HomeMy Public PortalAbout1990-05-14 Annual Town Meeting Report of the ANNUAL TOWN MEETING May 14, 1990 In accordance with the Warrant , the Annual Town Meeting was held in the Brewster Elementary School Cafetorium , Monday , May 14 , 1990 . The meeting was called to order at 7 : 05 p . m . by the Moderator , Stephen L . Doyle . The Tellers were Dorothy Grenier, June F . Gallant , Ruth A . Hanlon , Edwin J . Blease , Bill Nielsen , Nancy E . Brown , and Janice MacMillan . The Checkers were Dorothea Dugan , Jean Gage , Helen Allen , Carl Scrivener , Mildred Unger, and Mary Tucker . A quorum was present . The Town Clerk , Joan K . Cole , read the Annual Town Meeting Warrant and the return of the Warrant . There being no objection , the Moderator dispensed with the reading of all the articles . PROCLAMATIONANDRESOLUTION WHEREAS , We , the inhabitants of the Town of Brewster , assembled at this Annual Town Meeting the fourteenth day of May 1990 "to act and do upon the whole as the inhabitants of said Town of Brewster shall think proper ; " and WHEREAS , It is appropriate for good citizens to honor their loyal and faithful public servants . Therefore , the Board of Selectmen , on behalf of all the citizens of the Town of Brewster, extend to the widow of Lawrence B . Doyle a standing note of thanks for his many years of dedicated service as a member of the Board of Selectmen and the Finance Committee . We are grateful for Mr . Doyle 's great sense of history of the Town of Brewster, telling his favorite tales to make those around him laugh . He was always there when someone needed assistance . One cannot adequately present the invaluable contributions that Mr . Doyle gave to the Town of Brewster . We will remember Lawrence B . OBJECTIVES %11 11 In performing its responsibilities , the Finance Committee had the following % v ell 44 eel objectives : I VI 98 r r� 1�a v Pee ATM — 5 / 14/90 le vee 14 Iv ell e A . Essential Services ell eel e The first objective of the Finance Committee was , and is , to assure that the Town 's financial situation is such that the residents of Brewster ell ell eve are provided all essential services . The Finance Committee has also con eve v sidered the need to fund those projects which are required to meet population growth and educational and environmental mandates . — B . Tax Rates Another objective of the Finance Committee is to keep the tax rate as low as possible and still provide the required services for the Fiscal _ Year 1991 . The tax rate will also be affected by expenditures which will likely be required in the future ( e .g . , expanded school facilities ) and other events not entirely within our control (e .g . , decreased state — aid ) . FY - 1991 revenue will decrease as the result of less state aid , with additional revenues instead to be generated by an increase in the Tax Rate . Positive steps have been taken in 1990 to increase fees for user services by the Board of Selectmen and the Water , Recreation and Golf Commissions and thus minimize the impact on the Tax Rate . The Finance Committee endorses the charging of user fees to make services self- supporting as long as those fees are not prohibitive . C . Proposition 2 '/2 The Finance Committee feels that it is in the best interest of the Town to restrict Fiscal Year 1991 spending to an amount which will not exceed Proposition 2 '/2 limits . The new levy limit is estimated at u $ 11 ,055 ,064 * . F * With the available Free Cash and assuming the Finance Com - mittee recommendations are followed ( including approval of certain warrant articles outside of Proposition 2 '/2 ) , the Town will avoid the need for a general Proposition 2 '/Z override vote . IV . OPERATING BUDGET FY 1991 Operating Budget $ 15 ,028 , 160 FY 1990 Operating Budget 13 ,986 ,300 — $ 1 ,041 ,860 +7 .45% A . FY 1991 Operating Budget — Preliminary Considerations Prior to the preparation of the FY 1991 Budget and early in the budget process , the Finance Committee advised all those with budgetary re - sponsibilities of the financial difficulties to be expected in FY 1991 and the Board of Selectmen established budget guidelines for FY 1991 recognizing potential restrictions from sources beyond the control of 99 F 14 ATM — 5 / 14/90 the Town . As in past years , an analysis of the budget shows a large percentage of the proposed expenditures are either generally subject to very little control or are attributable to the decisions made by the voters at earlier Town meetings or by ballot . The salaries and wages make up a large portion of the budget , while the balance of the budget is roughly defined as those expenditures which are necessary simply to keep the various Town activities operating on a normal basis . The school budgets , which are a separate category , are under the direction of the Brewster School Committee , Cape Cod Tech School Committee and the Nauset Regional School Committee . The operating budget originally submitted to the Finance Committee , excluding the schools , called for an increase of 7 . 3% . With the school budgets included , the increase for FY 1991 over FY 1990 was 9 . 31 % . The FY 1991 Operating Budget recommended in Article 4 in the amount of $ 15 ,028 , 160 represents an increase over the FY 1990 budget of $ 1 ,041 , 860 or 7 . 