HomeMy Public PortalAbout20-03RESOLUTION NO. ? 0 - 3 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, URGING THE FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION TO ENTER INTO RULEMAKING TO ADOPT AN "IDLE SPEED — NO WAKE" ZONE WITHIN THE INTRACOASTAL WATERWAY SYSTEM FROM GEORGE BUSH BOULEVARD NORTH APPROXIMATELY TWO MILES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town recognizes that Florida Statutes section 327.60 delegates the power to regulate vessels on the Florida Intracoastal Waterway solely to the Florida Fish and Wildlife Conservation Commission; and WHEREAS, the Town Council of the Town of Briny Breezes and the City Commission of the City of Delray Beach, Gulf Stream's neighbors to the north and south, respectively, have requested Idle Speed — No Wake zones along the areas of the Intracoastal Waterway that run along their respective municipalities; and WHEREAS, the establishment of an "Idle Speed — No Wake" zone will decrease the degradation and provide protection to the property owners adjacent to the Intracoastal Waterway; and WHEREAS, the Town urges the Florida Fish and Wildlife Conservation Commission to establish and "Idle Speed — No Wake" zone within the Intracoastal Waterway system from George Bush Boulevard in the south, traveling north approximately two miles to the northern terminus of the municipal boundary of the Town of Gulf Stream parallel to Little Club Road on the east; and WHEREAS, the Town is respectfully requesting that the Florida Fish and Wildlife Conservation Commission enter into Rulemaking to adopt an "Idle Speed — No Wake" zone in the requested zone; and WHEREAS, the Town Commission deems approval of this resolution to be in the best interest of the health, safety, and welfare of the residents and citizens of the Town of Gulf Stream and the public at large. NOW THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The foregoing recitals are hereby affirmed and ratified. Section 2. The Town Commission of the Town of Gulf Stream, Florida hereby urges the Florida Fish and Wildlife Conservation Commission to adopt an "Idle Speed — No Wake" zone within the Intracoastal Waterway system from George Bush Boulevard in the south, traveling north approximately two miles to the northern terminus of the municipal boundary of the Town of Gulf Stream, as depicted in Exhibit "A". Section 3. The Town Clerk is hereby directed to forward copies of this Resolution to the Florida Fish and Wildlife Conservation Commission. Section 4. This Resolution shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED in a regular session assembled this A day of 2020.
