PROCLAMATION AND RESOLUTION
WHEREAS We , the inhabitants of the Town of Brewster , in the one hundred
and eighty -third Annual Town Meeting assembled May fifteenth ,
one thousand nine hundred and eighty -five , " to act and do upon
the whole as the inhabitants of said Town of Brewster shall
think proper ; " and
WHEREAS It is appropriate for good citizens to honor their faithful and
loyal teachers , the Board of Selectmen on behalf of the citizens
of Brewster honor Isabel LaPorte for her 37 years as a devoted
teacher in the Brewster Elementary School . Isabel LaPorte
inspired , encouraged and guided close to a thousand Brewster
youngsters in their pathway to the future . Her dedication to
excellence , her insistence on good manners and discipline and
perhaps above all , her unfailing sense of humor will be missed
by her students and fellow teachers ; and
THEREFORE as the Board of Selectmen on behalf of all the citizens of the
Town of Brewster , we extend our thanks and express our deepest
appreciation to Isabel LaPorte on her retirement from the
Brewster Elementary School , and declare SUNDAY , MAY 191
1985 as ISABEL LAPORTE DAY in Brewster .

BREWSTER BOARD OF SELECTMEN
PREAMBLE AND RESOLUTION
WHEREAS At the Special Town Meeting of January 6 , 1983 you — the
citizens of the Town of Brewster — voted for the formation of a
Committee to undertake the task of planning and overseeing the
construction of a Golf Course within the Town of Brewster ; and
WHEREAS On this Thursday , May 23 , 1985 — a little over two years later —
we will celebrate the opening day of the CAPTAINS GOLF
COURSE ; and
WHEREAS We recognize the tremendous job undertaken and accomplished
by the members of the Brewster Golf Commission who volun -
tarily gave of their time , effort and expertise to turn an idea into
a reality all of us can be proud of ;

THEREFORE We , the Board of Selectmen , on behalf of the citizens of the
Town of Brewster , extend our profound thanks and express
our appreciation to all of the members of the Brewster Golf
Commission .

ARTICLE 1 . To act on the Annual Report of the Board of Selectmen and
other Town Officers .

INTERIM REPORT OF THE TOWN OFFICES COMMITTEE
I am Alan McClennen , Chairman of the Town Offices Committee . I live at 68
Evelyn ' s Drive , Brewster . I would like to bring you up to date on our activities .
As you well know the other members of the Committee are Louise Crocker ,
Harris ( vers , Bernard LaFleur and Richard I . Perry .
I would like to ntoe particularly that at no time did I receive any calls or com -
ments urging that we use the Community Center for Town Offices .
The Town Hall employees have been very cooperative in talking to the Architect
so that he has a very good picture of the needs and wishes of those who are
e near term . We have worked with him in a
going to be using the building in th
review capacity in order that a solid long term plan can be developed for ap-
proval by the Town . We have developed several basic policies . First , the exterior
of the building should be roughly as it has appeared in the papers in the recent
past . Second , since our governmental structure may well change over sub ect e life of
the building , office partitions should be of the moveable type , 1
tural limitations . Third , we believe that the building should include a complete lee%
sprinkler system . Fourth , since at the time of occupancy there will be ample
cise space allocations are not
space in the building for all our employees , pre

means that if we were to hold a Special Town Meeting on June 24 , the plans and
all related documents could be completed in a way that the building could be
11 closed in " before winter . The Architect recommends that we pursue this course
of action .
The Committee tends to agree with him in this , it also realizes that we must
work in teamwork with other Committees and Boards each of which has serious
and worthy programs in development stages . We believe that the matter of a
Special Town Meeting is the responsibility of the Selectmen , Finance Committee ,
and the Treasurer with the assistance of the Town Accountant .
In closing 1 merely state that this work has been interesting and at times even
exciting and that our Committee has been pleased to be able to serve the Town .
ARTICLE 3 . To see if the Town will vote to authorize the Town Treasurer ,
with the approval of the Board of Selectmen , to borrow money from time to
time in anticipation of the revenue of the Financial year beginning July 1 ,
1985 , in accordance with the provisions of the General Laws , Chapter 44 ,
Section 4 , and to issue a note or notes as may be given for a period of less than
one ( 1 ) year , in accordance with the General Laws , Chapter 44 , Section 17 .

ARTICLE 4 . To see if the Town will vote to assume liability in the manner
provided by Chapter 516 and 524 , Acts of 1950 , for all damanges that may be
incurred by the Department of Public Works of Massachusetts for the improve-
ment , development , maintenance and protection of tidal and non -tidal rivers and
streams , harbors , tidewaters , foreshores and shores along a public beach outside
Boston Harbor , including the Merrimack and Connecticut Rivers , in accordance
with Section 11 of Chapter 91 of the General Laws , and authorize the Board of
Selectmen to execute and deliver a bond of indemnity therefor to the Common -
wealth .