45% . The remaining 12% is necessary to handle the 11, day -to -day operations of the various Town functions . The determina - tion of whether these expenditures are essential has , in the past , been left largely to the judgement of elected and appointed officials . In addition , 10% of the increase in the FY 1991 Budget requests was attributable to normal operations ; 90% of the requested increases were directly related to items which have previously been approved by Town vote or otherwise required by law . . * Excludes other costs related to SEMASS operations such as insurance , personnel , equipment maintenance , etc . * * Excludes $ 128 ,000 for merit increases . B . Comments and Conclusions — Operating Budget 1 . The Finance Committee believes that credit should be given to mmm Town officials and their associates who have been responsible for preparing the items comprising the operating budget . As men - tioned earlier , the overall budget , including the school budgets , has been increased by less than 9% , as compared with 24% last year . The Finance Committee appreciates the effort that has been made to take the Town 's financial situation into consideration when plans were being made for FY 1991 . In most cases recogni - tion has been given to financial realities and figures requested are essential to maintain the present level of services . 2 . Although there were differences of opinion and split votes on some of the budget items , the only major disagreement involved the Elementary Schools Operating Budget . The Finance Com - mittee voted by a majority to reduce the budget by $40 ,000 from $2 ,516 ,074 to $2 ,476 ,074 . This lower figure is included in Article 4 of the Warrant . Those in favor of the reduction believed that the budget could be reduced by $40 ,000 without compromising educational programs or educational quality . Moreover , even with the reduction as voted by the Finance Committee , the Brewster Elementary School budget would be increased by almost 11 % of their FY 1990 Budget . Those on the Finance Committee who did not support the reduction felt that the School Committee had carefully scru - tinized the budget and taken the Town 's financial condition into consideration . 101 ATM — 5 /14 /90 V . WARRANT ARTICLES A . Introduction Many of the Warrant Articles that the Finance Committee reviewed are routine in nature and need no comment . Others , however , are very important , and are commented upon in the Warrant itself . At this point we will refer only to "financial " articles . Compared with the operating budget and the "routine " articles , these discretionary articles provide the voters with some choices and a chance to establish priorities given the Town 's fiscal constraints . B . Status Report 1 . Free Cash — For a variety of reasons , Brewster is in a solid " Free Cash " position , although this situation is very likely to change in Fiscal Year 1992 . Free Cash Certified by State 6 /30 /89 $ 1 ,736 ,422 Less Spending Authorized at Special 310 ,000 Town Meeting 11 / 13 /89 $ 1 ,426 ,422 ; In addition to the above sum , the Town received $500 ,000 from the State as partial reimbursement for the purchase of Baker 's Pond land . When the purchase was authorized , it was agreed that when reimbursement occurred , it would be used to reduce the tax rate or considered as "free cash " if the Town so voted . For a fuller discussion on this point, please refer to Article 7 . 2 . Available Funds — Assuming the Operating Budget will be ap - proved as recommended , the Town has available for appropriation to the remaining articles the sum of $899 ,909 . The grand total of all financial articles is $2 ,202 ,903 . C . Options In contending with this situation , the Town has several options : 1 . To avoid complications with Proposition 2 '/2 , the Town can vote to spend only the amount available . This means that some items will have to be eliminated or reduced or , alternately , that our free cash will have to be used ; 2 . It may borrow the funds desired ; 102 y� ATM — 5 / 14/90 3 . It may vote to spend funds outside of the 2 '/2 limit . This requires a majority vote at Town meeting and a majority of voters on a _ later ballot election . D . Considerations In reaching the conclusions and recommendations which follow in the _ Warrant , the Finance Committee studied all pertinent information and discussed the articles with responsible parties in public hearings . Priorities were established and decisions made which , in the Finance — Committee 's judgment , would best serve the Town in FY 1991 and the future , taking into consideration both current local conditions and future prospects . E . Committee Action 1 . Recommend Approval — Among the major expenditures included in the articles and approved by the Finance Committee , either in total as requested or on a reduced basis , are : Article 4 — Operating Budget $ 15 ,0281166 Article 6 — Reserve Fund 1. 25 ,000 Article 28 — Ambulance Replacement 80 ,000 Article 30 — DPW Equipment 114 ,000 2 . Recommended Borrowing — The Finance Committee also recom - mended that the Town borrow funds for the following : Article 56 — Middle School Renovation 3 . Recommended Placing "Outside of 2 '/2 " — The Finance Committee also recommends that the following be approved as being outside the limitations of "2 '/2 " with the understanding that a majority vote by ballot is required later : Article 20 — Elementary School Architect and Design Service Article 57 — Middle School , First -Year Renovation The Finance Committee believes that these expenses should be — approved in the same manner as other capital expenditures ; i .e . , outside Proposition 2 '/2 . 