ANNUAL TOWN MEETING
May 9, 1983
In accordance with the Warrant the Annual Town Meeting was held in Brewster
Elementary School Cafetorium , Monday , May 9 , 1983 .
The meeting was called to order at 7 : 00 p .m . by the Moderator, Stephen Doyle .
The Tellers were June Gallant, Doris Powell , Gladys Curtis , J . Ogden Tyldsley ,
Jr. , and Ruth Hanlon . Checkers were Dorothea Dugan , Jean Gage , Carl Scrivener
and Mae Olson . A quorum was present.
The Warrant was read by Town Clerk , Barbara A . Vaughn , with the exception
of the articles which were read as they were being considered .
ARTICLE 1 . To accept the Annual Report of the Board of Selectmen and other
town officers . For Fiscal Year 6/30/82.
Adopted unanimously .
ARTICLE 2 . To hear the report of any special committees . Report by the Town
Hall Space Needs Study Committee . Report by the Management Study Com-
mittee . No report was presented by the Computer Study Committee .
To see if the Town will lay the following articles on the table until Tuesday ,
June 7 , 1983 at 7 : 00 pm . : 46 , 48, 75, 76 , 770 781 79, 89, 99 , 101 .
ARTICLE 3 . To see if the Town will vote to authorize the Town Treasurer, with
the approval of the Board of Selectmen , to borrow money from time to time in
anticipation of the revenue of the financial year beginning July 1 , 1983 , in ac-
cordance with the provisions of the General Laws , Chapter 44 , Section 4 , and to
issue a note or notes as may be given for a period of less than one ( 1 ) year in
accordance with the General Laws , Chapter 44 , Section 17 .

ARTICLE 4 . To see if the Town will vote to raise and appropriate as payment
due , the sum of Three Hundred Twenty and 17/ 100 ( $320 . 17 ) Dollars for the
year 1982 under the provisions of Chapter 32 , Section 59A of the General Laws,
and authorize the Town Treasurer to pay said appropriation to the Town of
Arlington , Massachusetts , said Chapter referring to the non-contributory pen-
Sion payments made to veterans .

ARTICLE 5 . To see if the Town will vote to raise and appropriate as payment
due the sum of Six Hundred Eighty-Seven and 24/ 100 ($687 .24 ) Dollars for
the year 1982 under the provisions of Chapter 32, Section 59A of the General
Laws, and authorize the Town Treasurer to pay said appropriation to the Com-
monwealth of Massachusetts , said Chapter referring to the non-contributory
pension payments made to veterans .
Adopted unanimously .
ARTICLE 6 . To see if the Town will vote to raise and appropriate the sum of
One Thousand Two Hundred and 00/ 100 ( $ 1 ,200.00) Dollars for the period
from July 1 , 1983 to June 30, 1984 , under the provisions of Chapter 944 , Sec-
tion 1 and 2, Acts of 1971 , an Act providing that cities and towns grant an
annual pension to certain retired teachers and that the Commonwealth reim-
burse said cities and towns for the amount of all such pensions .

ARTICLE 7 . To see if the Town will vote to assume liability in the manner
provided by Chapter 516 and 524 , Acts of 1950 for all damages that may be
incurred by work to be performed by the Department of Public Works of Massa-
chusetts for the improvement, development, maintenance and protection of tidal
and non-tidal rivers and streams , harbors , tidewaters , foreshores and shores
along a public beach outside Boston Harbor , including the Merrimack and Con -
necticut Rivers , in accordance with Section 11 of Chapter 91 of the General
Laws , and authorize the Board of Selectmen to execute and deliver a bond
of indemnity therefor to the Commonwealth .

ARTICLE 8 . To see if the Town will vote to raise and appropriate the sum
of Two Hundred Six and 80/ 100 ($206 .80) Dollars under the provisions of
Chapter 338, Acts of 1954 , amended by Chapter 433, Acts of 1955, Control
of the Greenhead Fly , and authorize the Town Treasurer to pay said appro-
priation into the State Treasury .

ARTICLE 9 . To see what action the Town will take regarding its Herring or
Alewife fishery .

ARTICLE 16. To see if the Town will vote to amend the Personnel By - Law by
adding Section 27 " Education and Training " to be effective immediately and
read as follows : It shall be the policy of the Town of Brewster to encourage em-
ployees to improve their knowledge and skills by on -the-job training , participa-
tion in recognized job- related programs sponsored by State , County and other
professional government related Associations and by enrollment in accredited
schools and colleges . The Personnel Board shall establish procedures defining the
limits of financial assistance and conditions under which assistance shall be pro-
vided for employee participation in accredited school and college programs .

ARTICLE 17 . To see if the Town will vote to amend the wage and salary scale
under the Personnel By- Law by adding 51/16 to the wage and salary scale excepting
temporary part-time personnel who are employed less than 6 months per year on
a part-time basis. Said increase is permanent, is a cosvof-living increase beginning
fiscal year 1984 and is to be effective July 1 , 1983 .

ARTICLE 18. To see if the Town will vote to amend the Personnel By- Law,
Section 9 Vacation Leave, by amending section c . to read as follows : During the
sixth through the tenth year of continuous employment, such employee shall be
granted three calendar weeks of vacation effective July 1 . " and section d . to
read : 'Beginning the eleventh year of continuous employment , such employee
shall be granted four calendar weeks of vacation effective July 1 ."

ARTICLE 19. To see if the Town will vote to amend the wage and salary scale
under the Personnel By - Law by amending individual classifications as follows :

ARTICLE 20 . To see if the Town will vote to raise and appropriate the sum of
Three Thousand Two Hundred Thirty-One and 28/ 100 ( $3 , 231 . 28) Dollars to fund
the salary accounts for the increases in wages voted in Article 19 , as follows :

ARTICLE 21 . To see if the Town will vote to authorize and direct the Board of
Selectmen to petition the General Court to pass the following special act. :
SECTION 1 . Notwithstanding any contrary provision of law , the office
of Town Treasurer and Collector of the Town of Brewster shall be appointed
by the Board of Selectmen for a term of 3 years . Upon the appointment and
qualification of said Town Treasurer and Collector, the term of office of the
person holding this office shall cease and terminate . All provisions of the law
relative to treasurers and to collectors of taxes shall , except insofar as the same
may be inconsistent with the provisions of this act, apply to said Town Trea-
surer and Collector .
SECTION 2 . Notwithstanding any contrary provisions of law, the offices
of Town Clerk, and Town Treasurer and Collector, in the Town of Brewster shall
not be held by the same individual .
SECTION 3 . Notwithstanding the provisions of SECTION 2 . , the incum -
bents in the offices of Town Clerk and Town Treasurer/Collector , if they are the
same person , shall continue to hold office as follows : The Town Clerk may con-
tinue to serve the remaining term of office , unless removed for any reason ; the
Town Treasurer/Collector shall continue to serve until a new Town Treasurer
and Collector is appointed in accordance with SECTION 1 ., above or is removed
for any reason .
SECTION 4 . This act shall take effect upon its passage .

Section X11 , 1 .3 by adding to the Appendix the following job description :
JOB DESCRIPTION FOR TOWN OF BREWSTER
TOWN TREASURER AND COLLECTOR
Purpose of Position :
Direct and coordinate the supervisory and fiscal aspects of the Treasury manage-
meet and Collector activities of the Town of Brewster. Supervise and direct
the activities of staff employees assisting the Treasurer and Collector.

Duties :
Treasurer
Receive , identify , record and account for all funds due . Insure safe keeping
of funds received .
Manage Town funds to include :
Adequate cash availability .
Maximum return on investment of available funds .
Negotiation and implementation of all borrowing to meet current
and future requirements .
Administration and custody of trust, stabilization , retirement and
investment funds not specifically assigned other Town functions .
Control , schedule , account for and pay all amounts due others after
approval by established authority .
Control , schedule , account for and pay all amounts due for salaries and
wages in compliance with established authorities . Receive and disburse
all items related to payroll deductions for taxes , insurance premiums ,
retirement and annuity payments and any other such item .
Maintain revenue ledgers and records .
Prepare fiscal reports of revenues , disbursements, investments , current
cash positions, schedules of bond interest and principal payments and the
status of trust funds.
Keep administrative officers , finance committee and other appropriate
boards or committees advised with regard to the financial condition of
the Town and provide information upon which decisions with regard to
budgets and appropriations are made .
Maintain tax title accounts , conduct sale of land , purchases of land by the
Town and petition the court to establish title on tax title property .
Collector
Collect all billed revenues due and owing such as license fees , users fees,
permits and other such receivables .
Collect and account for taxes as levied and assessed by proper authority
in the manner decreed by law, enforcing all statutory remedies .

Serve as custodian of all moneycollected and turned over to the Treasurer.
Process all tax payments, receipts and post to cash book and commit-
ment books. Make bank deposits and balance cash book.
Process demand notices , prepare warrants for unpaid demands and for-
ward same to Deputy Collector.
Post abatements and order refund checks .
And all other duties that may be required .

ARTICLE 35. To see if the Town will vote to take by eminent domain a parcel
of property in Brewster known as The Egg" and being more specifically identi
fieri as assessor's parcel Map 17 , Lot 39, owned by First Parish Church Society
a/k/a First Unitarian Universalist Society of Cape Cod , and shown on parcel
# 1A on a plan entitled "County of Barnstable , Plan of Road to Shore in Brew-
ster as laid out by the County Commissioners , scale 40 feet to an inch , Oct . 3 ,
1929, Newell B . Snow, Engineer" and to see if the Town will vote to raise and
appropriate the sum of Nine Thousand Six Hundred and 00/ 100 ( $9 ,600 .00)
Dollars for payment of this eminent domain taking and to designate the parcel
so purchased to be a Town Park in perpetuity , placed under the care and main-
tenance of Brewster's Department of Public Works .

