City of Richmond; Indiana , met in regular session at the office of said Board inu;rs-: May 31st, 19.23, at 9 o' clock A. M. All the members of said Board', Messrs., Land, McFall and Henley being present. The following proceedings were - had, to-wit : - - The"Board authorized the President Mr. Land, to sign agreement with E.W.Harbert , granting said Harbert permission to sell golf eq .ip- ment in Glen Miller Park in connection with the Public Golf Course therein, for a period of time ending November 15th , 1924, at which time said permit will terminate, In consideration- that the said E.W.Harbert agrees to furnish a reliable man. under his personal direction at his own cost and expense to manage said Golf Course to the satisfaction of the Board.' It shall be the duty of said E.W. Harbert to collect' a specified fee fixed. by the Board, to be paid by each person using said Golf Course, and ih all things to carry • out the rules, instructions-, 'orders & dir'stions of said Board. from time to time , and to'. report each week to said Board the amount of ' motley' collected and pay the ,same to the City Treasurer for the sole use and benefit of the . said City. It is understood that the rules & adopted by the Board from time to time shall be deemed a part of this contract in connection with the. operation of said Course . It is futther agreed that no expense of any kind or character for labor, material , services ,or otherwi se,shall be charged against the City by said E.W.Harbert ; or any of his employees ,. by 'vi rtue of- the permission hereby given to operate said Golf Course in Glen Miller Park. (See cont. ) for bi ds The Board directed the Clerk to advertiseVfor City- Legal -Advertising for the year ending June 30th , 1924. using the old specifications, ex- cept , by inserting 'in the specificati one , that each bidder shall sub- mit with hia •bid , a sworn statement of City Cir.cul'ation. • The Clerk was directed to advertise for Band Concerts to be held. i • n Glen Miller Park during the season of 1923.. Pursuant to advertisement , the Board received bids for Motorcycle for use of Police Department as follows, 'to -wit : - " Earl J. Wright , bid : One special Harley- Davidson 74 elec.egp. complete , 5�400.75 -Allowance -on the old 'motorcycle 150.00 Net. price ' 250 75 One H.D.'egp.a sabove ,net-5}3236'.75;H.D. 61 net , -5 175.75;Ice.-, 2'64. 25 _ "Myers & Kemp'er,bid #74- Indian. 01.00.for old motor-net--0268. 50 • One 4 cyclinder Henderson, net 0328 .00 "Elmer' S.Smith, bid : Excelsi or,N325 .00 old motor- 100.00 net --0225 .00 Henderson 4, 0400.00 allowance old Motor- 100.00--i et- 0300.00. Upon the recommendation of t tim.Eversman Sup' t. , of Police , the Board on motion awarded the contract to Earl J. Wright, for One special Harley-Davidson Motorcycle fully equipt , for the price named in above bid #74 Net $250.75. • The Board approved the contract 8c bond of John S. Duke, contractor under Improvement Resolution No. 673-1923. ThuYrsd ,y May 31 st, 1923. 441 The following communication from the City Attorney was received and ordered spread on the minutes , and a copy given to City Controller:- To the City Controller & Board of Public Works, May 29 , . 1923. of Richmond , Indiana. Gentlemen : . The matter of the legality of paying the sum of 01268.00 - for Buick automobile out of the Appropriation for Small Equipment from the Rinds of the Municipal Electric Light & Power Plant ,has been referred to me by the City Controller some tithe ago . I find at the time the 1923 budget was made out there was an appropriation of 010,000. made to pay for Small Equipment for the Municipal Electric Light & Power Plant . The record of the appropriation in the Con- troller`s Office,or elsewhere, so far as I have been informed,does not disclose whether or not " the -appropriation was made to pay, among other things,for an automobile for the use of the Superintendent of the Light Plant, In the absence of further information as to what the - appropriation included,and what was intent on of Council at the time the appropriation was passed, it was and is my opinion that an auto- mobile costing the slim of 01268 .00 could not reasonably be regarded as "Small Equipment" within the meaning of the appropriation--and there should have been,as a matter of business regularity, a separate appropriation made in the usual way for an item of this kind - especi- ally as .it was for the personal use of an employee of the Plant in the . discharge of his duties and not part of the actual necessary operating machinery of the Plant ;and further because of the unfortunate experi- ence of the last City Administration in connection with just such a matter. However, after having an interview with the 'Superintendent of the Plant , which was delayed several days because of his absence from his office , I learn for the first time the matter of the appropriation for the .new automobile for the Superintendent was considered and in- cluded in the Appropriation .for Small Equipment when the budget was made up in 1922. Mr. Hess,the Superintendent ,gives myself and the City Controller the assurance ,in a communication to the Controller digned by Messrs,Ford,Stegman and Benn, members of the Public Utility Commit- tee of the Council,that the same was included in the appropriation & was so understood at the time the budget was passed. This information, howeve r,did not appear as a matter - of record at the- time the matter was referred to me.The Communication referred to , to the City Controller, is in the ex- act words following; Webster Parry,City Controller, Richmond , Indie.na, May 21, 1923. Whereas, we the undersigned have at the time the budget for the Light Plant was made out ,understood that the Superintendent of the Light Plant was to have a new automobile during the year 1923,and Whereas the appropriation to the acct. of Small Equipment included the probable purchase price for the said automobile,and whereas fut- ther the Controller is in doubt about paying for said car out of the said appropriation for Small Equipment, Therefore we hereby assure the Controller that it was so understood at the time the 1923 budget was made out,and recommend the payment accordingly-. I am inclined to the 'belief that the Board of Accounts may approve the payment of 1268 .00 for the automobile . in question out of the Appropriation for Small 'Equipment and under the circumstances above recited. In order to avoid further conflict in this connection I re- qv est that this communic.ati on •be fi. led with any order the Board may . make with. reference to the aeproval of a bill when the same is pre- sented for the payment. of they said automobile, and suggest that the Controller approve payment of the b:i 11 accordingly. Indiana, approv- ing the agreement by the City of Richmond , Indiana, through its Board of Public Works , and John B., Schnelle, for Compensation 'due • t o said J. B. Schnelle and amount to be paid weekly the sum of 114.03 the same being 55% of his average weekly wages , for a peiod _ not _.exceeding 500 weeks. , and the City Controller, was authorized by • the Board of Public Works to pay to said John B. Schnelle , the sum of 03 /. being the amount due for 160 clays or 2 i •°,�// weeks in full to June 1st, 1923 g $14.03 per week, after veryfying as 'to the correctness of the time with the Street •Commissioner. The Board held a conferance th lot owners in Reeve ston Addition regarding conduit system of lights for that secti on •of the City, the matter was referred to a committee of lost oveners consisting of . Messrs , Howard A. Dill; Raymond Nicholson and •ED.H.Harris , to act in conjunction with the City Attorney, D.C .Hess Sup' t. of Ltght • Plant and Wm. Bailey of the Richmond Home Telephone Co.Co. , • • Claims to the mount of q 24,524 .81 were allowed & approved for payment .
