ORDINANCE NO. 45-2022
A GENERAL ORDINANCE AMENDNG SECTION 92.03 (DUTIES OF BUREAU OF
FIRE PREVENTION) OF CHAPTER 92 OF THE RICHMOND CITY CODE
WHEREAS, Indiana Code ("IC") 36-8-2-4 authorizes municipalities to regulate
conduct which may endanger the public health, safety, or welfare, and
IC 36-4-6-18 authorizes the Common Council("Council") of the City
of Richmond,:Indiana, ("City") to pass such ordinances as may be
necessary and proper for the City to fulfill and .satisfy the
responsibilities and duties:of the City; and
WHEREAS, _ IC 36-1-3.8 of the Home Rule Act (IC 36-1-3-1 et seq.) grants
municipal units all powers granted it by statute and all other powers
necessary or desirable in the conduct of its affairs, subject to any
constitutional limitations or subject to any specific statutes which may
preempt or regulate a specific power; and
WHEREAS, The Richmond Fire Department, by and through its Bureau of Fire.
Prevention, specifically its Fire Marshal, is charged with various
inspections of life safety systems existing on private property,
including, but not limited to, sprinkler systems, standpipe systems,
alarm and:extinguisher apparatus, emergency exit lights, commercial
kitchen hoods,boiler pressure vessels, and private hydrants and water
main systems (hereinafter "life safety systems") which impact public
safety; and
WHEREAS, Private property owners are permitted to install and maintain said life
safety systems at said owners' cost and expense, provided that the
systems are required by state administrative code to be timely and
accurately monitored for deficiencies, follow-up inspections, and this
entails timely notifications and tracking for proper ongoing
maintenance of said systems; and

WHEREAS, Due to growth in the community of properties which contain the life
safety systems,the Richmond Fire Department and City administration
may wish to enter into future contractual relationships with companies
known as "single-point repository service companies" which are
capable of providing a software licensing system which implements a
uniform reporting and monitoring database for use by the Fire Marshal
to accurately monitor inspections performed by third-party inspectors
to ensure that the inspections are consistent,routine,accurate, and with
the purposes described above in connection with accurately monitoring
for deficiencies and making sure inspections occur on a regular basis;
and
WHEREAS, Richmond City Code ("RCC") Chapter 92 contains the fire prevention
provisions for the City and for use by the City's Fire Marshal and
Bureau of Fire Prevention; and
WHEREAS, RCC Section 92.03 within said Chapter 92 sets forth certain duties and
it is in the best interests of the citizens of the City of Richmond,Indiana,
to amend Richmond City Code Section 92.03 to incorporate provisions
permitting the Fire Department through its Fire Marshal and Fire
Prevention Bureau to cause third party life safety system inspectors to
utilize a uniform monitoring system or"single-point repository service
company"which the City would utilize on a contractual licensing basis
in order that life safety inspection paperwork is contained within a
uniform database set up to address the above-described monitoring
activities.
NOW,THEREFORE,BE IT ORDAINED by the Common Council of the City of Richmond,.
Indiana that the findings and determinations set forth above in the recitals and preambles to
this Ordinance are hereby made the findings•and determinations of the City of Richmond,
Indiana, and that amendments to Section 92.03 of Chapter 92 are enacted as follows with
additions shown in bold font and with deletions show in stricken font:
92.03 DUTIES OF BUREAU OF FIRE PREVENTION
(a) The Fire Prevention Code shall be enforced by the Bureau of Fire
Prevention in the Fire Department. The Bureau shall be under the supervision
of the Chief of the Fire.Department.

(b) The Chief or Fire Marshal in charge of the Bureau of Fire Prevention
shall be appointed by the Board of Public Works and Safety on the
recommendation of the Chief of the Fire Department.
(c) The Chief of the Fire Department may detail such members of the Fire
Department as inspectors from time to time as necessary.
(d) A report of the Bureau of Fire Prevention shall be made annually and
transmitted to the chief executive officer of the municipality. It shall contain
all proceedings under this Code, with such statistics as the Chief of the Fire
Department may wish to include. The Chief of the Fire Department shall also
recommend any amendments to the Code which, in his judgement, shall be
desirable.
(e) Any third-party inspectors who perform inspections upon life
safety systems which are under the jurisdiction of the Richmond Fire
Department's Fire Prevention Bureau shall coordinate the inspections on
behalf of their clients as specifically directed by the Fire Marshal of the
City in order to ensure uniform monitoring and in the event the City
utilizes a single-point repository service company, and the following
provisions shall also applyto the inspectors and their clients:
(1) All certified contractors providing services, testing,
installations, repair, or maintenance of fire prevention systems to
commercial facilities within the City of Richmond are required to
enroll in and utilize the City-approved single point repository
services company(hereinafter"SRSC")for reporting the rendered
service information. This reporting information must be filed with
the SRSC within five (5) business days of the completion of the
services to the commercial facility.
(2) If utilized by the City, the SRSC will be a third-party
records repository which shall organize,maintain,and monitor the
received records, providing information to the City and the
commercial facility pertaining to the records status and timely
notifications on required inspection timetables. Fees for this
provided services shall be paid directly from the certified
contractors to the City-approved SRSC.

(3) In addition,a copy of the record of each periodic inspection,
test, servicing, repairs, and maintenance, shall be maintained on
the commercial facilities premises, or other approved location,for
a period of not less than seven (7)years, unless a greater period of
time is specified in the Indiana Fire Prevention Laws and Rules,
except that any original acceptance test reports shall be maintained
for the life of the system. The records shall be made immediately
available to the Fire Marshal or Fire Department Fire Prevention
Bureau upon request.

This Ordinance shall be in full force and effect after review by the Indiana State
Department of Homeland Security by and through its Fire Prevention and Building Safety
Commission.
