HomeMy Public PortalAboutResolution 1450 RESOLUTION NO. ~~d RESOLUTION OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD TO NEGOTIATE FOR AND IF NECESSARY CONDEMN CERTAIN PROPERTY FOR THE PURPOSE OF MAKING PUBLIC IMPROVEMENTS TO CONSTRUCT ROADWAY EXTENSIONS AND SIGNAL INSTALLATIONS ~:' WHEREAS, it is necessary that the Village of Plainfield obtain certain property for the purpose of making public improvements to construct roadway extensions and signal installation far the public good; and WHEREAS, 65 ILCS S/11-61-1 authorizes the Village of Plainfield to acquire property through eminent domain; and WHEREAS, 735 ILCS 5/7-103.119 authorizes the Village of Plainfield to institute "quick-take" proceedings to acquire certain parcels; and WHEREAS, it is necessary that specific direction. be given to agents of the Village of accomplish the same, NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: The following described property is required by the Village of Flainfiield for the purpose of making public improvements to construct road and signalization systems; SEE EXHIBIT "A" WHICH IS ATTACHED HERETO AND MADE A PART HEREOF SECTION 2: The President and Board of Trustees of the Village of Plainfield hereby find that the aforementioned property and interests to be acquired therein are useful, advantageous, and/or desirable for municipal purposes, specifically to make needed public improvements to the road and signalization systems within the Village. .. SECTION 3: The Plainfield Village attorney, and/or Village Administrator, as agent for the Village, is hereby authorized to negotiate as to compensation to be paid for the afarernentioned property, and, in the event an agreement on compensation cannot be reached, the law firm of McKeown, Fitzgerald, Zollner, Buck, Hutchison & Ruffle, as an agent for the Village, is hereby authorized to commence eminent domain proceedings, including "quick-take" proceedings to acquire said property. SECTION 4: This Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Nail marking the southwest corner of said Section 33; thence on an assumed bearing of North 00 degrees 30 minutes 36 seconds West 523.00 feet along the west line of the Southwest Quarter of said Section 33; thence North 89 degrees 29 minutes 19 seconds East 40.00 feet; thence South 00 degrees 30 minutes 36 seconds East 379.66 feet along a line 40.00 feet easterly of and parallel to the west line of the Southwest Quarter of said Section 33; thence South 26 degrees 12 minutes 37 seconds East 115.56 feet to a point on the northerly existing right of way line of 135` Street (Pilcher Road); thence South 00 degrees 00 minutes 24 seconds East 40.00 feet to a point on the south line of the Southwest Quarter of said Section 33; thence South 89 degrees 59 minutes 36 seconds West 89.76 feet along the south line of the Southwest Quarter of said Section 33 to the paint of beginning, containing 0.585 acres, more or less, of which 0.417 acres, mare or less, is in existing U.S. Route 30 and 135'x' Street (Pilcher Road) right of way.