4 . Recommended that the following major articles be disapproved : Article 40 — New Wellfield Article 55 — Land Acquisition Article 58 — New Access Way for Library — 103 Ile Ile ATM — 5/14/90 F . Conclusion If the Finance Committee recommendations are followed , the total expenditures for warrant articles , exclusive of the budget , will be $ 1 ,839,638 and this sum may be paid without adversely affecting our "free cash " position for Fiscal Year 1992 . The Finance Com - mittee also believes that the recommended expenditures will be suf- ficient to provide necessary services and to move ahead on requested capital expenditures which are essential to the future of the Town . VI . IMPACT ON TAX RATE There are so many variables involved in setting the tax rate apart from expenditures authorized at Town Meeting that it is next to impossible to make accurate predictions at this point . Nevertheless , the following may help to put the picture in perspective . It has been broadly estimated that an expenditure of $500 ,000 is equivalent to 40 cents on the tax rate . If this estimate is correct , a $250 ,000 expenditure would mean an addi - tional $40 a year on the tax bill for property assessed at $200 ,000 . VII . The Finance Committee wishes to express its appreciation to all Town officials , boards , commissions and employees for their assistance . Particular thanks are directed to Executive Secretary , Charles Sumner , and Adminis - trative Assistant , Wayne Southworth , and their staff for many hours of help and guidance . Eric Rasmussen , Chairman Charles Dedon , Vice-Chairman Dion Dugan Edith Foster Harold Harrison Nancy Shaw Arthur Stringer Robert Thomas Thomas Watkins BREWSTER FINANCE COMMITTEE 104 Ile, ATM — 5/14/90 TRANSCRIPTION OF THE REPORT OF THE GROWTH POLICY SUBCOMMITTEE WILLIAM HENCHY FOR BOARD OF SELECTMEN Many of the financial constraints that the Town is under tonight stem from the very large expansion in growth in population and development the Town has had over the past ten years . In recognizing those problems , the Board of Selectmen last year set up a Growth Policy Subcommittee consisting of a member of the Planning Board , a member of the Board of Health , two members of the Board of Selectmen , a member of the Water Commissioners and Ex-Officio Member Charles Sumner , Executive Secretary . The Subcommittee reviewed some of the Town 's policies with respect to where it wants to be and where it is headed in terms of development . The overriding consensus that came out of the discussions was that the Planning Board and all the other members of the Subcommittee felt that the Town 's 1970 Master Plan goals which consisted primarily of maintaining the rural character of the Town and specific recommendations in terms of the balance of development the Town was going to have , specifically 1 /3 of the Town to be residential , 1 /3 of the Town to be maintained as open space and 1 /3 to be considered as wet- lands , ponds and generally unsuitable for development , which we discovered is not always the case , and a small , approximately 5% , area devoted to commercial and industrial uses . It was the consensus that those goals are still the goals of the Planning Board . The 208 Study which is the basis of all of our Zoning and our groundwater recommendations is consistent with those goals and the Town endeavors to try to find ways in this kind of a climate in order to maintain a direction towards those goals . The problem that we are facing bears a little bit of restating briefly . The Town has had a major loss of land to development over the last ten years . During the period from 1981 to 1986 the Town lost in excess of 1800 acres to development and the population during the same time period went from 5400 to almost 8000 people , where it stands today . The result of that are things that everyone recognizes . There is a substantial increase in traffic and particularly there is a direct cor - relation between the Town 's financial burdens and the increase in growth that the Town has experienced . In looking at the Town 's records from the Annual Town Reports and Recap Sheets per capita spending in the Town from 1980 to 1990 if everything is approved in the Annual Warrant will have gone from approximately $950 . 00 to in excess of $2 ,200. 00 per person for the expendi - tures of the Town . The total spending per year during the same time period went from $5 . 3 million to $ 19 . 