Councilman Presents the following Ordinance Seconded by Councilman
AN ORDINANCE OF THE BOROUGH OF CARTERET
AUTHORIZING ACQUISITION OF A PROPERTY INTEREST IN
BLOCK 2701, LOT 1, 1299 ROOSEVELT AVENUE, CARTERET,
FOR THE CONSTRUCTION AND MAINTENANCE OF A
MONUMENT SIGN
WHEREAS. pursuant to N.J.S.A. 40:48 -2. the Borough ol'Carteret is authorized to adopt
an Ordinance for the preservation of public health. safiny and % %elfarc: and
WHEREAS. pursuant to N.J.S.A. 40A:12 -1 et sc____y.. the Borough of Carteret has the
po%%er to acquire any real property for a public purpose: and
WHEREAS, the Borough of Carteret is committed to improving the business
env ironment in Carteret through the Carteret Business Partnership: and
WHEREAS. support of the Carteret Business Partnership by the Borough of Carteret is
in the public interest for die health and vrelfare of its citizens: and
WHEREAS. the Borough of Carteret constructed a monument sign on Block 2701. Lot
1. commonly referred to as 1299 Roosevelt Avenue. Carteret. to promote the businesses
in the Borough's business district. and
WHEREAS, the City has determined that it Mould serve a public purpose for it to
acquire a property interest in Block 2701. Lot 1. for the purpose of construction and
maintenance of the monument sign.
NOW THEREFORE, BE IT ORDAINED AND ENACTED. by the Borough Council
of the Borough of Carteret. Middlesex County. Nevr Jcrse%. as follows:
Section L 'rhe acquisition o1' a property interest for a monument sign on
Block 2701. Lot L 1299 Roosc%elt Avenue. by purchase or condemnation is hereby
authorized.
Section 2. 'rhe Mayor. the Clmief Financial Officer and the Director of Lave
are each hereby authorized to sign am document necessary to effectuate the acquisition
of such property interest.
Section 3. Any and all ordinance or resolutions of the Borough. or pro%ision
thereof. inconsistent with the provisions of this Ordinance shall lx and are hcrehy
repealed as to the extent of any such inconsistencies.
Section d. If any section. subsection. pan. clause or phrase of this Ordinance
or the Redevelopment Plan shall be declared invalid by judgment of any Court of
competent jurisdiction. such section. subsection. part. clause or phrase shall be deemed to
be severable from the remainder of this Ordinance or the Redevelopment Plan. as
applicable.
Section 5. 1 his Ordinance shall take effect upon final passage and publication
in accordance with applicable la%%.

Council of the Borough of Carteret held September 21, 2017 when
it was adopted on first reading.
The said ordinance will be further considered on second reading for
final adoption at a meeting of said Council of the Borough of Car-
teret on December 28, 2017 at approximately 6:00 P.M., Borough
Hall /Council Chambers, 61 Cooke Avenue, Carteret, New Jersey at
which time and place all persons interested will be given
