HomeMy Public PortalAboutResolution 1487RESOLUTION NO. 1487 A RESOLUTION AUTHORIZING REIMBURSEMENT FOR THE CONSTRUCTION OF IMPROVEMENTS BENEFICIAL TO THE PUBLIC WHEREAS, the Village of Plainfield (hereinafter referred to as "VLL,L,AGE") has made certain improvements to the trunk sewer line in the following general location: 143~d Street from Van Dyke to Route 30 and Route 30 from 143"' Street to West Norman Drain in 2002 and 143"' Street between Route 30 and west of Meadow Lane at Dayfield Subdivision in 2004 (hereinafter referred to as IMPROVEMENTS"); and WHEREAS, the IMPROVEMENTS are valuable and. substantial improvements benefiting property shown in Exhibit "A" attached hereto and made a part hereof and which is further described as the "BENEFITING PROPERTY'; and WHEREAS, it is the opinion of the corporate authorities of the VILLAGE that such IMPROVEMENTS benefit the property outlined in Exhibit "A" and identified as the Sanitary Sewer Recapture Area -Northwest Basin. NOW, THERF,,FORE, BE IT RESOLVED BY THE PRESIDENT AND 130ARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, as follows: SECTION 1 The foregoing recitals are hereby incorporated by reference into the body of this Agreement as if fully set forth and repeated. SECTION 2 The cost of the IMPROVEMENTS, as described in Exhibit "A", attached hereto and made a part hereof; have been certified in the sum of one million one hundred sixty-five thousand six hundred seventy-seven dollars ($1,159,53 $.97). The VILLACrE shall be entitled to recapture otae hundred (100) percent of` those costs constituting the IMPROVEMENTS in the amount of $1,159,538.97 from the BENEFITING PROPERTY at a rate of $279/acre, as described in Exhibit "A". C:\Documents and 5ettings\sjanik.PLAINFIELD\Local Settings\Temp\RESOLUTION_060131-NW.doc SECTION 3 The VILLAGE staff is authorized to collect said sutra of $1,159,538.97 from the BENEFITING PROPERTY, including requiring said payment as a condition of any final plat of subdivision or before any building permits are issued, or as a condition of annexation, whichever occurs first, as to the BENEFITINGr PROPF..RTY. SECTION 4 Interest at the rate of four percent (~%) per annum will be charged on any unpaid amounts beginning two years after the completion and acceptance of the V illagc of said improvements or execution of this Agreement, whichever occurs sooner.