1 million if everything is approved on the Warrant . The real problem that the Town is facing is that the Town is only approximately 1 /2 developed in terms of what is left . The Subcommittee found that there is still open space available for development which will lead the Town to have approximately 3200 more dwelling units that can be built under today 's zoning . That translates , if ,you use the figure of three persons per household , into ap- proximately 9600 more people into the town . The Subcommittee worked on a series of outlines for recommendations to bring to this Town Meeting . Many 105 777 , ATM — 5 /14/90 of those have been implemented and have been brought before the Special Town d by the Planning Board . One of the pri - Meeting by way of Articles presente mary recommendations the Subcommittee wanted to follow through on and the Planning Board has followed through on is a Site Review Process and that is Article 11 of the Special Town Meeting and the Subcommittee asks your con sideration and favorable action on this article . The Subcommittee looked at the idea of cluster development and flexible development, which would allow the Town to have shorter roads , dedicate more of the land in the subdivisions for open space and allow some density bonuses for affordable housing , which the Town is under the obligation from the State to provide . The Planning Board has two articles ( 9 & 10 ) in the Special Town Meeting Warrant . The Subcommittee also wanted to take a look at the issue x of phased growth to try to level out the peaks and valleys in the development as it goes forward . A proposal to that effect is contained in Article 10 . There is some work that remains to be done and of primary consideration to both the Planning Board , and the Board of Selectmen , has been the issue of traffic in the Town . There may be some new information coming out of the re - I cent MEPA Review from The Villages . The Town is expecting some sort of decision on that this Friday and hopefully , the Town will have some positive f results to show for all the effort . Finally , the Subcommittee would like to recommend that the Town committees and departments go forward and work closely with the Cape Cod Commission Act in terms of the development of the local policy plans . All of those recom - mendations , and most of them have been brought forward by the Planning Board for your review are regulatory and while they will affect the rate of Bevel opment and what it will look like when it is finally developed , none of those will have any impact on the very serious problem , which is the capacity to nearly double or more than double the population of the Town based on the developable land that is still out there . For that reason , the Subcommittee also recommends that the Land Acquisition Committee program be continued and the funding for that committee be adopted ( Article 19 ATM ) . To see if the Town will vote to authorize the Town Treasurer , with the approval of the Board of Selectmen , to borrow money from time to time in anticipation of the revenue for the financial year beginning July 1 , 1990 in accordance with the provisions of the General Laws , Chapter 44 , Section 4 and _ to issue a note or notes as may be given for a period of less than one ( 1 ) year , in accordance with the General Laws , Chapter 44 , Section 17 , or to take any other action relative thereto . _ MOTION : I move that the Town vote to approve Article 2 as printed in the Warrant . A sign denoting the name of a way may be placed at the intersection of a public way and a private way and /or at the intersection of two ( 2 ) unposted private ways . Said sign shall not exceed one ( 1 ) square foot in area and , if more than one ( 1 ) sign is necessary at such intersections , then all such signs shall be affixed to a single sign post , frame structure , or other support . ( No permit required . ) 7 . Permitted antique shops are allowed a sign not to exceed four ( 4 ) square feet in area . D . SIGNS PERMITTED IN BUSINESS AREAS : ( "C- H " ) — Commercial High and ( " V - B " ) — Village Business Districts : 1 . Any sign permitted in the Residential Districts ( " R - R " , " R - L " and " R -M " ) and subject to the same provisions . 2 . In general , two ( 2 ) signs are permitted for each business in a commer- cial zone . For businesses that have frontage on more than one ( 1 ) public way , one ( 1 ) additional free -standing sign of not more than one ( 1 ) half the square foot area of the first free -standing sign is permitted , but must be placed at least two hundred feet ( 200 ' ) away from the first sign . 3 . A single business on a single lot is permitted one ( 1 ) free -standing sign , not to exceed eight ( 8 ) square feet ; and either one ( 1 ) wall projecting , roof, or awning sign not to exceed six ( 6 ) square feet . If a free -standing sign is not used , then the total square foot area of the other sign shall not ex - ceed fourteen .( 14 ) square feet . 4 . Sign permitted for Row Commercial and Planned Business Develop- ments ( more than one ( 1 ► business on a single lot ) : a . Said sign shall not exceed one ( 1 ) square foot in area and , if more than one ( 1 ) sign is necessary at such intersections , then all such signs shall be affixed to a single signpost , frame structure , or other support . 2 . Signs indicating name of a resident or activity are not permitted . 3 . Signs are permitted at the following intersections of public ways which service commercial areas , pre -existing businesses , or town -owned community facilities : Route 6A and Thad Ellis Road Route 6A and Underpass Road Route 137 and Underpass Road Route 137 and Freeman 's Way Route 124 and Route 6A Route 39 and Freeman 's Way a . Signs shall be of a uniform design with a dark green background ( Dark Green Glossy as in Town Signs or equal ) , and white letters all in a non -dayglo paint, and supported by unpainted ground treated 4x4 posts . b . Signs shall not exceed twelve ( 12 ) square feet in area and three ( 3 ) feet in width between the support posts , nor be more than six ( 6 ) feet in height . 