HomeMy Public PortalAboutResolution No. 23-071 - Resolution to evaluate all city owned facilities for ADA complianceSponsored by: Mayor Taylor RESOLUTION NO. 23-071 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, DIRECTING THE INTERIM CITY MANAGER TO CONDUCT AN EVALUATION OF ALL CITY OWNED FACILITIES FOR COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT AND TO IMPLEMENT A PLAN TO BRING ANY DEFICIENCIES INTO COMPLIANCE WITHIN ONE HUNDRED TWENTY (120) DAYS; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Opa-Locka ("City") desires to ensure that it remains in compliance with the Americans Disabilities Act (ADA) and that all residents and visitors of the City feel accommodated; and WHEREAS, the City Commission finds it in the best interest of the City and its residents to direct the Interim City Manager to conduct a thorough evaluation of all City - owned facilities for any ADA deficiencies. The areas of concern and a plan to remediate shall be presented to the City Commission within one hundred twenty (120) days of passage of this Resolution. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: SECTION 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. SECTION 2. AUTHORIZATION The City Commission of the City of Opa-Locka hereby directs the Interim City Manager to conduct an evaluation of all City owned facilities for compliance with the Americans with Disabilities Act and to implement a plan to bring any deficiencies into compliance within one hundred twenty (120) days of passage of this Resolution. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors, which do not affect the intent of this Resolution may be authorized by the Interim City Manager, following review and approval by the City Attorney, without need of public hearing, by filing a corrected copy of same with the City Clerk. Resolution No. 23-071 SECTION 4. EFFkCTIVE DATE This' Resolution shall take effect upon the adoption and is subject to the approval of the Governor or Governor's Designee. Staff Summary: The City would like to ensure that it remains in compliance with the Americans Disabilities Act (ADA) and that all residents and visitors of the city feel inclusive. Therefore, the Interim City Manager shall conduct a thorough evaluation of all city -owned facilities for any ADA deficiencies. The areas of concern and a plan to remediate shall be presented to the City Commission within 90 days. Financial Impact - Proposed Action: It is recommended the City Commission approve legislation directing the Interim City Manager to conduct an evaluation of all public area in City owned facilities for compliance with the Americans with Disabilities Act and to implement a plan to bring any deficiencies into compliance within 90 days.
