HomeMy Public PortalAboutr 18-013� of the 19orough of C ar t eret, N. 54 No. 18 -13 Date of Adoptio Jay 18, 2018 APPROVING PROGRESS PAYMENT ESTIMATE NO.7 & CHANGE ORDER #1 IMPROVEMENTS TO THE INTERSECTION OF MINUE STREET AND ROOSEVELT AVENUE WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a contract to Lucas Brothers, Inc. in the amount of $2,564,744.00 for the Improvements to the Intersection of Minue Street and Roosevelt Avenue; and WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has advised the Governing Body that a modification of the contract is reasonable and necessary and has recommended that the aforesaid contract be modified in accordance with Progress Payment Estimate #7 & Change Order #1 (see attached); and WHEREAS, Progress Payment Estimate No. 7 & Change Order #1 include a change in the description of work and/or to decrease quantities to reflect as-built conditions, and to provide for certain supplementary items; and WHEREAS, Change Order #1 provides for a net decrease in the contract price in the amount of $4,993.87, resulting in a revised contract price of $2,559,750.13 including all previously approved change orders; and WHEREAS, the Borough's Consulting Engineer, CUE Associates has advised that the above described changes and/or modifications to the project were unforeseen at the time of the award of the original contract. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: 1. That Progress Payment Estimate No. 7 & Change Order #1 attached hereto and made a part hereof, resulting in a net decrease of $4,993.87 and resulting in a revised contract price of $2,559,750.13 is hereby approved. 2. That the appropriate Borough Officials are hereby authorized to execute Progress Payment Estimate No. 7 & Change Order #1, and issue payment thereon, based upon the recommendation of the Borough Engineer and subject to attorneys review of the maintenance bond. NO. 18 -13 PAG 7 3. A copy of this resolution and a fully executed copy of Progress Payment Estimate No. 7 & Change Order #1 be forwarded to the Borough's Purchasing Department and CME Associates for distribution to Lucas Brothers, Inc. Borough of Carteret, Middlesex County, NJ CME File: HCA00603.01 Dear Mayor and Borough Council: Enclosed for your review and further handling, please find Progress Payment Estimate No. 7 and Change Order No. 1 for the above - referenced project, as approved by this office. This estimate is in the amount of $150,087.00. The estimate is for work completed by Lucas Brothers, Inc. through January 2018, which includes payment for milling and surface course paving, deductions taken for asphalt and fuel price adjustments, and associated work. The project is substantially complete at this time, with minor punchlist work remaining. Change Order No. 1 results in a $4,993.87 decrease in the original contract value from $2,564,744.00 to an adjusted value of $2,559,750.13. Additional items in the Change Order include costs for required electrical installations for the traffic signal as well as the inclusion of pay items which reflect a scope modification to allow for the resurfacing of Roosevelt Avenue and Minue Streets rather than full reconstruction, due to the presence of an existing concrete roadway base. The Middlesex County Office of Engineering has indicated their approval of the enclosed change order items. The change order reflects increases and decreases in original contract quantities required to complete the project. The increases in quantities could not, in our opinion, have reasonably been effectuated by a separately bid contract without unduly disrupting work and imposing adverse consequences on the Borough and will provide an improved level of service to residents.
