December 15, 1969
in accordance with the Warrant, the meeting was held on Konda.y
evening, December 15, 1969 in the Brewster School Auditorium.
The meeting was called to order at 7:30 P. H. by the Moderator
Grant W. Koch. Tellers were Elisabeth Linnell, and Paul C.
tylver. Registrars of Voters were jean Gage, and Dorothea Dugan.
The Warrant and the return were read by the Town Clerk, Donal6'.
P. Consodine, with the exception of the articles, which were
read as they were considered.
ARTICLE l.To see if the Town will vote to transfer the sum
of Sevek undrec'1 Dolla=rs (h700.00) from Free Cash to the Law
Account.
VOTED unanimously to transfer the sum of Seven Hundred
Dollars 07.00.00) from Free Cash to the Law Account.
ARTICLE 2. To see of the Town will vote to authorize the
Selectmen to purchase, take by eminent domain, ,or otherwise
as vire the land shorn on plan entitled "flan Showing Marsh at
Ouivet Creek in Brewster, Mass. , as Surveyed for the Brewster
Conservation Commission, Scale W = 1001 , I1larch 1969, Yickerson
and Berger, Civil Engineers, Eastham & Chatham, I,1ass.'' , for Con-
servation purposes, excepting herefrom an easement as slow,m.
on said plan over Tarcel 6, said easement for the purpose of
layhg, re-laying, and installing and maintaining pipes and
other facilities necessary to supply .water to the acauarzum
operating on the upland abutting Parcel 6, said easement to
terminate upon expiration of the aquarium operation.; and raise
and appropriate a sum of money for such purpose and to determine
whether such appropriation shall be raised by taxation, by trans-
fer of available funds, by borrowing or otherwise and take any
action -relative thereto; and to authorize and direct the Brewster
Conservation Commission to enter into any agreements it deems
advantageous on behalf of the Town with the Commonwealth of
Massachusetts and/or the United States of America for partial
re-imbursement of the cost of the land.
VOTED that the Town appropriate the sum of $438.50 and
to further borrow the sum of $9,642.60 to purchase or take by
eminent d oma in the land shown on a plan entitled "Flan showing
marsh at Quivet Creek in Brewster, NAss. , as surveye? for the
Erewster Conservation Commission, Scale 141 = 1001 , hArch 1969,
Nickerson & Eerger, Civil Engineers, Eastham & Chatham, Mass.'`,
far conservation purposes, excepting herefom an easement over
%reel 6, said easement for the purposes of laying, -relaying,
installing and maintaining pipes and other facilities necessary
to supply water to the accuarium operating on the upland abutting
Parcel 6, said easement to terminate upon the expiration of the
acquarium operation, and to authorize and direct the .Erewster
Conservation Commission to enter into any agreements it deems
-advantageous on behalf of One town with the Commonwealth of
Rissachusetts for partial reimbursement of the cost of the land,
A hand count vote was held on the above article with the follow-
ing result: Yes,126, No,65, lacking the required 2/3 vote nec-
essary for passage. A recount wis called for and a ballot vote
was held. The article then carried by a vote of Yes, 149, No, 64.
ARTICLE 3 . To see if the Torun will vote to authorize the
Selectmen'to purchase, take by eminent domain or otherwise
accuire land shown on a plan entitled "Plan Showing Skaket
Creek in Brea-sten, Mass. as surveyed for the Eraws ter Conserv-
ation

Berger, Civil Engineers, Eastham & Chatham, Mass," for conserv-
ation purposes ; and raise ond appropriate a sum of money for
such purpose and to determine whether such appropriation shall
be raised by taxation, by transfer ov available funds by borrowing
or otherwise and take any action relative thereto; and to author-
ize and direct the Brewster Conservation Commission to enter into
any agreements it deems advantageous on behalf of the Town with

MCVF"D that the town vote no appropriate the sun of $561.70
and to further borrow the sum of �712,357.40 to rurchase or
take by eminent domain the land show on a plan entitled
"Plan sharing Skaket Creek in Brewster, Mass. , as
surveyed for conservation purposes, and to authorize and
direct the Brewster Conservation Commission to enter into
any agreements it deems advantageous on behalf of the Town
with the Commonwealth of Assachusetts for partial reimburse-
vent of the cost of the land.
Che ballot vote was Yes, 131, No, 71. The motion failed to
carry as a 2J3 vote was required.
ARTICIF 4. To see if the Torn will vote to a yro7riate
the sun of Three Thousand Five Hundred (03 , 500.00 dollars
for legal fees in connection with the accuisition of salt
marshes.
VOTED that the town appropriate the sum of $2,000.00
for legal -fees in connection with the acceuisition of salt
marshes.
ARTICIF 5. To see if the Town will vote to install and
maintain a street light at the junction of Point of Rocks
Road, and Dennison Road on pole 22/18/
VOTED that the town instar. and Maintain a street light
at the junction of Dennison Road, and Point of Rocks Road.
ARTICIE 6. To act. on ^ny other business that may legally'
come before said meeting.
There being no further business, it was voted to adjourn
at 9:43 P. I.