Alewife fishery .

ARTICLE 6 . To see if the Town will vote to transfer from free cash the sum of
Four thousand eight hundred seventy -one and 25/ 100 ( $4 ,871 . 25 ) Dollars to
fund wage adjustments to the following wage and salary accounts :

ARTICLE 7 . To see if the Town will vote to amend the Wage and Salary Scale
under the Personnel By - Law by adding five ( 5 % ) percent to the Wage and Salary
Scale , and to adjust all of the numbers therein accordingly , but to exclude and
except from the effect thereof all part-time temporary personnel who are
employed less than 6 months per year on a part-time basis . Said increase is
permanent, is a cost -of- living increase beginning Fiscal Year 1986 and is to be
effective July 1 , 1985 .

ARTICLE 8 . To see if the Town will vote to amend the Personnel By - Law
Section 9 . Vacation Leave by deleting the words July 1 and adding to paragraph
a . the following :
° Years of continuous service for purposes of vacation eligibility after one year
of service shall be based upon the employees anniversary date of hire in each
of the following years , 11
And paragraph i . will read , " Upon termination of employment, other than
discharge for cause , the employee shall be paid an amount in lieu of vacation
prorated according to the months of service since their anniversary date of hire ,
including the month in which employment is terminated . "
So that , as amended Section 9 . Vacation Leave will read :
Section 9 . Vacation Leave
a . Full -time or part-time employees in continuous employment shall earn one
( 1 ) day of vacation leave per month not to exceed ten ( 10 ) working days in their
first year of employment . Computation of vacation leave shall commence sixty
( 60 ) days from the date of employment . For the purposes of computation ,
anyone hired from the first through the tenth of the month shall receive credit
for a full month of service .
Years of continuous service for purposes of vacation eligibility after one
year of service shall be based upon the employees anniversary date of hire in
each of the following years .
b . During the second through the fifth year of continuous employment , such
employee shall be granted two calendar weeks of vacation .
c . During the sixth through the tenth year of continuous employment , such
employee shall be granted three calendar weeks vacation .
d . Beginning the eleventh year of continuous employment , such employee
shall be granted four calendar weeks vacation .

e . A week is defined as five work days . Vacation pay is the weekly rate in
effect at the time the vacation is granted .
f . Unless approval by the employees Administrative Authority and authorized
by the Personnel Board , no more than two consecutive weeks of vacation may
be taken at one time .
g . Vacation may be taken at any time during the fiscal year , subject to the limi -
tation set forth in the preceding paragraph , with the approval of the employees
Department Head . The employee should indicate his preferred vacation period
May 1 .
h . Vacations shall be taken in the fiscal year earned and shall not accumulate to
be taken in the next fiscal year unless approved by the employees Administra -
tive Authority and authorized by the Personnel Board .
i . Upon termination of employment , other than discharge for cause , the em -
ployee shall be paid an amount in lieu of vacation prorated according to the
months of service since their anniversary date of hire , including the month in
which employment is terminated .
j . Upon the death of an employee who is eligible for vacation , payment shall
be made to the estate of the deceased .

ARTICLE 9 . To see if the Town will vote to amend the Personnel By - Law
Section 8 . Work Week , paragraph e . and adding paragraph f . by substituting
therefor the following :
e . Professional and supervisory employees are not entitled to overtime compen -
sation . Subject to a written request , compensatory time may be granted to such
an employee with the approval of the Board .
f . Such compensatory time is to be granted as soon as possible , preferably
during the following payroll week , but in no event later than the fourth pay -
roll week following the overtime services . Compensation time must be taken in
the fiscal year earned and cannot be carried over .

ARTICLE 10 . To see if the Town will vote to amend the Personnel By - Law
Wage and Salary scale to become effective July 1 , 1985 by deleting the present
I -6 classification and by substituting therefor the following :
I -6 Plumbing Inspector — Regular Part -time $ 11 ,009 . 80 per annum ( inc . trans . )
and by adding the following thereto :
BH -3 Assistant Health Agent — Regular Part-time $7 . 25 per hour ( 19 hours
per week ) ;
any cost of living increase passed in Article 7 . shall not be added to this article ,
or to take any other action relative thereto .

ARTICLE 17 . To see if the Town will vote to raise and appropriate the su .o, of
Five thousand six hundred and 00/ 100 ( $5 ,600 . 00 ) Dollars to increase the
Selectmen 's Salary account to provide the following service under our present
form of government :
1 . Allow the Board of Selectmen during the reorganization process to select
one member to serve a full day five days per week .
To become effective with the Annual Town Election of April 1986 , or to take
any other action relative thereto .

