VILLAGE OF PLAINFIELD RESOLUTION NO. 1566 A RESOLUTION AGREEING TO INDEMNIFY THE STATE OF ILLINOIS FOR PHOTO ENFORCEMENT EQUIPMENT ATTACHED TO IDOT FACILITIES. PUBLISHED IN PAMPHLET FORM BY THE AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES, ILLINOIS, THIS 22ND DAY OF JULY, 2008. Y ~ RESOLUTION NO. 1566 RESOLUTION AGREEING TO INDEMNIFY THE STATE OF ILLINOIS FOR PHOTO ENFORCEMENT EQUIPMENT ATTACHED TO IDOT FACILITIES WHEREAS, the Village of Plainfield, is desirous of constructing certain red light photo enforcement facilities attached to Illinois Department of Transportation ("IDOT") facilities; WHEREAS, IDOT has determined that the attachment of photo enforcement equipment to its facilities may be permitted and is in the interest of increasing the safety of the motoring public; and WHEREAS, pursuant to Safety Engineering Policy Memorandum 2-07, IDOT will issue a permit for the attachment of photo enforcement equipment to IDOT facilities pravided IDOT has obtained a resolution from the Village of Plainfield agreeing to indemnify the State of Illinois for any claims maintained as a result of the red-light photo enforcement system, including its installation, operation, maintenance and removal; and WHEREAS, the corporate authorities of the Village of Plainfield deem it in the interest of the Village to adopt such a resolution to facilitate safety of the motoring public. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS as follows: SECTION ONE. The findings in the Preamble to this Resolution are incorporated herein and made a part hereof by this reference. SECTION TWO. The Village agrees to indemnify and hold harmless the State of Illinois for any claims that may be made against it, its employees, agents and IDOT as a result the installation, operation, maintenance and removal of red-light photo enforcement equipment to IDOT facilities. SECTION THREE. Any Village Ordinance or Resolution, or part thereof, in conflict herewith, is to the extent of such conflict, expressly repealed. SECTION FOUR. This Resolution shall be in full force and effect after its passage, approval, and publication in pamphlet form, as provided by law. PASSED the 215` day of July, 2008.