137 ATM — 5 / 14/90 c . Signs shall be constructed of a series of horizontal panels six ( 6 ) inches in height and constructed in a manner that as many as eight ( 8 ) panels may be placed , one above the other and be separately removable . d . The subject matter of a sign shall be generic in nature such as " Drug Store " identifying an activity or service , not a specific business name . e . Each six ( 6 ) by thirty -six ( 36 ) inch panel can identify several activities depending upon lettering requirements and all lettering shall be of uniform character . f . A sign may be installed by a single business or group of businesses , and whether one or several , it shall be the responsibility of the party or 7 parties whose name ( s ) appear on the permit application ( s ) to ensure z' that the sign is maintained in good repair and appearance . g . The lettering on sign shall be simple block lettering as in the manner of recent signs installed by the Town with letters not more than three and one -half inches ( 3% " ) in height . h . If the sign is to be placed on a state highway , a permit from the State shall be obtained by the applicant before application is formally made to the Sign Commissioner in accordance with Chapter 93 , Section 29MGL . Said permit shall form part of the application . i . If the sign is to be placed upon private property , written authori - zation therefore shall be obtained from the owner before application is formally made to the Sign Commissioner . Said authorization shall form a part of the application . j . The location of all signs shall be selected by the Sign Commis - sioner with the advice of the Traffic Management Advisory Committee or successor to assure traffic safety . k . There shall be no more than one ( 1 ) sign at any intersection . 1 . When the public convenience and necessity require it , the Board of Appeals may grant a Special Permit for signs at other intersections providing directions to scenic areas , nonprofit institutions other than educational , or similar activities of a predominantly nonprofit nature . m . Any traffic or directional sign owned and installed by a govern - mental agency shall be permitted . F . HEIGHT : No free -standing sign shall be in excess of ten feet ( 10 ' ) in height . No sign shall be constructed in a manner that obstructs public passage . 138 ATM — 5/ 14/90 G . REGULATIONS FOR SPECIFIC TYPES OF SIGNS : 1 . Changeable -Copy Signs : When necessary to inform the public of chang - ing events , activities , dates , times , and other matters of important interest ; _ the Sign Commissioner may issue a permit for a changeable-copy sign not to exceed eight ( 8 ) square feet in area . Signs must be legible . 2 . Accessory Signs : Accessory signs are permitted . Total area cannot exceed one ( 1 ) square foot . 3 . Directional , Informational , or Safety Signs : In addition to other per- mitted signs , directional , warning or traffic signs necessary for the safety and convenience of residents , customers , employees , and visitors are per- mitted in all areas . Signs shall not exceed one ( 1 ) square foot in area and a maximum of four ( 4 ) will be allowed per site . The Sign Commissioner may grant exceptions to this subsection on a case - by -case basis if he finds that the site requires more or larger signs . ( No permit required . ) — 4 . Political Signs : Political signs are permitted in all districts on private property with the approval of the property owner and shall not exceed four ( 4 ) square feet in area and be subject to the rules that no sign shall be posted more than fifteen ( 15 ) days in advance of the date of the event to which it refers and shall be removed within seven ( 7 ) days of the event to which it refers . ( No permit required . ) 5 . Temporary Signs : Temporary signs cannot be used for more than twelve ( 12 ) months but are permitted in all zones . Some may require a permit from the Sign Commissioner . The sign shall be removed at the end of this period unless a renewal application has been approved . The Sign Commissioner shall ensure that signs shall be legible . a . Construction Signs and Real Estate Signs : ( No permit required . ) 1 ) Signs are permitted in all zones . 2 ) Not more than one ( 1 ) sign is permitted on a single site . 3 ) Signs may not exceed four ( 4 ) square feet in area . — 4 ) Signs must be placed on the site . 5 ) Signs shall be removed within seven ( 7 ) days of issuance of occupancy permit or transfer of ownership . b . Subdivision Lot Plan Signs : These are permitted if not in excess of twelve ( 12 ) square feet on any subdivision with eight ( 8 ) lots or more provided no " For Sale " signs are placed on the individual lots . The sign shall be placed within the subdivision and not easily visible from the abutting way . Individual lot number signs not in excess of one ( 1 ) square foot may be placed on each lot . _ 139 ATM — 5/14/90 C . Window Signs : Window signs are permitted as long as the total area of all such signs does not exceed twenty -five percent ( 25% ) of all window area on which the signs appear . ( No permit required . ) d . Special Event Signs : When an . activity is to be opened in a non - residential district, the owner may put up an informational sign not in excess of twelve ( 12 ) square feet in area , which may remain in place for not more than 15 days . 