Report of the
ANNUAL TOWN MEETING
May 11 , 1987
In accordance with the Warrant , the Annual Town Meeting was held in the Brew-
ster Elementary School Cafetorium , Monday , May 11 , 1987 .
The Meeting was called to order at 7 : 10 P . M . by the Moderator , Stephen L .
Doyle . The Tellers were Dorothy Grenier , June Gallant , Gladys Curtis , Doris
Powell , Edwin Blease and J . Ogden Tyldsley , Jr . Checkers were Dorothea
Dugan , Carl Scrivener , Jean Gage and Antoinette Mara ,
The Warrant was read by the Town Clerk , Barbara A . Vaughn , with the excep-
tion of the Articles which were read as they were being considered .
To see if the Town will vote Articles 1 , 3 and 4 as a block .

ARTICLE 1 . To act upon the Annual report of the Board of Selectmen and
other Town Officers ,
ADOPTED
RESOLUTION
WHEREAS We , the inhabitants of the Town of Brewster , in the one hundred
and eighty -fifth Annual Meeting assembled May eleventh , one thousand nine
hundred and eighty -seven , "To act and do upon the whole as the inhabitants of
said Town of Brewster shall think proper ; " and
WHEREAS It is appropriate for good citizens to honor their loyal and faithful
public servants . Therefore , the Board of Selectmen , on behalf of all the citizens
of the Town of Brewster , extend to the late Ernest J . Gage a standing vote of
thanks for his many years of dedicated service as a member of the Board of
Health , Stoney Brook Mill Sites Committee and Alewife Committee . One can -
not adequately describe the invaluable contributions that Ernie gave to the
Town of Brewster . We will remember Ernie and he will live on forever in the
hearts of all who knew him .
THEREFORE We extend our profound thanks and express our deepest appre -
ciation to Rosamond R . Gage , the widow of Ernest J . Gage , for his years of
dedicated service .
AND BE IT FURTHER RESOLVED that this resolution be spread upon the
records of the Town as with the Board 's doings thereon , and a copy given to
Mrs . Rosamond R . Gage .

with the approval of the Board of Selectmen , to borrow money from time to
time in anticipation of the revenue of the financial year beginning July 1 , 1987
in accordance with the provisions of the General Laws , Chapter 44 , Section 4 ,

and to issue a note or notes as may be given for a period of less than one ( 1 )
year , in accordance with the General Laws , Chapter 44 , Section 17 , thereto .

ARTICLE 4 . To see if the Town will vote to assume liability on the manner pro-
vided by Chapter 516 and 524 , Acts of 1950, for all damages that may be in -

curred by the Department of Public Works of Massachusetts for the improve
AN ments , development , maintenance and protection of tidal and non -tidal rivers
and streams , harbors , tidewaters , foreshores , and shores along a public beach
w outside of Boston Harbor, including the Merrimack and Connecticut Rivers , in
accordance with Section 29 of Chapter 91 of the General Laws , and authorize

the Board of Selectmen to execute and deliver a bond of indemnity therefor to
= the Commonwealth .

ARTICLE 2. To hear the report of any Special Committees .

Mr . Carr, Chairman of the Capital Outlay Committee , summarized the
Committee 's written report .

He indicated that the Town 's bonded indebtedness , which stood
at $5W8
million at the beginning of the current year , will rise to $ 16 . 6 million at year end
based on votes already taken . The Committee estimates that necessary school511 V , ,

AVIVwater and public works facilities will further increase debt to at least $31 million
in the next several years .
The Committee expects that the tax rate will increase between 50 and
1 100% as a result of these projects and accompanying increases in operating ex
penses .

The Committee classified projected school , water and public works pro-
jects as necessary priorities which should be voted without delay . Further land
acquisitions and the town hall project should be deferred until the tax impact
of the necessities has been ascertained .
ARTICLE 5 . To see if the Town will vote to take no action regarding its Herring
and Alewives fishery .

ARTICLE 6 . To see if the Town will vote to raise and appropriate the sum of

ARTICLE 7 . To see if the Town will vote to raise and appropriate the sum of
Twenty thousand one hundred seventy -six and 00/ 100 ( $25 , 176 .00 ) Dollars to
be used to meet the terms and conditions of the collective bargaining agreement
effective July 1 , 1987 , between the Town of Brewster and the Service Em -
ployees ' International Union , Local 254 .

ARTICLE 8 . To see if the Town will vote to amend the Personnel By -law Wage
and Salary Scale adopted by the September 22 , 1986 Special Town Meeting and
the Personnel By -law Fixed Rate Unclassified Wage and Salary Schedule by
increasing the same by a certain percent and adjusting the rates therein accord -
ingly and to raise and appropriate the sum of Forty -four thousand one hundred
twenty -three and 00/ 100 ( $44 , 123 .00 ) Dollars needed to fund the Wage and
Salary Account of eligible employees covered by the Personnel By -law . Said
increase is permanent and is a cost of living adjustment effective July 1 , 1987 .

ARTICLE 9 . To see if the Town will vote to authorize the Board of Selectmen
to enter into a contract or contracts for professional services to undertake a
classification and pay study ; review the operation of our personnel system ; and
develop a performance appraisal system and to raise and appropriate the sum of
Twenty thousand and 00/ 100 ($20 ,000 .00) Dollars for this purpose .

ARTICLE 10 . To see if the Town will vote to raise and appropriate the sum of
Twenty -five thousand and 00/ 100 ($25 ,000 .00 ) Dollars for the salary of the
Master Carpenter/Supervisor position .

