1. ADDITIONAL AGENDA ITEMS
Council agreed to discuss the following additional items:
Snow plowing procedures
Resignation of Verna Hoover
2. ADMINISTRATION OF OATH OF OFFICE
Clerk, Donna Roehl administered the Oath of Office to newly elected Mayor, Thomas Ander-
son and Councilmembers, William Reiser and Anne Heideman.
3. MINUTES OF DECEMBER 21, 1982
Donna Roehl stated that Order Check # 1741 in the amount of $13,600 to Displaymasters
needed to be added to the total of Order Checks for December 21st. for a total of $15,122.21.
Motion by Reiser, seconded by Scherer to approve minutes of December 21, 1982, as amended.
Motion declared carried
4. POLICE DEPARTMENT
Radar Purchase
Police Chief Sankey reported tht he would be purchasing a 1983 Radar unit for $883.00,
plus trade-in on an existing unit.
City of Loretto Contract
Motion by Scherer, seconded by Reiser to enter into contract with the City of Loretto for
police protection of their city during 1983 at a contract price of $15,000.

Deferred Compensation Program
Thomas Crosby explained that under the program the city buys an annuity policy with an
employee paying for same and the asset being the property of a city.
Referring to a memo from the City Attorney's law firm, he explained that they recommend
securring an Attorney General's opinion before joining the program. He suggested that if
other cities are involved Medina could probably be a member without there being a problem.
Motion by Crosby, seconded by Scherer to table approval of the Deferred Compensation Pro-
gram pending receipt of information regarding the legality of the program and determination
as to how many other cities are involved.
Motion declared carried
Mark Moran Holiday Pay
Council discussed the fact that Police Officer, Mark Moran had questioned the payment for
holiday hours vs. payment for the number of holidays he had worked since his employment
began on August 13, 1982.
Thomas Anderson explained that named holidays had not been included in discussion of holiday
pay when labor contracts had been negotiated.
Richard Schieffer stated that the contract governs police department benefits, no other
document.
Chief Sankey stated that he had told Bob Anderson to discuss the matter with the union
and determine if other cities designate holidays or holiday hours.
Welcome Dr.
William Reiser stated that he had received a complaint regarding a number of junk cars
on two properties on Welcome Dr.
Chief Sankey stated that he would investigate.
5. PUBLIC WORKS DEPARTMENT
Snow Plowing
Wilfred Scherer explained the snow plowing procedure followed by the Public Works
after a snowfall; that is, thru roads are plowed first, then Hamel because of the
partment and then the cul de sacs.
Motion by Anne Heideman, seconded by Crosby to commend the department for the excellant
manner in which they cleard roads after the 16 inch snowfall on December 28th.

6. PIONEER CREEK WATERSHED DISTRICT
Anne theis, Chairman of the Pioneer Creek Watershed Commission, reported that Greenfield
is still undecided as to whether or not they will become members of the district. She
explained fees cities will pay, with or without Greenfield.
7. PLANNING AND ZONING DEPARTMENT
Philip Sullivan, Subdivision
JoEllen Hurr reviewed memo and Planning Commission recommendation regarding approval of
the application of Philip Sullivan to subdivide 14+ acres into a 10.74 and a 3.27 acre
parcel. She stated that a park dedication fee would not be required because the newly
created parcel would be in excess of the 10 acre minimum set forth in the ordinance.
She stated that the right-of-way on Chippewa Rd. should be obtained and that the septic
system site on the existing motel property should be located..
Motion by Reiser, seconded by Scherer to recommend approval of the Philip Sullivan sub-
division and authorize preparation of a resolution including securing a road easement along
918 ft. of Chippewa Rd.; location of an existing septic system site on a survey and that
the driveway for the newly created parcel be located 200 ft. east of the new property line.

Nunn -Radtke Conditional Use Permit and Variance
JoEllen Hurr reviewed memo and Planning Commission discussion regarding the Nunn -Radtke
Conditiona Use Permit and Variance application to operate a boarding, training and lesson
stable at 2825 Willow Dr.
She reviewed list of conditions that Planning Commission had included in their approval.
Anne Heideman stated that Item 8 should read: Manure shall be disposed of at least every
6 months.
Regarding the parking area William Nunn stated that he would have room for about 20 cars
and that he would like to use crushed limestone on the parking area and driveway.
Ms. Hurr stated that commercial operations require blacktop but Council may specify what-
ever conditions it would like included, when issuing a Conditional Use Permit.
She stated that a parking plan, drawn to scale, should be shown on the survey.
Regarding disposal of manure that is stored on the property at the present time, she re-
ferred to a letter from the PCA whereby present owner, Debbie Kemp must submit a plan for
manure removal within 45 days.
Mr. Nunn stated that he would be assuming liability for the disposal and would be posting
a bond to guarantee removal.
Thomas Crosby stated that he had not been involved in the sale of the property, at this
time, but that he had been when Debbie Kemp had purchased the property.
'He also stated that he did not believe that there should be more than 28 horses on the
property.
Mr. Nunn stated that there might be riders stopping by with their horses on occasion and
he would not want a problem with the Conditional Use Permit if that should happen.
Thomas Crosby asked how the number of horses on the property could be regulated.
Richard Schieffer stated that language in the Conditional Use Permit could include a penalty
if conditions were violated and also the permit could be revoked by Council if conditions
were not met.
William Reiser stated that there had been some concern about where horses would be ridden
and he asked that an item in the permit be included regarding the need to secure permission
before riding on a neighbors' property.
Motion by Scherer, seconded by Reiser to authorize preparation of a resolution approving
the Conditional Use Permit and variance of William Nunn and Carey Radtke to operate the
kemp stable at 2825 Willow Dr. and to include conditions set forth by the Planning Comm-
ission plus an item regarding securing permission from neighboring property owners before
riding on their properties.