6 . Illumination of Signs : If signs are illuminated , it shall be done so by a direct, or external light source . Light bulbs or tubes shall not be visible to the motoring public from a public way . Directional signs , internally lit , are permitted when not in excess of one ( 1 ) square foot in area . 7 . Animated Signs : Animated signs are prohibited . 8 . Mailboxes : Numerals identifying street numbers and /or letters naming the occupant of a building may be placed on both sides of a mailbox or on the door ; letters not to exceed two and one -half inches ( 2% " ) in height, numerals not to exceed four inches ( 4 " ) in height . Advertising on mail - boxes is not permitted . 9 . Banners or flags to call attention to a business or activity are pro - hibited . Banners used for Town festivals are permitted . H . GENERAL PROVISIONS RELATING TO ADMINISTRATION , EN - FORCEMENT , PENALTIES AND REMOVAL : 1 . Enforcement , Permits , and Penalty : a . The Sign Commissioner is hereby authorized to enforce this Article . b . Permits and Certificates of Appropriateness : All signs regulated by this Article require a sign permit issued by the Sign Commissioner with exception of ARTICLE VI , C - 1 , C -6 , G -3 , G -4 , G -5a , and G - 5c . All signs which require a sign permit shall be marked with an identifi - cation sticker supplied by the Sign Commissioner . All signs which require a sign permit and lie within the jurisdiction of the Old King 's Highway Regional Historic District ( OKHRHD ) must first obtain a Certificate of Appropriateness from the OKHRHD Committee . A sign without a permit is illegal . c . Fees : Fees for sign permits shall be set by the Board of Selectmen . d . The Sign Commissioner is authorized to order the repair or removal of any sign and its supporting structure which the Sign Commissioner judges dangerous or in disrepair or erected or maintained contrary to this Article . 140 ; ti ATM — 5 /14/90 e . The Sign Commissioner is authorized to issue citations for vio - lations of these regulations by the method provided in MGL , Ch . 40 , Section 21 D . f . Failure to respond to a properly issued citation within 21 days will make the person , trust or other enterprise exhibiting a sign not in compliance with this Article , unless afforded protection under Article VIII of this Chapter , shall be subject to the following penalty : A . First offense : Warning B . Second offense : Twenty -five dollar fine C . Third offense : Fifty dollar fine D . Fourth and subsequent : Two Hundred dollar fine starting on the thirty-first ( 31st ) day after issuance of said citation . 2 . Signs not complying with this ARTICLE : a . Signs without a valid permit shall be removed within sixty ( 60 ) days of passage of this ARTICLE . b . Signs with valid permits : 1 ) A sign with a valid permit issued prior to enactment of this ARTICLE must remain in compliance with the requirements and conditions that enabled the valid permit to be originally issued . 2 ) Where a sign identifying a business has approved subsidiary signs , the subsidiary signs may be replaced provided they remain in compliance with the requirements and conditions that enabled the valid permit to be originally issued . 3 ) Failure of compliance will result in automatic revocation of the prior issued valid permit and require compliance with this ARTICLE for issuance. of a current valid permit . 3 . Maintenance : A sign shall be maintained in a safe and secure manner and in a good state of repair including paint . If the Sign Commissioner finds that a sign does not comply with this ( maintenance ) section of this ARTI - CLE , written notice of noncompliance and the reasons therefore shall be sent, by certified mail , return receipt requested , to the person or persons to whom the permit was issued . If the specified defects in the sign have not been corrected or the sign removed within thirty ( 30 ) days , the Sign Commissioner shall revoke the permit and shall notify the person ( s ) to whom the permit was issued that the sign is now in violation of this ARTI - CLE and must be removed . 141 r ATM — 5 / 14/90 4 . Abandoned Signs : When the Sign Commissioner finds that a sign has been abandoned , whether or not a permit has been issued , written notice ordering its removal shall be sent by certified mail , return receipt requested . a . to the owner of the property on which the sign is located , and b . to the person to whom the permit was issued if not the owner . 5 . Removal of Abandoned Signs or Signs in Violation of this ARTICLE : If sign on public property is not removed within thirty ( 30 ) days of the issuance of an order , the Sign Commissioner shall remove or arrange for the removal of the sign . The sign shall be stored by the Sign Commissioner in a safe location for sixty ( 60 ) days after which time it may be appropriately disposed of . Any costs incurred shall be borne by the sign owner . 