ARTICLE 36. To see if the Town will vote to amend Article 69 voted at the
Annual Town Meeting of May 12 , 1975 by deleting the words "ninety ( 90 )
days " and substituting the words " one hundred twenty ( 120 ) days" and deleting
"June 30, 1975" and substituting "June 30, 1983 ", so the amended article shall
read as follows : The Annual Town Report shall be printed and available for dis•
tribution to the inhabitants of Brewster within one hundred twenty ( 120) days
of the close of the fiscal year, commencing with the year ended June 30 , 1982
and each year thereafter .

ARTICLE 37. To see if the Town will vote to amend the Finance Committee
By- Law by substituting the following new first paragraph :
There shall be a Finance Committee consisting of nine members who are resi-

the Finance Committee shall be appointed by the moderator for the term of
three years . The Town Moderator shall annually appoint three members for a
term of three years . All appointments by the Moderator shall begin on July 1
and shall terminate on June 30 , of the third year following appointment, except
vacancies in existing offices which may be appointed by the Moderator for the
original term .
So that as amended the complete By- Law will read as follows :
There shall be a Finance Committee consisting of nine members , who are resi-
dents of the Town and who shall hold no other Town office . All members of the
Finance Committee shall be appointed by the Moderator for the term of three
years . The Town Moderator shall annually appoint three members for a term of
three years . All appointments by the Moderator shall begin on July 1 and shall

It shall be the duty of this committee to consider all matters of business in=
cluded within the articles of any warrant for a Town Meeting and it shall be the

to transmit a copy thereof to the Finance Committee . The Committee shall
report on each article to the Town Meeting, in print or otherwise as it deems for
the best interest of the Town .
The Finance Committee shall have authority at any time to investigate the books,
accounts and management of any department of the Town , and the books and
accounts of the Town shall be open to inspection of the Committee or any
person authorized to act for the Committee .
The members of the Finance Committee shall serve without pay for their ser-
vices but may be reimbursed for actual expenses incurred in the discharge of
their duties thereunder .
Any vacancy which may occur in said Committee shall be filled by the remaining
members of the Committee .
All existing appointments shall remain in effect until their normal expiration
d ate .

of Public Ways, adopted under Article 21 , Annual Town Meeting, March 6 , 1967,
by deleting prior By- Law and adding the following By- Law : " In the matter of
laying out a public way over private property , the Board of Selectmen shall
require a plan drawn by a registered engineer or registered land surveyor at the
petitioner's expense which shall include all details of the road , names of all
owners and abuttors , areas to be taken , drainage disposal , easements and any
other specifications that the Board of Selectmen may require . If in the discre-
tion of the Board of Selectmen , a subdivision plan , approved by the Brewster
Planning Board , and duly recorded in the Barnstable County Registry of Deeds ,
exists , said plan may be used , provided that it complies with the necessary re-
quirements for the layout. No layout shall be considered by the Board of Select-
men if the road does not meet all of the requirements pertaining to road lay-
outs and road construction of the Brewster Planning Board Subdivision Regu -
lations as from time to time are amended . In addition , the Board of Selectmen
may require certain road repairs if deemed necessary before laying out said road .
If the Board of Selectmen decides that said road layout is in the best interests
of the Town relative to convenience and necessity , it shall institute proceedings

Resolved : The Nuclear Crisis Relocation Plan developed for the Town of Brew-
ster by The Massachusetts Civil Defense Agency proposes the evacuation of
23, 966 residents of the Town of Dartmouth to the Town of Brewster in the
event of the danger or perceived threat of nuclear attack . We , the Brewster
citizens in Town Meeting reject the State 's Nuclear Crisis Relocation Plan ,
finding that it creates an illusion of safety and is unrealistic and unworkable .
Certified copies of this resolution to be sent by the Town Clerk to the following :
President Reagan , Senators Kennedy and Tsongas , Representative Studds,
Governor Dukakis , The Massachusetts Defense Agency , Senator Doane , Repre-

ARTICLE 79. To see if the Town will vote to raise and appropriate the sum of
Twenty -Three Thousand and 00/ 100 ( $23 ,000 .00) Dollars to be used in con-
junction with the previous Article 78 in order to repair and/or resurface
HARWICH ROAD , from the intersection of LONG POND ( Route 137 ) ROAD
northerly to MAIN ( Route 6A ) STREET , a distance of approximately 2 ,200
feet .

ARTICLE 89. To see if the Town will vote to raise and appropriate or transfer
from available funds the sum of Ten Thousand Five Hundred and 00/ 100
( $ 10, 500.00 ) Dollars to purchase a tractor and attachments to be used at the
