RESOLUTION OF THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF PLAINFIELD TO
NEGOTIATE FOR AND IF NECESSARY CONDEMN
CERTAIN PROPERTY FOR THE PURPOSE OF MAKING
PUBLIC IMPROVEMENTS TO CONSTRUCT ROADWAY
EXTENSION AND WATER AND SEWER IMPROVEMENTS
WHEREAS, it is necessary that the Village of Plainfield obtain certain property for the
purpose of making public improvements to construct roadway extension, water and sewer
improvements for the public good; and
WHEREAS, 65 ILCS 5/11-61-1 authorizes the Village of Plainfield to acquire property
through eminent domain; and
WHEREAS, 735 ILCS S/7-103.119 authorizes the Village of Plainfield to institute
"quick-take" proceedings to acquire certain parcels; and
WHEREAS, it is necessary that specific direction be given to agents of the Village of
accomplish the same,
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION 1: The following described property is required by the Village of Plainfield
for the purpose of making public improvements to roadway, water and sewer systems;
SEE EXHIBIT "A" WHICH IS ATTACHED HERETO AND
MADE A PART HEREOF
SECTION 2: The President and Board of Trustees of the Village of Plainfield hereby
find that the aforementioned property and interests to be acquired therein are useful,
advantageous, and/ar desirable for municipal purposes, specifically to make needed public
improvements to the roadway, water and sewer systems of the Village.

SECTION 3: The Plainfield Village attorney, and/or Village Administrator, as agent for
the Village, is hereby authorized to negotiate as to compensation to be paid for the
aforementioned property, and, in the event an agreement on compensation cannot be reached, the
law firm of McKeown, Fitzgerald, Zollner, Buck, Hutchison & Ruttle, as an agent for the
Village, is hereby authorized to commence eminent domain proceedings, including "quick-take"
proceedings to acquire said property.
SECTION 4: This Resolution shall be in full force and effect from and after its passage
and approval in the manner provided by law.

That part of Outlot "A" in Indian Oaks Estates Unit Six, a subdivision of part
of the Southeast Quarter of Section 17 in Township 36 North and Range 9 East
of the Third Principal Meridian, in Will County, Illinois, according to the plat
thereof recorded Apri16, 1989 as Document Number R89-15582, described as
fallaws:
Beginning at the southeasterly corner of Outlot A, thence South 45 degrees 31
minutes 50 seconds West along the south line of the aforesaid Outlot 147.49 feet
to the southwesterly corner of the aforesaid Outlot; thence North 0 degrees 0
minutes 26 seconds East along the west line of the aforesaid Outlot 221.82 feet;
thence on a northeasterly bearing 134.05 feet to a point on the east line of the
aforesaid Outlot that is 201.53 feet north of the southeasterly corner; thence
southerly along the east line of the aforesaid Outlot 201.53 feet to the point of
beginning; containing 0.511 acres, more or less, all in Will County, Illinois.

Subject: Property Acquisition
On the Agenda for Tuesday, February 22 are three (3) Resolutions required to complete prior Village
Board policy to acquire rights-af way for public projects. Two (2) of these Resolutions describe the
location and required improvements. One (1) Resolution describes the anticipated work schedule.
The first Resolution entails the acquisition of approximately .511 acres and is for the purpose of
extending water, sewer, and roadway generally south of the present terminus of New Van Dyke
Road. The property is vacant and does not require any resident or structure relocation and our
authority to acquire it results from legislation adopted in Springfield and signed by the Governor.
This is commonly referred to as "quick take" authority. The matter must be presented to the local
court system to determine compensation. Compensation will be paid, as permitted by law, after the
Village acquires the parcel.
The second Resolution entails the acquisition of approximately .417 acres at the northeast corner of
135`" Street and Route 30 and is for the purpose of widening the intersection and installing permanent
tralfic signals. The Village has rights presently for the remaining corners. The property is vacant and
does not require any resident or structure relocation. Our authority to acquire the parcel is again
through "quick take" legislatian and will progress as with the first parcel.
The third Resolution states fox the record the Village's intent' and anticipated work schedule. 1\~Ir.