6 . Appeals : Any individual aggrieved by a decision of the Sign Com - missioner may appeal to the Brewster Board of Appeals as provided under Chapter 40A of the General Laws of the Commonwealth of Massachusetts except that no variances may be granted for off- premise signs . or to take any other action relative thereto . Signs shall be of a uniform design with a dark green background ( Dark Green Glossy as in Town Signs or equal ) , and white letters all in a nonAayglo paint , and supported by unpainted ground treated 4x4 posts . b . Signs shall not exceed twelve ( 12 ) square feet in area and three ( 3 ) feet in width between the support posts , nor be more than six ( 6 ) feet in height . c . Signs shall be constructed of a series of horizontal panels six ( 6 ) inches in height and constructed in a manner that as many as eight (8 ) panels may be placed , one above the other and be separately removable . d . The subject matter of a sign shall be generic in nature such as " Drug Store " identifying an activity or service , not a specific business name . e . Each six ( 6 ) by thirty -six ( 36 ) inch panel can identify several activities depending upon lettering requirements and all lettering shall be of uniform character . j f . A sign may be installed by a single business or group of businesses , and whether one or several , it shall be the responsibility of the party or parties whose name ( s ) appear on the permit application ( s ) to ensure that the sign is maintained in good repair and appearance . 149 C Ile ATM — 5 / 14/90 el g . The lettering on sign shall be simple block lettering as in the Y manner of recent signs installed by the Town with letters not more than 1 three and one -half inches ( 3'/2 " ) in height . h . If the sign is to be placed on a state highway , a permit from the State shall be obtained by the applicant before application is formallyok made to the Sign Commissioner in accordance with Chapter 93 , Section I le 29MGL . Said permit shall form part of the application . F i . If the sign is to be placed upon private property , written authori - zation therefore shall be obtained from the owner before application t is formally made to the Sign Commissioner . Said authorization shall W form a part of the application . I j . The location of all signs shall be selected by the Sign Commis- sioner with the advice of the Traffic Management Advisory Committee or successor to assure traffic safety . leeee%%%% k . There shall be no more than one ( 1 ) sign at any intersection . Ile I . When the public convenience and necessity require it, the Board of Appeals may grant a Special Permit for signs at other intersections providing directions to scenic areas , nonprofit institutions other than educational , or similar activities of a predominantly nonprofit nature . m . Any traffic or directional sign owned and installed by a govern - mental agency shall be permitted . F . HEIGHT : No free -standing sign shall be in excess of ten feet ( 10 ' ) in height . No sign shall be constructed in a manner that obstructs public passage . or motor vehicle visibility . G . REGULATIONS FOR SPECIFIC TYPES OF SIGNS : 1 . Changeable-Copy Signs : When necessary to inform the public of chang - ing events , activities , dates , times , and other matters of important interest ; the Sign Commissioner may issue a permit for a changeable-copy sign not lee to exceed eight ( 8 ) square feet in area . Signs must be legible . 2 . Accessory Signs : Accessory signs are permitted . Total area cannot exceed one ( 1 ) square foot . 3 . Directional , Informational , or Safety Signs : In addition to other per- mitted signs , directional , warning or traffic signs necessary for the safety and convenience of residents , customers , employees , and visitors are per - mitted in all areas . Signs shall not exceed one ( 1 ) square foot in area and a maximum of four ( 4 ) will be allowed per site . The Sign Commissioner may grant exceptions to this subsection on a case- by -case basis if he finds that the site requires more or larger signs . Political Signs : Political signs are permitted in all districts on private — property with the approval of the property owner and shall not exceed four ( 4 ) square feet in area and be subject to the rules that no sign shall be posted more than fifteen ( 15 ) days in advance of the date of the event to which it refers and shall be removed within seven ( 7 ) days of the event to which it refers . ( No permit required . ) — 5 . Temporary Signs : Temporary signs cannot be used for more than twelve ( 12 ) months but are permitted in all zones . Some may require a — permit from the Sign Commissioner . The sign shall be removed at the end of this period unless a renewal application has been approved . The Sign _ Commissioner shall ensure that signs shall be legible . a . Construction Signs and Real Estate Signs : ( No permit required . ) — 1 ) Signs are permitted in all zones . 2 ) Not more than one ( 1 ) sign is permitted on a single site . 3 ) Signs may not exceed four ( 4 ) square feet in area . 4 ) Signs must be placed on the site . 5 ) Signs shall be removed within seven ( 7 ) days of issuance of occupancy permit or transfer of ownership . b . Subdivision Lot Plan Signs : These are permitted if not in excess of twelve ( 12 ) square feet on any subdivision with eight ( 8 ) lots or more provided no " For Sale " signs are placed on the individual lots . The sign shall be placed within the subdivision and not easily visible from the abutting way . Individual lot number signs not in excess of one ( 1 ) square foot may be placed on each lot . c . Window Signs : Window signs are permitted as long as the total area of all such signs does not exceed twenty -five percent ( 25% ) of all window area on which the signs appear . ( No permit required . ) d . Special Event Signs : When an activity is to be opened in a non - residential district , the owner may put up an informational sign not in excess of twelve ( 12 ) square feet in area , which may remain in place for not more than 15 days . 