RESOLUTION NO. 23-106
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA DIRECTING THE INTERIM CITY
MANAGER TO ENFORCE CITY LAND USE RIGHTS
THROUGH A CODE ENFORCEMENT PROCESS THAT
PROHIBITS PROPERTY OWNERS FROM ENCROACHING
UPON CITY OWNED PROPERTY AND EASEMENT RIGHTS;
PROVIDING FOR INCORPORATION OF RECITALS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, City of Opa-Locka staff has discovered that several City property
owners are encroaching upon City of Opa-Locka ("City") owned property and utility
easements; and
WHEREAS, these acts cause inconvenience and restrict the City from conducting its
business of providing City services; and
WHEREAS, it is necessary that property owners within the City be prohibited from
encroaching upon City -owned property and easements; and
WHEREAS, the City Commission desires to enforce the City's land use rights through
a code enforcement process that operates to prohibit City property owners from encroaching
upon City owned property and easement rights; and
WHEREAS, the City Commission desires that the Interim City Manager enforce
City land use rights through a code enforcement process that prohibits property owners
from encroaching upon city owned property and easements rights is in the best interests
of the City of Opa-Locka and its residents.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OPA LOCKA, FLORIDA:
SECTION 1. RECITALS ADOPTED.
The recitals to the preamble herein are incorporated by reference.
SECTION 2. AUTHORIZATION
The City Commission of the City of Opa-Locka authorizes and directs the Interim
City Manager to enforce City land use rights through a code enforcement process
that prohibits property owners from encroaching upon city owned property and
easement rights.

SECTION 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re -lettered and corrections of
typographical errors, which do not affect the intent of this Resolution may be
authorized by the Interim City Manager, following review by the City Attorney,
without need of public hearing, by filing a corrected copy of same with the City
Clerk.
SECTION 4. EFFECTIVE DATE
This Resolution shall take effect upon the adoption and is subject to the approval
of the Governor or Governor's Designee.

An ordinance of the City Commission of the City of Opa-locka prohibiting residents from encroaching on City
property and easements.
Staff Summary:
City staff have recently determined that several residents are encroaching on City property and utility
easements areas. These acts cause inconvenience and restrict the City from conducting daily business and
providing services. It is imperative that residents are prohibited from encroaching and invading these areas
and are cited as necessary for habitual behavior.
Financial Impact - There is no immediate financial impact. There could be subsequent legal costs.
Proposed Action:
It is recommended the City Commission of the City of Opa-locka adopt legislation prohibiting residents from
encroaching on City property and easements.
