5/8/89 eee SECTION 2 . APPLICATION All Town departments and positions shall be subject to the provisions of this bylaw except elected officers , employees with personal contracts , employees of the school department and members of the Police Department . The provisions of this bylaw shall not be applicable to employees covered under collective bargaining agreements except where such collective bargaining agreements ex- pressly so provide . SECTION 3 . PERSONNEL BOARD (a ) Composition , Terms of Office . The Board of Selectmen shall serve as the Personnel Board under the authority of Chapter 41 , Section 108C of the General Laws . The term of office shall be lee concurrent with the term of each Selectman . (b ) Powers and Duties . The Board shall be responsible for establishment and maintenance of a personnel system based on merit principles , the classification and reclassification of posi tions , an annual compensation plan , and the development of personnel policies pursuant to Section 5 of this bylaw . SECTION 4 . PERSONNEL SYSTEM lee I V11 eeeeA personnel system shall be established by promulgation of policies pursuant lee eee e% 11 to Section 5 . The personnel system shall make use of current concepts of person - nel management and shall include but not be limited to the following elements : (a ) Method of Administration . A system of administration which assigns specific responsibility for all elements of the personnel system , including : ell maintaining personnel records , implementing effective recruitment and selection ee processes , maintaining the classification and compensation plans , monitoring the application of personnel policies and periodic reviews, and evaluating the personnel system . 531 VVVVV Ile el%e'le eel (b ) Classification Plan . A position classification plan for all employees sub 11 ject to this bylaw shall be established , based on similarity of duties performed and the responsibilities assumed so that the same qualifications may be reason- ably required for, and the same schedule of pay may be equitably applied to , all positions in the same class . ADOPTION AND AMENDMENT OF PERSONNEL POLICIES The Board of Selectmen /Personnel Board shall promulgate personnel policies obligations astfollows employees subject to this bylaw . defining the rights , benefits Policies shall be adopted or amended (a ) Preparation of Policies . Any person proposing a new or amended policy shall provide the substance and the reason for the proposed policy to the Board of Selectmen /Personnel Board in writing . The Board of Selectmen /Personnel Board shall hold a public hearing on any proposed policies or amendments . Any proposed policies or amendments shall be posted at least five (5 ) days prior to the public hearing in prominent work locations , and a copy of all proposals shall be provided to the Town Clerk . (b ) Public Hearing . The Board of Selectmen /Personnel Board shall present the proposed policy (ies ) or amendment (s ) , the purpose of the proposal , and may implication of any proposed change at the public hearing . Any person attend the hearing , speak and present information . Within twenty (20 ) days e Personnel Board / Board of Selectmen shall con - after such public hearing , th sider the proposed policies and may vote to adopt the policies , (with or without modifications ) , reject the policies , or indicate that further study is necessary . Policies shall become effective upon approval of the Personnel Board / Board of Selectmen , unless some other date is specified . SECTION 6. SEVERABILITY The provisions of this bylaw and any regulations adopted pursuant to this ylaw provision or regulation is held invalid , the re - bylaw are severable .