6 . Illumination of Signs : If signs are illuminated , it shall be done so by a direct, or external light source . Light bulbs or tubes shall not be visible _ to the motoring public from a public way . Directional signs , internally lit , are permitted when not in excess of one ( 1 ) square foot in area . 7 . Animated Signs : Animated signs are prohibited . 8 . Mailboxes : Numerals identifying street numbers and /or letters naming j the occupant of a building may be placed on both sides of a mailbox or on the door; letters not to exceed two and one -half inches ( 2 '/2 " ) in height , numerals not to exceed four inches ( 4 " ) in height . Advertising on mail - ` boxes is not permitted . 151 ATM — 5 / 14/90 9 . Banners or flags to call attention to a business or activity are pro - hibited . Banners used for Town festivals are permitted . H . GENERAL PROVISIONS RELATING TO ADMINISTRATION , M FORCEMENT , PENALTIES AND REMOVAL : 1 . Enforcement , Permits , and Penalty : w a . The Sign Commissioner is hereby authorized to enforce this Article . b . Permits and Certificates of Appropriateness : All signs regulated by this Article require a sign permit issued by the Sign Commissioner with exception of ARTICLE VI , C - 1 , C -6 , G -3 , GA , G -5a , and G -5c . All signs which require a sign permit shall be marked with an identifi - cation sticker supplied by the Sign Commissioner . All signs which require a sign permit and lie within the jurisdiction of the Old King 's Highway Regional Historic District ( OKHRHD ) must first obtain a Certificate of Appropriateness from the OKHRHD Committee . A sign without a permit is illegal . c . Fees : Fees for sign permits shall be set by the Board of Selectmen . d . The Sign Commissioner is authorized to order the repair or removal of any sign and its supporting structure which the Sign Commissioner judges dangerous or in disrepair or erected or maintained contrary to this Article . ' e . The Sign Commissioner is authorized to issue citations for vio- lations of these regulations by the method provided in MGL , Ch . 40 , Section 21 D . f . Failure to respond to a properly issued citation within 21 days will make the person , trust or other enterprise exhibiting a sign not in compliance with this Article , unless afforded protection under Article f VI II of this Chapter , shall be subject to the following penalty : s A . First offense : Warning B . Second offense : Twenty-five dollar fine C . Third offense : Fifty dollar fine D . Fourth and subsequent : Two Hundred dollar fine starting on the thirty -first ( 31st ) day after issuance of said citation . 2 . Signs not complying with this ARTICLE : 152 r ATM — 5/ 14/90 a . Signs without a valid permit shall be removed within sixty ( 60 ) days of passage of this ARTICLE . b . Signs with valid permits : 1 ) A sign with a valid permit issued prior to enactment of this ARTICLE must remain in compliance with the requirements and conditions that enabled the valid permit to be originally issued . 2 ) Where a sign identifying a business has approved subsidiary signs , the subsidiary signs may be replaced provided they remain in compliance with the requirements and conditions that, enabled the valid permit to be originally issued . 3 ) Failure of compliance will result in automatic revocation of the prior issued valid permit and require compliance with this ARTICLE for issuance of a current valid permit . 3 . Maintenance : A sign shall be maintained in a safe and secure manner and in a good state of repair including paint . If the Sign Commissioner finds that a sign does not comply with this ( maintenance ) section of this ARTI - CLE , written notice of noncompliance and the reasons therefore shall be sent , by certified mail , return receipt requested , to the person or persons to whom the permit was issued . If the specified defects in the sign have not been corrected or the sign removed within thirty ( 30 ) days , the Sign Commissioner shall revoke the permit and shall notify the person (s ) to whom the permit was issued that the sign is now in violation of this ARTI - CLE and must be removed . 4 . Abandoned Signs : When the Sign Commissioner finds that a sign has been abandoned , whether or not a permit has been issued , written notice ordering its removal shall be sent by certified mail , return receipt requested . a . to the owner of the property on which the sign is located , and b . to the person to whom the permit was issued if not the owner . 5 . Removal of Abandoned Signs or Signs in Violation of this ARTICLE : If sign on public property is not removed within thirty ( 30 ) days of the issuance of an order , the Sign Commissioner shall remove or arrange for the removal of the sign . The sign shall be stored by the Sign Commissioner in a safe location for sixty ( 60 ) days after which time it may be appropriately disposed of . Any costs incurred shall be borne by the sign owner . 6 .
