Hi Amy,
This all appears to be appropriate to me. Two quarts is a relatively small quantity and may
have never been reported to us. If you use the link below, you can see that 10 Gallons
triggers the reportable quantity to Massachusetts DEP. It appears that they were far less
than this and only had to report due to the reportable concentration requirement. From the
documentation if appears that the contaminated material was removed and the
concentration is now within normal limits.

American Tower has completed the renewal application for Certificate of Water Quality Compliance. Due to a spill of
hazardous material occurring on this site since the last application (Question 12), we have enclosed supplemental
documentation and a description of our remediation efforts.
In May 2020, American Tower’s natural gas generator had an engine oil release into the soil. A spill remediation vendor
was mobilized to address the spill. Although olfactory and PID readings did not indicate impact, concentrations of one
carbon range, C19-C39 aliphatics were detected above the applicable RCS-1. To confirm that the spill was remediated to
MA DEP standards, another mobilization in March 2021 was completed by a spill remediation vendor (EBI) to collect soil
samples from the vicinity of the post-excavation soil sample SS-2 to further evaluate the detected concentration of EPH
fraction C19–C36 aliphatic hydrocarbons related to the reported release of 2 quarts of engine lubricating oil from a
former generator within the ATC compound. EBI advanced four shallow soil borings, approximately 3-feet in each
intercardinal direction from the SS-2 sample location. There was no visual or olfactory evidence of contamination or
elevated PID readings above background observed in any of the soil samples collected and field screened. The analytical
results did not identify any concentrations of the EPH fraction C19-C36 aliphatic hydrocarbon above the laboratory
detection limits or MCP RCS-1 Reportable Concentrations in any of the six samples collected. Based on these results and
in accordance with MCP at 310 CMR 40.0315(2), EBI concludes that no MassDEP release notification is required, and no
further action is required.

Dear Ms. Ruth:
Please find attached the Soil Analytical Results Summary report for the American Tower telecommunication tower complex
located at 26 Freemans Way Industrial Park in Brewster, Massachusetts (the Site).
Background
EBI understands that a release of an estimated 2 quarts of engine lubricating oil occurred from a generator that was formerly
in use at the American Tower telecommunication tower compound at the SIte. The release was identified in May 2020 and
initial cleanup efforts included decommissioning of the generator and removal of a limited volume of soil from beneath the
generator. A post-excavation soil sample (SS-2) from within the impacted area indicated a concentration of C19–C36 aliphatic
hydrocarbons of 5,220 mg/kg remaining in soil at a depth of approximately 6 inches below grade. This detected concentration
is above the Massachusetts Contingency Plan (MCP) RCS-1 Reportable Concentration for this hydrocarbon range of 3,000
mg/kg. The MCP RCS-1 reporting concentration is applicable because the Site is located within a Zone II to a nearby public
water supply well, and groundwater within the area is classified as MCP category GW-1. EBI understands that no additional
removal actions were undertaken in response to this release and that MCP release notification to MassDEP of the detected
concentration of C19-C36 aliphatic hydrocarbon concentrations had not been made.
The MCP at 310 CMR 40.0315(2) requires release notification to MassDEP within 120-days when the detected
concentration of oil in soil exceeds the applicable Reportable Concentration, and “where the total contiguous volume of
contaminated soil is equal to or greater than 2 cubic yards.” EBI proposed to conduct additional soil sampling in the area
surrounding the post-excavation sample that exhibited the exceedance in an attempt to evaluate whether the 2-quart release
of lubricating oil did not impact more that 2 cubic yards of soil; and, therefore, would not require release notification under
the MCP.
Soil Sampling Activities and Laboratory Analytical Results
On March 11, 2021, an EBI representative mobilized to the Site to collect soil samples from the vicinity of the post-
excavation soil sample SS-2 to further evaluate the detected concentration of C19–C36 aliphatic hydrocarbons. Using
handtools, EBI advanced four borings, approximately 3-feet in each intercardinal direction from SS-2. A depiction of the
soil boring locations can be found on the Boring Location Map in Attachment A.
A total of six soil samples were collected from from depths ranging between 1.5 and 2.5 feet below grade surface. The
samples were transported under chain-of-custody to an independent qualified laboratory, Con-Test Analytical Laboratory
(Con-Test) of East Longmeadow, Massachusetts, to be analyzed for extractable petroleum hydrocarbons (EPH) C19-C36
aliphatic hydrocarbon only by MassDEP Methods.