ARTICLE 18 . To see if the Town will vote to authorize and empower the
Board of Selectmen to appoint an Executive Secretary for one or more terms of
three years and to remove him at the Board 's discretion ; during the time in
which he holds office , he may be appointed by the Board of Selectmen or , with
its approval , by any other town officer , board , committee or commission to an
any other town office or position consistent with his office ; the Executive
Secretary shall act by and for the Board of Selectmen in any matter which they
may assign to him and which relates to the administration of the affairs of the
Town or of any town office or department under its supervision and control ;
with the approval of the Board of Selectmen , the Executive Secretary shall
perform such other duties as may be requested of him by any other town
officer , board , committee , or commission ; to become effective July 1 , 1986 or

Monday , August 26 , 1985 at 7 : 30 P . M . in the Brewster Elementary School , and
in the meantime , for the town to vote to appoint a seven ( 7 ) person study com -

E . FLOOD PLAIN DISTRICT . The FLOOD PLAIN DISTRICT is established
as an overlay district . The underlying permitted uses are allowed , provided that
they meet the following additional requirements , as well as those of the MASS-
ACHUSETTS STATE BUILDING CODE dealing with the construction in flood
plains and coastal high hazards .
1 . Location and Boundaries .
The location and boundaries of the FLOOD PLAIN DISTRICT shall be
shown by an overlay map entitled " National Flood Insurance Program ,
FIRM , Flood Insurance Rate Mate , Town of Brewster , Massachusetts ,
Barnstable County dated May 30 , 1984 " , on file with the Town Clerk ,
Planning Board and Inspector of Buildings/Zoning Agent . These maps as
well as the accompanying Town of Brewster Flood Insurance study are
incorporated herein by reference . This District shall include all special
flood hazard areas designated as Zone A , Al -30 and V1 -30 .
2 . Requirements .
a . Within Zone A , where the base flood elevation is not provided on
the FIRM , the applicant shall obtain any existing base flood eleva-
tion data and it shall be reviewed by the Inspector of Buildings/
Zoning Agent for its reasonable utilization toward meeting the
elevation or floodproofing requirements , as appropriate , of the
State Building Code .
b . Located within the Flood Plain District are areas designated as
coastal high hazard areas ( Zone V ) . Since these areas are extremely
hazardous due to high velocity waters from tidal surges and hurri -
cane wave wash , the following provision shall apply :
All new construction shall be located landward of the reach of
mean high tide .

first sentence to read as follows :

residential district , intended to be divided or subdivided into not more than two
lots .

identification label issued by the enforcing agent . Said label is to be affixed to

SECTION XI , ADMINISTRATION AND ENFORCEMENT , H . PROSECUTION
OF VIOLATION AND PENALTY , by eliminating the present SECTION H and
substituting the following : H . PROSECUTION OR CITATION OF VIOLATION
AND PENALTY . If the notice of VIOLATION AND ORDER is not complied
with promptly , the Inspector of Buildings , or his designee , shall , through the
Board of Selectmen and Town Counsel , institute the appropriate action or
proceeding at law or in equity to restrain , correct or abate such violation . Any
person , trust or other enterprise who violates or refuses to comply with any of
the provisions of this By- Law , any of the conditions under which a permit is
issued , or any decision rendered by the Board of Appeals , may upon conviction ,
be fined a sum of three hundred dollars ( $300 ) for each offense . Any Zoning
By - Law of the Town of Brewster enforceable by the Inspector of Buildings , or
his designee , and a violation of which is subject to a specific penalty , may , as
an alternative to initiating criminal proceedings , be enforced by the Inspector
of Buildings , or his designee , by the method provided in Section 21D , Chapter
40 of the Massachusetts General Laws .

ARTICLE 114 . To see if the Town will vote to raise and appropriate a suf-
ficient sum of money not to exceed the sum of $ 7 ,000 . 00 to purchase and equip
one ( 1 ) new vehicle to be used , under the direction of the Inspector of Buildings ,
by the inspection personnel . Said funds to be expended under the direction of
the Inspector of Buildings with the approval of the Board of Selectmen , or to
take any other action relative thereto .

RESOLUTION
We , the Town of Brewster , resolve that the Selectmen , who are required to sell
foreclosure properties , will hereby first present these parcels to the various
Committees , Commissions , Boards and Department Heads , in order to see if
there is any advantage in keeping these parcels for the Town . If there is such a
need , then the Selectmen will come to Town Meeting and ask the voters to
accept these properties as Town properties . If no such needs are presented , then
these properties would be sold in accordance with the law .
