Home My Public Portal AboutOrd. 17-20wrbinan e No. 17 -2 0 of toe Ovrough of Carteret, J- Councilman Presents the following Ordinance Seconded by Councilman AN ORDINANCE TO AUT14ORIZE THE ACQUISITION OF CERTAIN REAL PROPERTY WITHIN THE BOROUGH OF CARTERET WHEREAS, the Mayor and Council of the Borough of Carteret ('Borough ") has determined that a need exists to acquire the follotking parcels of real property Ibr public purposes as are authorized b) la\%. including but not limited to the rude\ elopmem thereol and'or the establishment of a bicycle/pedestrian circulation system and similar public recreation uses: BLOCKS /LOTS (All or a Part Thereon Block 100. Lot I Block 100. Lot 2 Block 100. Lot 3 Block 303. Lot I WHEREAS, the Governing Body has determined that said uses are for public purposes and %% ill promote the general health and welfare of the community. and WHEREAS, Section 40A:12- 5(a)(1) of the Local Land and Buildings La«. N.J.S.A. 40A:12 -1 el scy_ and Section 40A: 12A-8(b) and 8(c) of the Local Redo%elopment and Housing La%%. N.J.S.A. 40A:12A -I et cey.. each empo%ver municipalities to acquire real proper) by direct negotiation leading to the purchase of said property. or by condemnation should that be neecssar\. NOW THEREFORE, BE IT ORDAINED, b) the Mayor and Council of the Borough of Carteret, as follo%%s: SECTION 1. The lorcgoing recitals are hereby incorporated by reference as if full) set forth herein. SECTION 2. The acquisition of the aforementioned parcels of real property within the Borough of Cancret by am of the follox%ing methods: (i) consummation of a purchase and sale contract ehich is the product of direct negotiations \ %ith the of +ners of such properties. (ii) b) a gift. grant or contribution by a% owner of such properties. or (iii) by condemnation of am such property that is carried out pursuant to the Eminent Domain Act. N.J.S.A. 20:3 -1 ci .sey.. is hereby authorized and directed for the purposes pro%ided for herein. and for such other municipal purposes as may be authorized by law. SECTION 3. The Borough Attorney. and!or other special legal counsel. are hereby authorized and directed to perform or carry out or cause to he perl'ormed or carried out. any studies. surveys. tests. soundings. borings. appraisals. title searches and title report re%ic%%s as reasonabh necessary to determine the %alue of any of the properties. the location and quality of any of the properties and any environmental matters associated with any of the properties and to undertake an) action necessary or appropriate to acquire the aforementioned real properties. The Borough Attorney. and /or other special legal counsel. are hereby authorized to negotiate with the property's owner. and the Borough Attorney, and /or other special legal counsel are authorized to file and pursue any condemnation action, as necessary. SECTION 5. The Mayor and Borough Clerk and such other ollicers as may be necessary are hereby authorized to undertake any actions and execute and deliver any paper, form or document necessary or appropriate to acquire said properties by any of the methods set forth in Section I of this ordinance.
