HomeMy Public PortalAboutResolution 1434RESOLUTION NO. 1434 WHEREAS, the Village of Plainfield has jurisdictions for certain sections of River Road; and, WHEREAS, the roadway improvements necessitated the removal of curb and gutter along the east of River Road; and, WHEREAS, property owners immediately adjacent to that curb and gutter had initially absorbed the cost of that construction in their home purchase; NOW, THEREFORE BE IT RESOLVED that should the Village of Plainfield reinstall curb and gutter along that section at any time in the fixture, there will be no charge or assessment for the properties presently addressed, 16051, 16101, 16041, 16111, and 16021 South River Road. It is the intent of the Village of Plainfield that any future curbs and gutter installation be at municipal cost. Burghard , Uate: September 15, 2004 f . . - ~•~~ ,+ ~ (~.,.,,,..< ~ ~~ ~ ~~ Subject: Neighborhood Petition ~, \. ~.~ Attached is a petition signed by five (S) residents of Leewood Subdivision (unincozporated) regarding the road and drainage improvements being constructed on. River Road. The neighbors are requesting either: a) Replace their curb when the road is reconstructed; or b) Guarantee in writing that if curb is ever installed on River Road, these property owners will not be required to pay for the curbing. River Road is essentially a "rural cross section" north, south, and west of these homes. Our plans do anticipate removal of the curb largely because the entire roadway system needs replacement. Soils and slopes need to be improved. How does one excavate a new roadway but leave the existing curbline which rests in part on the road bed and helps define drainage? The comprehensive solution is to insure proper reconstruction for the long term. Rumors have circulated that the road is too low, that driveways will be impassable, and drainage will be a problem. This is not the case. River Road, when completed, will be at an elevation near identical to the existing level. Driveways will be replaced where disturbed by construction to near identical present slopes. Our staff has talked to the contractor's (Baish) Field Superintendent. He- knows the road design, agrees to follow it, and works continually with our staff and Baxtzr and Woodman. In terms of the Petitioner's desired solutions, eve can guarantee in v~~-iting by a Board Resolution that "should the Village install curbing along River Road in the future, it will be done at no cost to the adjoining property owner- This is a reasonable solution. Plainfield, Il 60544 Dear Mr. Burghard; ~n behalf of several citizens in the Leewoad subdivision, on the southwest side of Plainfield, I have included a copy of a petition that we are presenting far Village Board consideration. I am presenting this to you well in advance of the September 20 board meeting in order to provide opportunity to review the document, and ensure that neither you, the mayor, nor board members will be blindsided by this request. I asked your secretary for direction in this case, and she identified you as the party to whom this should be (initially, at least) submitted. Thank you for receiving it, and far communicating its contents to the rightful parties in a timely way prior to the board meeting. The citizens who have signed this petition will be represented at the September 20 meeting, and we are planning to verbally present this information for public consideration of the bard at that time. Dear Mayor Pro-Tem, Board Members, and Village Administrator: This letter of petition is intended to solicit your attention and action to remedy an unfair, and what we consider to be unconscionable action being ,perpetrated upon property owners on River Road. As a consequence of the new Guinta development taking place west of River Road in this _ locale, River Road is being replaced. It will be lowered and completely re-done. ,The ~~ section of road in question is that portion south of the American Legion Hall (at Renwick and River), and north of Easy Street. We have been informed that the curbing that presently lines the east side of River Road ~_ will be removed as a part of this development project. THERE IS ND INTENT OR PLAN TO REPLACE THE CURBING after it is removed. The curbing was installed by Ralph Bada when he created the subdivision, and currently serves to provide water run-off control for those properties.. The curbing was an existing part. of the six individual properties an the East. side of River Road when: each of those properties was purchased. The home owners paid for that curbing as a part of the purchase price of their properties: Even if the curbing is considered Township "property", it does affect the visual "look" of the property; and provides water run-off, "` "` protecting our yards from erasionlpaoling in heavy rains:' We feel that we are being treated unfairly and unjustifiably in removing a perananent structure (that was definitely a part of our property when we purchased the land) without replacing it with a like structure (curbing). We believe it to be a normal and expectable procedure to replace whatever is presently in existence an the properties in question. To , _.. be sure, we are N(~T asking for anything beyond what already affects the value of our property in a positive way. While-our property is still township, Plainfield Village limits are now the road. that meets our property line. We ask that you to consider what your own reaction would be, were you to be personally involved in this scenario. ~ 36 l~ We strongly feel that one of two options be imposed upon the development/construction project: 1) replace the curbing where it presently exists with like curbing at the new road level. We consider this to be simply equity: replace what you remove! 2) Guarantee in writing that, in the event of future expansion, annexation, ar other reasons far curbing to be installed at some future time, the residents who presently have curbing (6 properties) WILL NOT HAVE TO PAY FOR CURBNG TO BE INSTALLED A SECOND TIlVIE -since we already have it now, and are adamantly apposed to the removal of our present curbing unless it is replaced with same. We have already paid for it once; it would be improper to ask us to pay for it AGAIN. Thank you for considering our request.
