HomeMy Public PortalAboutResolution 1391RESOLUTION NO. 1391 A RESOLUTION AUTHORIZING THE FILING OF A PETITION TO BECOME A CERTIFIED VILLAGE UNDER THE WILL COUNTY STORMWATER MANAGEMENT ORDINANCE SE IT RESOLVED BY THE PRESIDENT AND BOARD OF THE VILLAGE OF PLAINFIELD AS FOLLOWS: SECTION I: The President and Board hereby request that the County of Will declare the Village of Plainfield to be a "Certified Community" pursuant to Article 11 of the Will County Stormwater Management Ordinance. The Village Administratar is hereby directed and authorized to file a Petition for Certification meeting the requirements of the Will County Stormwater Ordinance. SECTION 2: The President and Board have previously adopted amendments to the Village's Special Flood Hazard Areas, Soil Erosion and Sedimentation Cantral Ordinance, and Starmwater Drainage and Detention Ordinance thereby making these requirements at least as strict as the provisions of the Will County Stormwater Management Ordinance, in order to be declared a Certified Community. This ordinance shall apply to all territory within the Village of Plainfield and its planning jurisdiction situated in Will County. SECTION 3: The President and Boazd hereby authorize and direct the Village Administrator to implement and enforce the substantive requirements of the ordinance amendments adopted pursuant to Section 2 in the same manner as the current Ordinances have been implemented and enforced, including but not limited ta, through the use of the zoning ordinance, the subdivision review and approval process and the building permit and inspection process. The Administrator shall utilize staff and consultant personnel and other personnel that the Administrator may deem reasonably necessary to implement and enforce the stormwater management ordinance and associated regulations. The Administrator is further authorized to prepare and submit to Will County a more detailed plan statement as may be required or requested. SECTION 4: It is hereby declared to be the policy of the Village of Plainfield that all annexation agreements entered into after the effective date of this Resolution affecting territory located in Will County shall contain a requirement that the real property sought to be annexed be made subject to the substantive requirements of the Will County Stormwater Management Ordinance, as amended and adapted by the Village. SECTION S: It is hereby declared to be the policy of the Village of Plainfield that upon certification the Village of Plainfield shall be bound by the rules and procedures of the Will County Starmwater Management Committee by which certification is granted or revoked and county jurisdiction is reasserted over the enforcement of this ordinance within the boundaries of the Village of Plainfield. SECTION G: The Subdivisions and development listed in Exhibit A, having been notified and heard in accordance with Section 802 of the Will County Stormwater Management Ordinance, attached hereto and incorporated herein by reference, are hereby declared to be exempt from the requirements of the amendments referred to in Section 2 and shall instead remain subject to Ordinances in effect prior to these amendna.ents. SECTION 7: This Resolution shall take effect upon this passage.
