HomeMy Public PortalAboutResolution 1254 RESOLUTION NO. 1254 A RESOLUTION AUTHORIZING THE FUNDING OF CERTAIN IlVIPROVEMENTS TO ILLINOIS ROUTE 59 IN THE VILLAGE OF PALINFIELD, WILL COUNTY, ILLINOIS WHEREA5, the Village of Plainfield has entered into an Agreement with the State of Illinois for the improvement of Illinois Route 59, FAP Route 338, known as State Section: 113SB & 113B-R, Village Section 00-00031-00-RP; and WHEREAS, in compliance with the aforementioned Agreement, it is necessary for the Village to appropriate funds to pay its share of the cost of said improvement; NOW, THEREFORE, BE IT RESOVLED, that there is hereby appropriated the sum of $79,170, or so much thereof as may be necessary; from any money now or hereafter allotted to the Village to pay its shaze of the cost of this improvement as provided in the agreement; and BE IT FURTHER RESOLVED, that upon award of the contract far this improvement, the Village will pay to the STATE, in a lump sum from any funds allotted to the Village, an amount equal to 95% of its obligation incurred under this Agreement, and will pay to said STATE the remainder of its obligation (including any nonparticipating costs for FA projects) in a lump sum, upon completion of the project based upon final costs. BE IT FURTHER RESOLVED, that the Village of Plainfield agrees to pass a supplemental resolution to provide necessary fonds for its share of the cost of this improvement if the amount appropriated herein proves to be insufficient to cover said cost. Bureau Chief of Design Enclosures AGREEMENT THIS AGREEMENT entered into this ~_ day of _u A.D. 0o"a by and between the STATE OF ILLINOIS,. acting by an through its DEPARTMENT OF TRANSPORTATION, hereinafter called the STATE, and the Village of Plainfield, County of Will, of the State of Illinois, hereinafter called the VILLAGE. WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is .desirous of improving approximately 945 meters (3,100 lineal feet) of Illinois Route 59 (FAP Route 338, State Section: 113SB & 113B-R, State Job No.: C-91-034-94, State Contract: 82650, Village 5ecti.on: 00-00031-00-RP), by making the following improvements: Reconstructing Illinois Route 59 from north of Lockport Road to south of 143` Street, providing 2-3.3 meters (11 foot) and variable width through traffic lanes in each direction, traffic signals will be modernized at Illinois Route 59 and U.S. Route 30 (North Junction)/Lockport Road, at Illinois Route 126 a left turn lane will be provided on all four legs, on the south leg the northbound and southbound lanes will be 3.3 meters (11 foot) as will be the turn lane, a 3.6 meter (12 foot) median north of Plainfield-Naperville Road, on the north leg there will be 2-3.6 meter (12 foot) through traffic lanes in each direction, a left turn lane will be provided on Illinois Route 59 for eastbound traffic on Plai~eld-Naperville Road. Traffic signals will be modernized at the Illinois Route 59 intersections with Illinois Route 126 and U.S Route 30 (South Junction), traffic signals will be installed at Illinois Route 59 and Plainfield/Naperville Road all with interconnection, the profile of the roadway will be lowered under the EJ&E Railroad, .the EJ&E Railroad bridge (SN: 099-0343) will be reconstructed as a single span steel through girder bridge on reinforced concrete abutments, a new highway bridge will be constructed over the main branch of the DuPage River (SN: 099-0338), a new single span bridge will be provided for the tributary to the DuPage River (SN: 099-4622) ,which is located 122 meters (400 feet) north of the main branch. Illinois Route 59 will remain open to through traffic. A truck detour route will be provided during construction of the bridge designated as northbound Illinois Route S9 to westbound U.S. Route 30 to eastbound 143rd Street to northbound Illinois Route 59 and southbound Illinois Route 59 to westbound 143`d Street to southbound U.S. Route 30 to eastbound U.S. Route 30 to southbound Illinois Route 59. Temporary traffic signals will be installed at the intersections of Illinois Route 59 at 143`d Street and U.S. Route 30 at 143`d Street to facilitate the truck detour movements. A 3.6 meter (12 foot) grassy barrier median will be provided from just south of the new EJ&E Railroad badge to north of the DuPage River Tributary, the 3.6 meter (12 foot) barrier median flazes to a 5.4 meter (18 foot) mountable median at a point approximately 488 meters (1,600 feet) south of 143`d Street, the through lanes in each direction will continue to be 3.6 meters (12 foot) in width, left turn lanes will be provided to the Village Hall on the west side of the highway, 213.3 meters (700 feet) south of 143`d Street, constructing a service road for a future pump ,station, constructing curb and gutter and a storm sewer system for highway drainage, and by performing all other work necessary to complete the improvement in accordance with the approved plans and specifications; and WHEREAS, the VILLAGE is desirous of said. improvement in that same will be of immediate benefit to the VILLAGE residents and permanent in nature; NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE. agrees to make the surveys, obtain all necessary rights of way, if necessary, prepare plans and specifications, receive bids, awazd the contract, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans, specifications, and contract. 2. The STATE also agrees to pay, ar provide for the payment of, all right of way, construction and engineering costs subject to reimbursement by the .VILLAGE as hereinafter stipulated. The STATE agrees to coordinate with the EJ&E Railroad for the adjustment of railroad facilities. 3. The Village's cost shall be determined by multiplying the final quantities times contract unit prices plus 10% for construction engineering and 5% for preliminary engineering. *The VILLAGE'S cost is to be 21.1 percent of the total watermain cost (Estimated at $366,477) for it's upsizing and upgrades. The STATE, as part of the total project cost is assuming the VILLAGE'S cost for watermain relocation because of prior rights. The estimates shown were determined from attached Summary of Quantities Exhibits A and B. The VILLAGE shall receive an allowance for Preliminary Engineering of S% for the design of their watermain relocation (in kind), because of prior rights. 