RESOLUTION NO. 1182 A RESOLUTION AUTHORIZING A CHANGE ORDER IN THE CONTRACT BETWEEN THE VILLAGE OF PLAINFIELD AND "D" CONSTRUCTION. WHEREAS, the Village of Plainfield and "D"Construction previously entered into a contract for the construction of improvements on Illinois Street; and WHEREAS, it has been determined that it is in the best interest of the Village to add storm sewer work to the original contract; and WHEREAS, the circumstances necessitating said change were not reasonably foreseeable at the time the contract was executed and said change order is in the best interest of the Village of Plainfield, as authorized by law. NOW THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS AS FOLLOWS: That it is hereby determined that it is in the best interest of the Village of Plainfield to authorize Change Order Na. 1, dated January $, 1998, and that the circumstances necessitating said change were not reasonably foreseeable at the time the contract was executed and that said change order is in the best interest of the Village of Plainfield, as authorized by law. II. The President is hereby authorized to execute said proposed change order, a copy of which is attached hereto and made a part hereof as Exhibit "A", and that a copy of said Resolution and Exhibit shall be preserved in a file regarding said contract which shall be open to the public for inspection pursuant to 720 Illinois Compiled Statutes 5/33E--9. Harvey DATE: January 19, 1998 RE: Change Order for Illinois Street Improvements for $24,432.55 The Illinois Criminal Code, Chapter 720 ILCS 5/33E-9 regarding Change Orders, requires any change order of $10,000.00 or more or changing the time of completion by a total of thirty (30) days or more, must be approved by a determination in writing that circumstances said to necessitate the change in performance were not reasonably foreseeable at the time the contract was signed, or that the change order is in the best interest of the Village of Plainfield and authorized by law, or, the change is germane to the original contract as signed. Said written determination and the change order resulting from that determination shall be preserved in the contract's file which shall be open to the public for inspection. Lincoln Highway Plainfield, II. 60544 Re: Illinois Street Our Project No. 693'5 Dear President and Board: January 8, 1998 Area Code 815 722-3444 Please find enclosed information for Pay Request 1 and Change Order 1, an invoice from the project's general contractor, "D" Construction, in the amount of $71,933.44, a Request for Approval of Change in Plans (Change Order), and a Change Order and Pay Request spreadsheet from our office. Change Order 1 is a $24,432.55 increase. We have observed the Work, agreed to quantities with the Contractor and reviewed the invoice. Work completed under this pay request is storm sewer, pavement repair and overlay. Restoration and electrical work are not included. Change Order 1 consists of: the original contract did not include storm sewer work - at the Village's request it was added; additional concrete patching and curb and gutter removal and replacement was required; and bid quantities were adjusted for in-place quantities. We recommend you approve both Pay Request 1 and Change Order 1. Retainage will be released when the punch .list is completed. The contractor should not be given payment until an affidavit (IDOT Form BC-141) has been received by the Village.
