HomeMy Public PortalAboutResolution 1224RESOLUTION NO. 12 2 4 A RESOLUTION IN SUPPORT OF FUNDING AN IMPROVED WILL COUNTY HIGHWAY SYSTEM WHEREAS, the Will County Department of highways has identified forty (40) immediate major capital outlay improvements totaling over one hundred fifteen million dollars ($1 15,000,000) which are needed on the Will County highway system; and WHEREAS, Will County's current highway funding from existing Motor Fuel Tax and other revenue sources is unable to adequately address this immediate need; and WHEREAS, the Will County highway system is ever increasing in its need of rehabilitative and capacity improvements related to increased travel and Will County population; the Will County population having escalated from 357,313 to 444,469 between 1990 and 1997 and is projected to grow to approximately 750,000 by the year 2020; and WHEREAS, the Will County highway system connects Will County municipalities and municipal residents to employment, educational, civic, recreation and other activities and opportunities across Will County and thus has a vital link to the quality of life within each community; and WHEREAS, failure to augment the Will County Department of Highway's future revenue base will result in a declining transportation system for the residents of the entire county; and WHEREAS, the Illinois General Assembly has previously approved the County Motor Fuel Tax Law (SSILCS 5/5-1035.1) which grants authority to the county boards of DuPage, Kane, and McHenry counties to adopt a local motor fuel tax. NOW, THEREFORE, BE IT RESOLVED that the Village of Plainfield is supportive of the expansion of the County Motor Fuel Tax Law to include Will County for the purpose of funding an improved Will County highway system and requests that the Will County Board adopt a resolution in favor of the Illinois General Assembly taking such action to include Will County in the County Motor Fuel Tax Law. BE IT FURTHER RESOLVED that copies of this resolution be distributed to Will County Executive Charles Adelman, Will County Board Public Works Chairman Glenn Warning, local Will County Board members, lacal State Senators and Representatives, and the Will County Governmental League. One action item within that Agenda is a WCGL position in support of Will County Board being granted authority by the Illinois General Assembly to enact a local motor fuel (gas) tax under the County Motor Fuel Tax Law (copy attached). Will County was excluded from the County Motor Fuel Tax Law in 1990 when the Illinois General Assembly created this authority for DuPage, Kane, and McHenry counties. The WCGL has not taken a position on the amount of the tax or on funding priorities. I have been working with Sheldon Latz, Will County Engineer to compile background information on potential revenues generated, existing and unmet county road needs, etc. Included with this memo are the following items: 1. Will County Highway Capital Outlay Improvements (Jan. 1999) 2. Projects for FY 99 Budget 3. Total Expenditure of County Funds on Various Highway Projects (FY 96-98) 4. Will County Engineer's revenue estimate (no Illinois Department of Revenue numbers available) As discussed at our January meeting, your council/board is asked to review this information and consider adapting a supporting resolution (you may use the attached sample resolution). If you or your council/board have any other opinions or ideas regarding a Will County Motor Fuel Tax as presented, please forward those comments in writing to me. The first step is to ask the Will County Board to adopt its own resolution in favor of this authority and then to seek with the Will County Executive and Board the passage of legislation by the Illinois General Assembly during the current spring 1999 session. The refund shall be paid by the State 't'reasurer out of the County Option Motor Fuel Tax Fund. On or before the 26th day of each calendar month, the Department shall prepare and certify to the State Comptroller the 'disburse- ment of stated sums of money to named counties For which taxpayers have paid taxes or penalties hereunder to the Department during the second preceding calendar month. Nothing in this Section shall be construed to authorize a county to impose a tax upon the privilege of engaging in any business which under the Constitution of the United States may not be made the, subject of taxation by this State. An ordinance ar resolution imposing a tax hereunder ar effecting a change in the rate thereof shall be effective vn the first day of the second calendar month next fallowing the month in which the ordinance or resolution is adopted and a certified copy thereof is filed with the Department of Revenue, whexeupon the Department of Revenue shall proceed to administer and cnfazce this Section on behalf of the county as of the effective date of the ordinance er resolution. Upon a change in rate of a tax levied hereunder, ar upon the discontinuance of the tax, the county board of the county shall, nn or not later than 6 days after the effective date of the ordinance nr resolution discontinuing the tax or effecting a change in rate, transmit to the Department of I-isvenue a certified copy ofthe ordinance or resolution effecting the change ar discontinuance. The cost figures are based on 1999 expected cost. Please note that I have included with this program the intersections that should be improved based on the volume of traffic and accidents. I did not include any new bridge construction, because I think they could be handled with the current bridge budget. I have also included for your information the proposed projects for 1999. As you can see, the majority of our current projects are. for the continued routine maintenance. I am enclosing for your comparison for years 1996, 97 and 98. I believe the charts are self- explanatory. I estimated an increase in gas tax on the basis of current auto registration within the county assuming a one (1) cent gas tax per gallon, a income of approximately 3.4 million dollars could be obtained for new construction in the upgrading of the existing County Highway budget. if there are any further questions, please feel free to contact me.
