RESOLUTION SUPPORTING ASSEMBLY BILL NO. 2728-
INDEMINIFICATION OF VOLUNTEERS OPERATING MUNICIPALLY
OWNED OR LEASED VEHICLES
WHEREAS, Assembly Bill No. 2728 has been released by the Assembly Local
Government and Housing Committee and is being considered by the full Legislature;
and
WHEREAS, Assembly Bill No. 2728 would allow municipalities, by ordinance, to
indemnify a volunteer for his expenses and liabilities resulting from volunteer's
negligent operation of a motor vehicle which is owned or leased by the municipality
except for willful, wanton or grossly negligent acts of commission or omissions; and
WHEREAS, the Borough of Carteret (the "Borough"), as well as most other
Municipalities in New Jersey, utilize the services of many volunteers for services
such as fire fighting, emergency medical care, senior citizen activities and
recreational activities; and
WHEREAS, these volunteers save substantial expenditures by the taxpayers through
their generosity; however, many potential volunteers are reluctant to offer their
services because of concerns of personal liability ;vhen performing these voluntary
services; and
NOW, THEREFORE, BE IT RESOLVED, the Mayor and Council of the Borough
of Carteret, County of Middlesex, state of New Jersey does hereby support the
adoption of Assembly Bill No. 2728 by the State Legislature as a measure to
encourage volunteering ;vithin our Municipality;
BE IT FURTHER RESOLVED, that the Municipal Clerk shall forward a certified
copy of this resolution to Senator Joseph Vitale, Assemblyman John Wisniewski, and
Assemblywoman Arline Friscia and all Middlesex County Municipalities.
Adopted this 12th day of October, 1999
and certified as a tree copy of the original
on October 13, 1999.
