The Board of Public Works of the City of Richmond, Indiana, met in regular session at the office of said .Board Thursday May 31st, 1928 at 9 o 'clock A.M. All the members of said Board Messrs, Reid, McFall and Henley, being present . The following proceedings were had, to-witj The Clerk presented, remonstrance or an appeal to the Circuit Court in matter of . improvement of South "L" Street , from South 5th to 9th Street, as provided under Improvement Resolution No. 864- 1928, filed by Gath P. Freeman Attorney for the C. & 0. Ry. Co . , and purporting to be signed by 40% of the owners of property zh.- abutting upon said street and liable to assessment for the cost of said improvement, objecting and remonstrating against said pro- posed improvement for each of the following causes and reasons, • to-wit : First . That said improvement is not required by the public needs. Second, That the cost of proposed improvement would be excessive considering the character and value of the real estate to be assessed. Third. That the cost of the same "will exceed the benefits to the real estate to be assessed. Fourth. That said Board or common council has no legal authority to order the same . The Board after considering said appeal, and. again viewing said street proposed to be improved, direct the Clerk to file said re- appeal with the Clerk of the Wayne County Circuit Court of Indiana, as by law provided. The Board approved the contract & bond of J . L.. Teegarden & Co . , contractor under Improvement Resolution No. 8 56-1928. The Board unanimously adopted Improvement Resolution No. 866-1928, for the improvement of Harris Street, by constructing cement side- walks, curb & gutter & planting of trees on both sides ; also, grading & paving the roadway with either Sheet Asphalt, Rock Asphalt, Re- inforced Concrete or Bituminous Macadam, from Maple to School St. Upon request - of the School Board, the Board direct that School Street be paved with concrete on north side of street , in front of School property. Claims in amount of $9610. 81 were allowed. The Board then adjourned, Prest . of Board Attest : Clerk of Board '
