RESOLUTION NO. 23-094
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,
AUTHORIZING THE CITY ATTORNEY TO FILE PROPER LEGAL ACTION TO
ENFORCE A UTILITY EASEMENT FOR 930 ORIENTAL BOULEVARD, WITHIN
THE CITY; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the property owner at 935 Curtiss Drive has extended their property boundaries by
encumbering a utility easement and preventing City staff from accessing the neighboring property; and
WHEREAS, consequently, the water meter for 930 Oriental Boulevard is impacted by the
expansion of the property located at 935 Curtiss Drive; and
WHEREAS, the property owner at 930 Oriental Boulevard is now unable to
initialize water service; and
WHEREAS, in order to perform the City's duty of acquiring meter readings for water services,
the City needs access to utility easements and legal action may be necessary; and
WHEREAS, the City Commission directs the Interim City Manager to explore and implement
non -legal measures within a 24 -to -48 -hour period in order to protect the City's easement without the
necessity of litigation; and
WHEREAS, the City Commission further directs that Interim City Manager to provide all
necessary documentation requested by the City Attorney in order to file the appropriate legal action
and determine if legal action is necessary; and
WHEREAS, the City Commission finds that it is in the best interests of the City and its residents
to authorize the City Attorney to file appropriate legal action in order to enforce a utility easement
for 930 Oriental Boulevard after a 48 -hour period has elapsed, information is provided to the City
Attorney and it is determined that nonlegal measures cannot otherwise be accomplished.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
OPA LOCKA, FLORIDA:
SECTION 1. RECITALS ADOPTED.
The recitals to the preamble herein are incorporated by reference.
SECTION 2. AUTHORIZATION
The City Commission of the City of Opa-Locka hereby authorizes the City Attorney to file
appropriate legal action in order to enforce a utility easement for 930 Oriental Boulevard after a
48 -hour period has elapsed, information is provided to the City Attorney and it is determined
that non -legal measures cannot otherwise be accomplished.

SECTION 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re -lettered and corrections of
typographical errors, which do not affect the intent of this Resolution may be
authorized by the Interim City Manager, following review by the City Attorney,
without need of public hearing, by filing a corrected copy of same with the City
Clerk.
SECTION 4. EFFECTIVE DATE
This Resolution shall take effect upon the adoption and is subject to the approval
of the Governor or Governor's Designee.

Short Title:
A resolution allowing the City Manager to seek an emergency injunction
Staff Summary:
It is in the best interest of the city to seek Commission approval to obtain an emergency
injunction, to enforce the city utility easement at 935 Curtiss Drive. The property owner at 935
Curtiss Drive has extended their property boundaries by encumbering the utility easement.
Now that the water meter for 930 Oriental Boulevard, is enclosed in 935 Curtiss Drive, and
even with police intervention the property owner is refusing access to the meter. As such the
property owner at 930 Oriental Boulevard is unable to initialize their water service.
Financial Impact: The City is outside the court costs (for which I will yield to the legal department)
the city do not anticipate any additional financial impacts.
Proposed Action:
Staff recommends the City Commission approve the amendment of this loan agreement.

With further investigation, Mr. Delgado issued a NOV to 935 Curtiss Dr because they are the violator in this matter disallowing access to get to the property located at 930 Oriental Blvd. A
NOV was posted to the property on September 22, 2022; I have copied the inspector on this email and are requesting a $500 citation for failure to comply. As you know we are required
to give due process to remediate the issue and I'm sure that time has expired. Mr. Delgado will move forth with a citation immediately.

The City Manager(Darvin Williams) is requesting that as long as the property owner at 935 Curtiss Dr. is refusing and denying access to the meter to be read for 930 Oriental Blvd, he is
directing us to notify the customer his or her water will be interrupted if access isn't granted. So far Code has issued an NOV yesterday and Joseph(Public Utilities Meter Supervisor) will be
issuing a door tag this morning.

Good morning Wilma,
As 1 have stated to you yesterday of what that property owner stated about the City installed the meter in his property. There were originally two meters existing on the property one was for his property and the
other is for the property on Oriental Blvd originally until Public Works did an project to upgrade the water line on Curtiss Dr by upgrading our water lines,as part of the project we removed and capped the meters from
the rear for all the residents on Curtiss Dr only to the front in the sidewalk.

Mr. Cook conducted inspection per your request. The owner of 935 Curtiss Dr. stated that 930 Oriental Blvd meter was installed in his rear yard years ago by the city. He
expressed his concern for leaving his gate unlocked with his dogs in the yard when he's not home.
As it relates to the encroachment of the fence, a permit was issued and approved by B&L which hinders Code Enforcement from further enforcement. In addition, 935
Curtiss Dr. shows no inspection was done, but permit issued per records. We are receiving complaints from Public Works more often with the fence encroachments not
allowing access to the meters.
I'm not sure how to proceed in this matter, because it will be dismissed in court due to city approving the fence permit. .