4. The VILLAGE has passed a resolution appropriating sufficient funds to pay its shaze of the cost of this improvement, a copy of which is attached hereto as Exhibit C and made a part hereof. Upon awazd of the contract. for this improvement, the VILLAGE will pay to the Department of Transportation of the State of Illinois in a lump sum, .from any funds allotted to the VILLAGE, an amount equal to 95% of its obligation incurred under this Agreement, and will pay to said Department the remainder of its obligation (including any nonparticipating costs on FA projects) in a lump sum upon completion of the project, based upon final costs. The VILLAGE agrees to pass a supplemental resolution to provide necessary funds for its shaze of the cost of this improvement if the amount appropriated herein proves to be insufficient to cover said cost. S. The VILLAGE has adopted, and will put into effect, prior to the State advertising for the work to be performed hereunder, an ordinance requiring that parking be prohibited along Illinois Route 59 within the limits of this improvement, within the VILLAGE limits, a copy of which is attached hereto as Exhibit D and made a part hereof, and will, in the future, prohibit parking at such locations within, or immediately adjacent to, this improvement, as may be determined by the STATE or be necessary from traffic capacity studies. 6. The VILLAGE has adopted, and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance prohibiting the dischazge of sanitary sewage and industrial waste water .into any storm sewers or drainage facilities constructed as a part of this improvement, a copy of which is attached hereto as Exhibit E and made a part hereof. '~. Prior to the STATE advertising for the work to be performed hereunder, the disposition of encroachments will be cooperatively determined by representatives from the VILLAGE and the STATE. -3- The VILLAGE has adopted, and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance relative. to the disposition of encroachments and. prohibiting in the future ,any new encroachments within the limits of the improvement, a copy of which is attached as Exhibit F and made .apart hereof. $. .The VILLAGE agrees to adopt a resolution or send a letter, prior. to the STATE advertising for the work to be performed _ hereunder, .approving the plans and specifications as prepared. 9. The VILLAGE agrees not to permit driveway entrance openings to be made in the curb as constructed, without the consent of the STATE. 10. The VILLAGE shall exercise its franchise right to cause private utilities to be relocated at na expense to the STATE. 11. The VILLAGE agrees to cause its utilities located on right of way acquired by the STATE or installed within the limits of a raadway after the said roadway 'was taken over for maintenance by the State, to be relocated and/or adjusted at no expense to the STATE. 12. All VILLAGE owned utilities, on STATE right of way within the limits of this improvement, which aze to be relocated/installed under the terms of this Agreement, will be in accordance with the "Accommodation of Utilities on Right of Way of the Illinois State Highway System" (92 Ill. Adm. Code 530). The VILLAGE agrees to obtain from the STATE, an approved permit for the facility, and to abide by all permit conditions associated therewith. 13. Upon completion of the improvement and final field inspection by the STATE, and so long as Illinois Route 59 is used as a STATE highway, the STATE agrees to maintain, or cause to be maintained, the median, the: through traffic lanes, the left turn and right turn lanes, and the curb and gutter or stabilized shoulders and ditches adjacent to those lanes. -4- The STATE will be responsible for the, maintenance of lane .line and median line mazkings. 14. Upon final field inspection of the improvement, the VILLAGE agrees to maintain, or cause to be maintained, those portions of the improvement. which are not maintained by the STATE, including pazking lanes and their adjacent curb and gutter, sidewalks, parkways, guardrails, crosswalk, stopline markings on all effected. highways, and maintenance of the mast arm cross street signing facing VILLAGE maintained streets, VILLAGE owned utilities, including all highway appurtenances thereto, and shall maintain the storm sewers and appurtenances by: Performing those functions necessary to keep the sewer in a serviceable condition, including cleaning sewer lines, inlets, manholes, and catch basins along with the repair or replacement of inlet, manhole and catch basins' frames, grates or lids, plus structural failures to a maximum. length of 12 feet between adjacent manholes. The maintenance, repair, and/or reconstruction of storm sewers constructed as a part of this improvement beyond the aforedescribed responsibilities shall~be that of the STATE. -5- 15. It is further agreed that the signals shall be maintained to the Level of Maintenance shown above. It is understood that Level of Maintenance II exceeds the manual requirements and is prescribed for those signals that the District Engineer, with the concurrence of the -6- Engineer of Operations, determines to require a higher level of service far adequate operations of the highway at those locations. The STATE agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The VILLAGE agrees to pay the entire cost as billed by the local power company. The STATE retains the riglit to control the sequence and timing of the traffic signals. 16. Upon ~ acceptance by the - STATE of the traffic signal work included herein, the responsibility for maintenance and energy outlined above shall become a part of .the Master Agreement executed by the STATE and the VILLAGE on February 23, 1982. 1 ~. It is also understood that the STATE wi11 maintain the "closed loop" interconnection system. 18. If in the future, the STATE adopts a roadway or traffic signal improvement on Illinois Route S9 passing through the new signal installation included herein, which requires modernization or reconstruction to said installation, then the VILLAGE hereby agrees to be financially responsible for its proportionate shaze to modernize or reconstruct said signal installation in conjunction with the STATE's proposed improvement. -7- Obligations of the STATE will cease immediately without penalty or further payment being required if, in any ,fiscal year, the Illinois ,General Assembly' or Federal funding source fails to appropriate or otherwise make available. fiords for this contract.
