Presents the following Ordinance Seconded by Councilman
AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 222,
ENTITLED, "STREETS AND SIDEWALKS" OF CODE OF
THE BOROUGH OF CARTERET
BE IT ORDAINED by the Mayor and Borough Council of the Borough of Carteret (the
"Borough ") that Chapter 222 entitled "Streets and Sidewalks" is hereby amended and
supplements as follows:
Section 1. § 222 -2 "Definitions and word usage" is hereby amended and supplemented
to include the following new, additional definition:
PRE- APPROVED CONTRACTOR:
Any person who has applied for and received prequalification by submitting the
necessary forms to the Borough through a formal review process established by
the Borough Engineer.
Section 2. § 222 -4 "Application for permit" is hereby amended and supplemented to
include the following new, additional paragraph:
C. With the exception of utilities regulated by the Board of Public Utilities, any
persons performing excavation work within a public right -of -way shall be pre -
approved contractors. A list of pre- approved contractors shall be kept on file with
the Borough Clerk, Department of Streets and Roads and the Borough Engineer.
The applicant shall list the pre- approved contractor on the pen-nit application.
Section 3. § 222 -9 "Surety" is hereby amended and supplemented to replace the existing
paragraph "C" with the following new paragraph "C" with the balance of said section
remaining the same:
C. In lieu of a performance bond per job, any utility regulated by the Board of
Public Utilities, or any contractor expecting to request multiple permits per year,
may post a blanket performance guarantee in the minimum sum of $25,000 with
the Borough on an annual basis. Pre- approved contractors shall post a blanket
performance guarantee in the minimum sum of $25.000 with the Borough on an
annual basis to maintain their pre - qualification status. In the event the Borough
Engineer or Head of the Department of Streets and Roads determines that the cost
of proper restoration of the area disturbed and pavement surface will exceed the
amount of the blanket bond. an additional bond for that particular job, in an
amount to be detennined by the Borough Engineer, shall be posted by the
permittee prior to the issuance of any permit(s); the balance of the same shall
remain unchanged.

Section 4. All Ordinances or parts thereof inconsistent with the provision of this
Ordinance are hereby repealed limited to the extent of any such inconsistency. ' .
Section 5. If any section. paragraph. subdivision, clause or provision of this Ordinance is
adjudged invalid, such adjudication shall apply only to the section, paragraph.
subdivision, clause or provision so adjudged and the remainder of this Ordinance shall be
deemed valid and effective.
Section 6. This Ordinance shall take effect upon passage and publication according to
applicable law.

The foregoing ordinance was introduced at a meeting of the
Council of the Borough of Carteret held November 20, 2017 when it
was adopted on first reading.
The said ordinance will be further considered on second reading for
final adoption at a meeting of said Council of the Borough of Car-
teret on December 7, 2017 at approximately 6:00 P.M., Borough
Hall /Council Chambers, 61 Cooke Avenue, Carteret, New Jersey at
which time and place all persons interested will be given an oppor-
tunity to be heard.