Thomas Crosby asked why a variance is needed to correct the structure.
Mr. Nunn stated that the roof line needed to be changed so that rain do not continue to
run off as side -by -side roofs cause a water problem.
Motion carried. Abstaining, Crosby.
Albert Saari, Subdivision
JoEllen Hurr explained Mr. Saari's application to subdivide 34 acres on Tamarack Dr. into
three, 10 acre, plus, parcels. She indicated that Parcel D would need a private roadway
agreement and would allow for connection to a future extension of Co. Rd. 116.
She explained that Parcel C has sufficient conventional septic system soils so that it
could be subdivided sometime in the future.
Thomas Anderson stated that right-of-way on Tamarack Dr. is needed.
Motion by Reiser, seconded by Heideman to authorize preparation of a resolution granting
the subdivision of the Albert Saari property at 3132 Tamarack Dr., according to the survey,
with the condition that no further division can be made on Parcels A and B and that road
easements be gotten along Tamarack Dr.

Harold Pederson, Subdivision
JoEllen Hurr stated that Mr. Pederson now wishes to file his subdivision with Hennepin
County; that he had paid the park dedication fee as had been determined by the city assessor
and that a legal description was needed for the streets shown in the subdivision.
Mr. Pederson asked for an explanation of the section of the subdivision ordinance regarding
park dedication fees. He stated that he believed that the value of property, before sub-
dividing, should be used, but the city assessor was using a value of the lots after sub-
dividing.
Richard Schieffer stated that he would speak to the assessor regarding interpretation of
the ordinance and that he had sent the legal description of the proposed road to the engineer
for verification and that he would send the contract to Mr. pederson when it was completed.
Motion by Reiser, seconded by crosby to adopt Resolution 83-1, approval of the Harold Ped-
erson subdivision and to refund a portion of the Park Dedication Fee if the amount has
not been calculated correctly.

Hwy. 55 and Co. Rd. 116 Signals
JoEllen Hurr explained that a meeting had been held with interested business owners that
own property west of the intersection of Hwy. 55 and Co. Rd. 116, and all agreed to the
final plan. She stated that she had spoken with Bruce Luxford, Dairy Queen owner, who
seemed satisfied with the plan.
Thomas Anderson reported that he had spoken with Don Mayer,owner of the service station
north and east of the intersection, and that he had no problem with the plans.
Planning Commission Appointment
Council was advised that Bonnie Etzel and Lawrence Elwell were interested in serving on
the Planning Commission.
Thomas Anderson stated that he would like to find someone from the Hamel area for the
Commission.
Council asked that an article be placed in the Crow River News asking that anyone interested
in serving should call the city office and plan to attend the January 18th City Council
meeting.
Emil Jubert, Agricultural Preserve Rezoning
JoEllen Hurr explained tht Mr. Jubert had applied for a zoning amendment that would allow
his property to be classified Ag Preserve and that he would have done it earlier but the
cities Comprehensive Plan had not been approved by the Metropolitan Council.
Motion by Reiser, seconded by Scherer to approve Resolution 83-2, granting approval for
reclassification of the Emil Jubert property to Agriculture Preserve.

8. NORTHWEST TRAILS ASSOCIATION

Discussion of the agreement that needs the cities approval for the Northwest Trails Assn
to maintain snowmobile trails along Hwy. 55.
Donna Roehl stated that the cities of Maple Grove and Plymouth have similar agreements with
the State of Minnesota and that the Trails Association assumes responsibility for the con-
ditions included in the agreement.
Richard Schieffer stated that he would review the conditions with a law partner who is the
City Attorney for Plymouth.
Matter was tabled until January 18th.
9. CONSENT AGENDA
Motion by Crosby, seconded by Scherer to remove salary items 10, 11, and 12 from the con-
sent agenda.

paper for 1983.

William Reiser as Public Safety Commissioner; Special Projects Commissioner, Thomas Crosby
and Anne Heideman as Commissioner of Health, Welfare, Recreation and Administration.

Anne Heideman stated that she would work with the Clerk, Assistant Clerk and Zoning Admin-
istrator on their concerns.

Thomas Anderson stated that he would like to find someone who is a resident of Medina.
Council agreed to hire Charles Hurr, through the month of August, at $6.00 per hour.
12. FIRE TRUCK
Motion by Crosby, seconded by Reiser to adopt Resolution 83-3, Ordering the preparation
of of specifications and advertizing for bids for fire apparatus on February 15, 1983 at
10:00 A.M.

13. SUBURBAN POLICE RECRUITING SERVICE
Motion by Reiser, seconded by Scherer to continue the contract with Suburban Police Re-
cruiting Service for 1983 and to designate Mike Sankey as delegate and William Reiser as
alternate delegate to the Joint Powers Board.

14. SIGN PERMITS
Emil Jubert, Sign Administrator, stated that he would speak with Bruce Neumann regarding
his auto repair sign on Hamel Rd. He also reported that he had contacted Stop-N-Go Liquors
and Highway 55 Rentals.
15. METROPOLITAN WASTE CONTROL PUBLIC HEARING
JoEllen Hurr reported that she would be attending the Metro Waste Control Public Hearing
on January 6th regarding their projects and specifically the phasing out of the Hamel
Treatment plant.
