HomeMy Public PortalAboutResolution 1198RESOLUTION NO.,,~8 WHEREAS from time to time a municipality may find that the medical condition of one of its elected officials prohibits that official from personally attending its Board meetings for an extended time period; and WHEREAS it is necessary that municipal business continue to operate with maximum representation and participation by its elected officials; NOW, THEREFORE, BE IT RESOLVED that the Village of Plainfield hereby adopts the following policy and conditions: If an elected official is temporarily disabled in such a manner as to prohibit their personal mobility and they are confined largely to their residence for a period not less than 45 days, then that official may be eligible to partake fully in Village meetings in conformance with the following conditions: A) The Mayor and Board of Trustees shall adopt a Resolution acknowledging that the elected official has been temporarily disabled for no less than 45 days; and, that the disabled official is confined largely to their residence and is unable to exercise sufficient personal mobility to attend meetings. B) The disabled elected official shall affirm in an affidavit supplied by the Village that he has been temporarily disabled for no less than 45 days and anticipates the disability to continue for no less than an additional 6d days. C) The disabled elected official shall affirm that he has routine access to the Village's Cable TV channel within his own residence and is capable of reading and understanding written material. D) The Village shall cause the installation of required telephone/data lines to provide the disabled elected official with necessary communications and continue distribution of all required documents. E) The disabled elected official shall acknowledge his presence at a meeting during that meeting's regular roll call and further state that he/she has visual and auditory access to the meeting being televised and subsequent to the meeting shall sign an affidavit reaffirming his/her vote. F) The Village shall cause such teleconferencing equipment as necessary to be installed at the meeting site to enable the remaining elected officials to hear and understand the audible responses and comments by the disabled elected official. If any technical difficulties occur during the meeting that disrupt effective two way communication to/from the disabled elected official, then that official shall no longer be considered as participating in the meeting nor shall he/she be allowed to vote on subsequent matters. G) All documents and actions of the Boazd of Trustees adopted or enacted at the meeting so attended by the disabled elected official shall reflect the attendance, vote or action of that disabled elected official the same as if that official were present physically at the meeting. I-~ This policy is being adopted by the Village of Plainfield upon reliance of Freedom Oil Co. v. Illinois Pollution Control Board, 211 Ill. Dec. 801, 655 N.E. 22 11$4 (1995). I) At no time shall more than one temporarily disabled elected official be eligible to vote or participate within the terms of this Resolution.. PASSED this 18 day of MaY , 1998.
