HomeMy Public PortalAbout100_042_2015-663 North Beach AmusementsPage 1 of 6 ITB # 2015-663 CITY OF TYBEE ISLAND TYBEE ISLAND, GEORGIA The City of Tybee Island is soliciting invitations to bid for THE LEASE OF PUBLIC REAL PROPERTY AT NORTH BEACH PARKING LOT FOR PUBLIC AMUSEMENT – approximately +/- .25 acres. Bidders shall specify their best price per year to lease the space as identified in Exhibit “A”. The bids will be subject to site plan and/or special review for the proposed amusement. The successful bidder will have the right to lease the property only after obtaining the necessary municipal and other governmental approvals, as required by law. BIDS ARE TO BE RETURNED NO LATER THAN: MARCH 18, 2015 AT 10:00AM BIDS WILL BE OPENED ON MARCH 18, 2015 AT 11:00AM AT CITY HALL. ALL RESPONDENTS ARE INVITED TO ATTEND. The City is seeking a total bid package for service/materials equal to or exceeding specifications set forth on the attached pages which must meet or exceed stated specifications. Those not meeting these standards will be rejected. The attached material specifications become and remain a part of this request for bid All responses, inquiries, or correspondence relating to, or in reference to, this request for bids, and all reports, charts, displays, schedules, exhibits and other documentation by the bidders shall become the property of the City when received. All bids submitted in response to this invitation for bid shall become the property of the City. The City retains the right to use any or all ideas presented in any bid to the invitation to bid, whether amended or not. Selection or rejection of the bid does not affect this right. Bidders must respond completely by filling in all applicable blanks. Bids are subject to the terms and conditions of this Invitation to Bid. Bids shall be submitted in a sealed envelope, clearly marked on the outside of the envelope, to the office of the above address prior to the time specified. Page 2 of 6 Signature of bidder indicates that bidder understands and will comply with attached terms and conditions and all other specifications made a part of this invitation for bid and any subsequent award or contract. All terms, conditions and representations made in this invitation will become an integral part of the contract. Nothing contained within this RFP is indicative of intent by the City of Tybee Island to reimburse the bidder, in whole or in part, for any costs associated with preparation, submission, or presentation of bids. WAIVER: The City of Tybee Island reserves the right to reject any or all bids received. The City reserves the right to waive any variances from original bid specifications in cases where the variances are considered to be in the best interest of the City. SUBMISSION OF BIDS AND SUPPLEMENTAL MATERIALS Bids and all required or requested supplemental materials in compliance with the attached specifications shall be submitted to the above address. Supplemental materials will not be accepted after the bids have been opened, unless requested by the City. Please include a bid sheet, W-9, vendor application, and affidavit verifying status, which can be found at the end of this request. SPECIFICATIONS THE SUCCESSFUL BIDDER WILL BE REQUIRED TO ENTER INTO A LEASE AGREEMENT WITH THE CITY OF TYBEE WITH THE FOLLOWING SPECIFIC TERMS AND CONDITIONS: The initial term of this lease shall be for one (1) year with up to four automatic renewals. However, a condition of the lease will be that either party may terminate the agreement prior to the renewal of a new term by giving the other party sixty (60) days written notice. (1) The lessee shall assume sole responsibility for or incur liability for any injury to person or property caused by any act or omission of any person while on the property and shall agree to indemnify the municipality and hold it harmless from any claim, suit, or demand made by any person; (2) The lessee shall agree to indemnify the municipality and hold it harmless from any claim, suit, or demand arising out of any improvements to the property or any indebtedness or obligations incurred by the lessee or contractee in making any such improvement to such property; and, (3) The lessee shall be required to obtain waivers for all participants/customers of the amusement waiving any liability against the City of Tybee Island and its officials, employees and volunteers. PROPERTY DESCRIPTION The total area of the property to be leased is +/- .25 acres, and is more particularly described in Exhibit “A”, that survey by Bert B. Barrett dated February 05, 2015. A portion of the property is located within the shore protection area. The bids are for the entire +/- .25 acres. According to the survey, the area that is not within the shore protection area equates to +/- 7,565 square feet or +/- .170 acres. If the successful bidder intends to utilize the area in the shore protection area, the successful bidder will be required to obtain the necessary permits from Page 3 of 6 Department of Natural Resources. The City does not warrant that the entire area may be used, and expressly disclaims any liability related to use of the area located within the shore protection area. The successful bidder will be required to indemnify the City for any fines or penalties incurred due to any unauthorized use of the property within the shore protection area. The City will not be required to lower the lease price should the leased property in the shore protection area not be able to be utilized. PAYMENT The successful bidder will be required to pay three (3) months rent as a deposit at time of execution of lease. The rent shall be due on the first of each month the property is leased. INSURANCE REQUIREMENTS If applicable, contractor shall provide a Certificate of Insurance naming the City of Tybee Island as also insured, a 30 day cancellation notice, indicating the following minimum coverage: Comprehensive General Liability $2,000,000.00 Page 4 of 6 QUOTATION SHEET A.
