AN ORDINANCE OF THE TOWN COMMISSION
OF THE TOWN OF GULF STREAM, PALM
BEACH COUNTY, FLORIDA, AMENDING THE
TOWN CODE OF ORDINANCES AT CHAPTER
66, ZONING, ARTICLE VIII, SUPPLEMENTARY
DISTRICT REGULATIONS, DIVISION 2,
ACCESSORY STRUCTURES AND
RECREATIONAL FACILITIES, SECTION 66-369
— DOCKS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF ORDINANCES IN
CONFLICT; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town of Gulf Stream received an inquiry about building a dock on the property
located at 520 Middle Road; and
WHEREAS, Town staff reviewed the Town Code, which lists 520 Middle Road as Lot 20 of the
Town of Gulf Stream "Gulfstream Cove" Waterfront Footage ASSESSMENT chart ("Chart"),
contained as exhibit B to Section 66-369 of the Gulf Stream Code; and
WHEREAS, Town Staff consulted its planner, who reviewed the Plat of Gulf Stream Cove and
noted that based on the Plat the waterfrontage and angles in degrees of Lot 20 should be identical
to Lot 6 on the Chart, and thought that the current information for Lot 20 was incorrect; and
WHEREAS, this Ordinance corrects this error in the Town Code to allow Lot 20 to have the same
size and other restrictions as contained in the Chart for Lot 6.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF
STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Code of Ordinances of the Town of Gulf Stream is hereby amended at
Chapter 66, Article VIII, Division 2, Section 66-369 — Docks, Exhibit B, as referenced in Section
66-369 (6)(e) in accordance with the following illustration, incorporated as Attachment 1.
Section 2. All other provisions of Section 66-369 not amended in Section 1 above
shall remain intact.
Section 3. Severability.
If any provision of this Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of this Ordinance which can be
given effect without the invalid provisions or applications, and to this end the provisions of this
Ordinance are hereby declared severable.
Section 4. Repeal of Ordinances in Conflict.
All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict
with this or any part of this Ordinance are hereby repealed.
Section 5. Codification.
This Ordinance shall be codified and made a part of the official Code of Ordinances of
the Town of Gulf Stream.
Section 6. Effective Date.
This Ordinance shall take effect immediately upon its passage and adoption, as provided
by law.