Based upon observations made during the soil sampling activities, no visual evidence of staining or any olfactory residual
petroleum impacts were identified. The subsurface soils consisted of fill material consisting of brown fine to coarse sand,
silt, and gravel.
The vapor headspace of each soil sample was field-screened using a photoionization detector (PID). The PID provides a
reading of total ionizable volatile organic compounds (VOCs). The PID was calibrated with an isobutylene standard, to
measure total VOCs as isobutylene equivalents. The PID has a practical sensitivity of approximately one part per million by
volume (ppmV). PID readings should not be considered as exact measurements, but as relative readings of VOCs between
locations. The soil samples were placed in a ziplock bag approximately three-quarters full with the soil to be analyzed, which
was sealed for approximately 10 minutes in a warm (>60˚ F) location for equilibration. The headspace analysis was conducted
by inserting the probe of the PID through an opening in the ziplock bag and into the space above the soil sample. No visual
or olfactory evidence of contamination or elevated PID readings above background was observed in any of the soil samples
collected and field screened.
The analytical results did not identify any concentrations of the EPH fraction C19-C36 aliphatic hydrocarbon above the
laboratory detection limits or MCP RCS-1 Reportable Concentrations in any of the six samples collected.
A summary of the soil analytical results is included in Attachment B and the complete laboratory analytical report and chain-
of-custody documentation are presented in Attachment C.
Conclusions and Recommendations
EBI mobilized to the Site to collect soil samples from the vicinity of the post-excavation soil sample SS-2 (collected and
analyzed by others) to further evaluate the detected concentration of EPH fraction C19–C36 aliphatic hydrocarbons related
to the reported release of 2 quarts of engine lubricating oil from a former generator within the ATC compound. EBI
advanced four shallow soil borings, approximately 3-feet in each intercardinal direction from the SS-2 sample location.
There was no visual or olfactory evidence of contamination or elevated PID readings above background was observed in
any of the soil samples collected and field screened. The analytical results did not identify any concentrations of the EPH
fraction C19-C36 aliphatic hydrocarbon above the laboratory detection limits or MCP RCS-1 Reportable Concentrations
in any of the six samples collected.
Based on these results and in accordance wth MCP at 310 CMR 40.0315(2), EBI concludes that no MassDEP release
notification is required and no further action is required.

Item 1: Discuss Proposed Article XI Water Quality Protection District Bylaw Revisions to be
presented at Brewster Town Meeting November 15, 2021
Amy said she wanted to have a quick discussion, more for informational purposes because this
Bylaw Revision will directly affect this committee. Essentially, the section of the Zoning Bylaw which
is Article 11 Water Quality Protection District is going through some language changes to make it
easier for interpretation as far as staff and applicants located in the DCPC and will be affected by
those restrictions. We are also going to be presenting a Storm Water Bylaw at Fall Town Meeting
which also affects the current zoning bylaw for water quality protection district which currently
addresses some of the stormwater issues. We are taking it out of this section of the bylaw and will
be addressing it in the new stormwater bylaw. The other piece is we had discussed over a year ago
about changing the language in requirements for the certificate renewals related to septic systems.
Based on recommendations and discussions, a full septic inspection every three years seemed
overblown. We opted to go with a self-certification that the applicants will sign off on when they
apply. We have put the new language in the new draft regulation for WQRC. Amy said she still
needs to draft a new application including the self-certification language. When that is complete, she
will bring it before the board to discuss and approve. She provided the documents that showed the
changes.
Cyndi said she read through the documents, and she pretty much got the idea, however wondered
how the self-certification will be worded. Amy said the intent was to essentially state they have been
maintaining the system with no issues or problems and give them the opportunity to list any
maintenance or repair if necessary. She also said if there are any issues with a septic system, the
Health Department finds out about it quickly and it gets addressed. That is the primary reason there
is no need to get the system pumped or inspected every three years.

Item 2: Discussion and Vote on American Tower Renewal
Amy said this has been an approved use for quite a while - a cell tower on town property. She said
part of the renewal application, on page 2 number 12, states there is additional documentation on a
spill, and she doesn’t see any supplemental documentation regarding a spill. She doesn’t think they
use any type of hazardous materials for that site use, however, there are two options. We can
continue this to the next meeting, and she can find out about any additional information, or we can

Item 7: Informational Items
Amy said the additional piece of information was the report for Cape Sand and Recycling. This is a
standard report required for permitting from the DEP. Because of Covid, we didn’t have an
opportunity to do a walkthrough on the site which is usually done by this committee. Since Amy
started, she hasn’t had the opportunity to do a walkthrough. This committee should think about
scheduling, usually late winter, when things aren’t too crazy busy for them, and the weather isn’t too
cold or windy for us to be walking around outside. So far, she hasn’t had any complaints or issues
with the property. She said Jay and his crew have been doing a great job over there.
Cyndi thanked her for mentioning that, and said over the next couple of meetings, we should sort
that out.