ALARM SYSTEMS , REGULATIONS , AND FALSE ALARMS
BY— LAW
DEFINITIONS :
For the purpose of this section the following terms shall have the following
meanings :
( a ) "Alarm System " — An assembly of equipment and devices or a single device
such as a solid state unit which plugs directly into a 110 volt AC line , arranged
to signal the presence of a hazard or emergency requiring urgent attention and
to which police , emergency medical personnel or firefighters are expected to
respond . Fire alarm systems and alarm systems which monitor temperature ,
smoke , humidity or any other condition not directly related to the detection of
an unauthorized intrusion into a premises or an attempted break at a premises
are included .
( b) " False Alarm " — 1 . The activation of an alarm system by an Agency other
than a bona fide hazard or emergency of a type which the system is designed to
warn against . For fire hazard or emergency of a type which the system is
designed to warn against . For purpose of this definition , activation of alarm
systems by acts of vandals , by acts of God , including , but not limited to hurri -
canes , tornados , earthquakes and similar weather or atmospheric disturbances
or power failure shall not be deemed to be a false alarm . 2 . Any signal or oral
communication transmitted to the Police or Fire Department requesting , requir -
ing or resulting in a response on the part of the Police or Fire Department in the
absence of any bona fide hazard or emergency .
( c ) "Users " means the owner occupant , and his/her agents , of the premises con -
taining the alarm systems , whether residential , commercial or otherwise .
CONTROL AND CURTAILMENT OF SIGNALS EMITTED BY ALARM SYS -
TEMS
( a ) Every user shall submit to the Police and/or Fire Chief the names and tele-
phone numbers of at least two ( 2 ) other persons who are authorized to respond
to an emergency signal transmitted by an alarm system and who can open the
premises wherein the alarm system is installed .
( b ) All alarm systems except fire alarm systems installed after the effective date
of this by -law which use an audible horn or bell shall be equipped with a device
that will shut off such horn or bell within ten ( 10 ) minutes after activation of
the system .
( c ) Any alarm system emitting a continuous and uninterrupted signal for more
than fifteen ( 15 ) minutes between 10 : 00 P . M . and 6 : 00 A . M . which cannot be
shut off or otherwise curtailed due to the absence or unavailability of the alarm
user or those persons designated by him under paragraph ( a ) of this subsection ,
and which disturbs the peace , comfort or repose of a community , a neighbor -
hood or a considerable number of inhabitants of the area where the alarm sys -
tem is located , shall constitute a public nuisance and be subject to the penalties

described in subsection III below . Upon receiving complaints regarding such a
continuous and uninterrupted signal , the Police or Fire Chief shall endeavor to
contact the alarm user , or members of the alarm user 's family or those persons
designated by the alarm users under paragraph
( a ) of this subsection in an effort to abate nuisance . The Police and /or Fire
Chief shall cause to be recorded the names and addresses of all complaints and
the time each complaint was made .
REGULATIONS AND PENALTIES
( a ) Upon receipt of three ( 3 ) or more false alarms from the same system within
a calendar year , the Police or Fire Chief may , in writing , order :
1 . The user to discontinue the use of the alarm .
2 . That any direct connections to the Police or Fire Departments be dis -
connected .
3 . That any further connection to the communications console in the
Police or Fire Station be contingent upon the user equipping any
alarm system with a device that will shut off any audible horn or bell
within ten ( 10 ) minutes after activation of the system .
4 . That the alarm system be changed , modified , repaired , upgraded or
replaced to eliminate false alarms .
( b ) The user shall be assessed a fee of Fifty and 00/ 100 ( $50 . 00) Dollars for
each false alarm in excess of three ( 3 ) occurring within the calendar year . All
fines assessed and collected hereunder shall be paid to the Town Treasurer for
deposit in the General Fund .
( c) Whoever violates a written order of the Police or Fire Chief as set forth in
paragraph ( a ) of this subsection shall be punished by a fine not to exceed Fifty
dollars ( $50 .00 ) for each offense and each day a violation continues shall be con -
sidered a separate offense .

linkage provision of affordable housing . Such a land bank shall be established
under a linkage formula between land purchases for conservation and the pro-
vision of affordable housing . The formula shall provide that land suitable for
the construction of affordable housing ( under either the Commonwealth 's 705
family housing program or the Commonwealth 's Homeownership Opportunity
Program or similar future programs approved by the housing authority ) be
deemed by the Town to the Brewster Housing Authority in the amount suffi -
cient to provide the equivalent of 10% of the number of house lots that would
have been created under current zoning on the land purchased for conservation .
The land deeded to the Housing Authority shall be land that the Town has not
taken for conservation . Alternatively , if no suitable parcel of land is available ,
the Town shall provide financial remuneration to the Brewster Housing Author-
ity to purchase , in combination with Commonwealth provided housing funds
( Chapter 705 ) , the equivalent number of housing units . This article shall be
retroactive to January 1 , 1987 , or to take any other action relative thereto .

Council for the purpose of increasing the support of arts and humanities in
Brewster by means of Fall Arts Festival to be held the second weekend in Sep-
tember , 1987 . The funds would be used in publishing a catalog , posters and
other forms of promotion , including a band concert and a "Gallery Day " in
Brewster . The funds would be expended exclusively for the benefit of Brewster
and its artistic community , under the direction of the Board of Selectmen .
