HomeMy Public PortalAboutResolution 1223 RESOLUTION NO. 1223 A RESOLUTION AUTHORIZING THE PREPARATION OF THE NECESSARY DOCUMENTS AND ORDINANCES FOR AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF PLAINFIELD AND PLAINFIELD CONSOLIDATED SCHOOL DISTRICT 202. NOW, THEREFORE, BE IN RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS: 1. That the Village Attorney and Staff will work diligently and in good faith to execute an intergovernmental agreement between the Village of Plainfield, (Village), and Plainfield Consolidated School District 202, (District), for the mutual purpose of assuring the District it shall have sufficient potable water and sanitary sewer infrastructure available to the new High School by a date no later than July 31, 2001 and that the Village shall not be unduly burdened by the accelerated timetable of infrastructure improvements required by said new High School. 2. That the agreement shall be constructed to commence its timetable upon the District finalizing its purchase of the New High School site and following State Statute requirements for Village required bonds being without possible legal encumbrances. 3. That the site be annexed to the Village and is located within the Village's F.P.A. Upon annexation the District shall grant and/or deed at no cost to the Village, all-necessary easements and Rights-Of--Way asked for on behalf of the Village within 30 days. 4. Both parties acknowledge that time is of the essence; and that accelerated schedules have a premium in costs; and that the goal of this agreement is to keep both at an absolute minimum. 5. The Village and District will present to the Plainfield Township Board a joint resolution requesting from Plainfield Township an behalf of the Village the necessary Easements and Rights-Of--Way, (as determined and engineered by the Village), for the extension of utilities to the New High School Site. 6. That agreement shall incorporate the following Village agreed upon considerations to the District, as not to set a precedent, but to satisfy the requirements of sound intergovernmental cooperation and the mutual consideration of what is fair to each taxing body's tax payers. A. Construction Water -Within 60 days, (May 1, 1999) the Village shall decide to construct or let contracts to construct a 12" water-main from the Whispering Creek/Indian Oaks area to the new High School site within 180 days, (November 1, 1999), of sufficient capacity to meet all masonry construction needs. B. Distriet Needed Construction Documents -The Village shall deliver to the District drawings of all potable water and sanitary water manhole locations, elevations and invert elevations from an agreed upon benchmark, within 30 days fnr the future connection of High School utilities. The Village will indemnify the District for any incorrect invert elevations or errors in Village supplied documentation stamped "Far Construction" and signed by the Village Engineer. C. Potable & Fire Water -The Village shall construct or let contracts to construct water system improvements for the purpose of supplying sufficient water flows to the New High School and be operational within 20 months, (July 31, 2001). Actual needs and method of accomplishing needs will be determined by the Village Engineer within 30 days after said engineer is supplied with the proper "Fire Flow Documentation" by the District's Architect. D. Sanitary Sewer -The Village shall construct or let contracts to construct a sanitary sewer system of sufficient capacity to transport and treat all sanitary waste water from the new High School site to be completed within 28 months, (July 31, 2001). E. Roadway Needs - The Village will waive the normal Developer, (District), required infrastructure improvements in the following manner. At its option the District may: 1. Follow all normal rules and regulations and receive 1/2 recapture. 2. Build 37" B-B roadway entire length, curb, storm and sidewalk on District side only. No recapture. 3. Build full profile roadway with bath curbs and storm water management for 1 /2 length property, sidewalk District side only for entire length. No recapture. F. District Security Interest - The Village and the District will immediately begin negotiations with the City of Joliet and Mirage Developments for TEMPORARY connection to Joliet utility services approximately 1/2 mile away. The Agreement shall be structured a safety valve in case it is deemed by the Village Engineer that the Village ar the District has fallen behind schedule and the new High School opening date is in jeopardy. This agreement would most likely involve an agreement that Joliet would supply water and accept and treat the wastewater from the District. PASSED THIS 2 z DAY OF February , 1999.
