Driscoll,Town Manager Date: October 6, 2016 RE: Proposed Amendment to the Fiscal Year 2017 Budget Enclosed please find, for your review and consideration a Proposed Amendment to the Fiscal Year 2017 Budget. The Proposed Amendment is related to the following: o New Growth number updated from the adoption of the Fiscal Year 2017 Budget. • Receipt of actual Fiscal Year 2017 Cherry Sheet Estimated Receipts and Charles (Attachment 1). • Pro Forma Tax updated from the adoption of the Fiscal Year 2017 Budget. • Appropriating monies from Utilization of Free Cash to acquire property known as 10 Winter Street by eminent domain (Attachment 11). 1 respectfully request the attached Amendment be placed on the October 11, 2016 Town Council Agenda as a First Reading amending the Fiscal Year 2017 Budget. Given this Amendment, the Fiscal Year 2017 Revenues and Expenditures will be each increased by $816,916. Driscoll, Town Manager Date: October 6, 2016 RE: Agenda Items--Resolution to Acquire Property Known as 10 Winter Street by Eminent Domain. Order of Taking— 10 Winter Street Enclosed please find, for your consideration and review, correspondence from. Steven Magoon, Director of Community Development and Planning/Assistant Town Manager regarding goals and objectives included in the Town's Open Space and Recreation Plan 2015 Update and Comprehensive Plan related to the Community Path,parking and road design. As you are aware, the property owners of 10 Winter Street approached the Town to see if there was any interest in acquiring their property. Given the above mentioned goals and objectives included in the long range planning documents and further direction from the Honorable Town Council, negotiations were held with the property owners of 10 Winter Street and an agreement was reached on the value and acquisition of this property. You will note in the attached"Resolution to Acquire Property Known as 10 Winter Street by Eminent Domain"that the sum of$796,000 is listed as damages for the proposed taking by eminent domain for parking and open space purposes. Therefore, given all of the above, I respectfully recommend and request your favorable consideration on the following attached items at the October 25, 2016 Town Council Meeting: o A Resolution to Acquire Property known as 10 Winter Street by Eminent Domain Order of Taking--- 10 Winter Street Town Attorney Mark R. Reich will provide an overview of these proposed actions at the October 25, 2016 Town Council Meeting. A Proposed Amendment to the Fiscal Year 2017 Budget, which includes monies from Utilization of Free Cash to acquire the above mentioned property, will be on the October 11, 2016 Town Council Agenda as a First Reading. The proposed Amendment to the Fiscal Year 2017 Budget will be advertised in accordance with the provisions of the Watertown Home Rule Charter and will be placed on the October 25, 2016 Toni Council Agenda as a Public Hearing and Action by the Honorable Town Council. Driscoll, Town Manager From: Steve Magoon, DCDP Director,Assistant Town Manager Date: October 6, 2016 Subject: 10 Winter Street I am writing in support of the acquisition of the property known as 10 Winter Street. This property represents an opportunity to implement several goals of our long range planning documents and enhance the governmental complex. The implementation of these goals can be accomplished through the extension of the Community Path through Watertown Square to the Town Hall complex,and including much needed parking and an unproved design for transportation in'this area. For many years,there have been a number of residents committed to creating a Community Path that would provide a connection from the Charles River park system to Main Street, through Watertown Square, and through the Arsenal Street Corridor to connect to the State,Greenway Path that connects to Cambridge and Alewife Station. This concept was supported by the Honorable Town Council when on March 24, 2015, they approved the Open Space and Recreation Plan 2015 Update, which was developed concurrently with the 2015 Watertown Comprehensive Plan, which was adopted on June 23, 2015. Both of these planning documents provide clear guidance with regard to supporting and enhancing opportunities for active recreation and transportation, The Open Space and Recreation Plan includes a goal to "Make Watertown friendlier to pedestrians and bicyclists and promote active and healthy lifestyles", which is further supported by the objective to "Develop multi-use path connections (i.e.Watertown Community Path and the Watertown Cambridge Greenway)". Similarly,the Comprehensive Plan Transportation element Goals regarding Pedestrian and Bicycle policies include "Continue to identify potential opportunities for on and off road bicycle connections between corridors and traffic destinations." The Open Space and Recreation element of the Comprehensive Plan also includes a goal to "Promote Active and Healthy Lifestyles" and that is further described by an implementation strategy to "Complete the Community Path and support other linear path/park development". This portion of the Community path is a critical piece of this infrastructure as it allows for off road bicycle and pedestrian travel through the Town center. This will link our residential neighborhoods with our commercial centers and our most precious environmental resource, the Charles River. The ability for residents to make these connections off road will be a major accomplishment. Similarly, the Comprehensive Plan supports the inclusion of parking in and around the Watertown Square,which includes the Town Hall complex. As outlined in the implementation strategy"Evaluate future development proposals with an eye towards increasing the publicly available parking supply,particularly in Watertown Square". The Plan supports the redesign of our transportation system in this area, "Encourage the incorporation of multimodal design into roadway projects to ensure that streets are shared by all users and not dominated by cars", and also includes the development of a Complete Streets policy. These design philosophies are prevalent in the Plan, and the acquisition of this property would allow for a redesign of the circulation and parking to embody these ideals. NOW THEREFORE BE IT RESOLVED that the Town Council of the City known as the Town of'Watertown take by eminent domain, for parking and open space purposes, without limitation, the fee in and to the parcel of land shown as 10 Winter Street, Watertown (the"Property"), which Property contains 3,782 square feet, more or less, as shown on a plan entitled "10 Winter Street Watertown,Massachusetts Record Owner: McDerrnott-Watertown Nominee Trust," dated August 24, 2016, said plan recorded herewith, and which is described in a deed recorded with the Middlesex South District Registry of Deeds in Book 53348, Page 127, and an Order of Taking of the Town Council, recorded herewith, and, further, to authorize the Town Manager to record said Order of Taking, and, further,to appropriate the sum of Seven Hundred Ninety-Six Thousand and 00/100 Dollars ($796,000.00) from utilization of free cash for said acquisition by eminent domain, and award said sum as damages for the foregoing taking.
