RESOLUTION NO. 95-45
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE
VACATING AND ABANDONING A PUBLIC UTILITY EASEMENT BETWEEN LOTS
129 & 130, SIERRA MEADOWS SUBDIVISION
WHEREAS, the Town of Truckee has received a request to vacate and abandon a ten-foot
(10') public utility easement located along a portion of the common property line between Lots 129
and 130 of Unit 3 of the Sierra Meadows Subdivision (APN 19-510-03 and 19-510-04); and
WHEREAS, the Community Development Director has approved, subject to conditions,
the lot line adjustment being processed concurrently with the easement vacation and abandonment;
and
WHEREAS, environmental review has been conducted in accordance with the California
Environmental Quality Act (CEQA) and the CEQA Guidelines and the Town Council has
determined the project is exempt from environmental review in accordance with Section 15061 (b)(3)
of the CEQA Guidelines; and
WHEREAS, said easement has not been used for the purpose for which it was dedicated
or acquired for five consecutive years immediately preceding this proposed vacation and
abandonment;
WHEREAS, the Director of Public Works and the Community Development Director have
reviewed the proposed vacation and abandonment and find the easement is no longer necessary for
public purposes;
WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code, Section
8335, et seq., provides a procedure for summary vacation of easements.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TRUCKEE,
1. Summarily vacates and abandons the ten-foot (10') public utility easement located
along a portion of the common property line between Lots 129 and 130 of Unit 3 of the Sierra
Meadows Subdivision as shown on Exhibit A attached hereto, subject to the following condition:
A ten-foot (10') public utility easement shall be established along the adjusted common
property line of the parcels as shown on Exhibit A attached hereto. The easement shall be
created in accordance with the requirements of the Town Engineer.
2. Declares that from and after the date that this Resolution is recorded, the subject
easement no longer constitutes a public easement;
3. Instructs the Town Clerk to record this Resolution of Vacation of Public Easement,
pursuant to Section 8336 of the Streets and Highways Code, upon compliance with the condition of
approval stated in Paragraph 1.
The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town
of Truckee, held on the 21st day of December, 1995 by Council Member Eagan who moved its
adoption, xvhich motion being duly seconded by Council Member Carpenter was upon roll call
carried and the Resolution adopted by the following vote:
