HomeMy Public PortalAboutResolution 1170RESOLUTION NO. 1170 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF PLAINFIELD AND THE PLAINFIELD TOWNSHIP PARK DISTRICT. WHEREAS, the Park District is concerned with the control of motor vehicle traffic and the enforcement of its ordinances on its property; and WHEREAS, it is the desire of the Park District to have ordinances of the Park District and traffic laws of the State of Illinois regulated and enforced on its property by the PLAINFIELD POLICE DEPARTMENT; and WHEREAS, the Village of Plainfield and the Park District wish to continue the relationship as previously established regarding traffic and ordinance enforcement in its parks; NOW THEREFORE, BE IT RESOLVED that the President and Clerk are hereby authorized to execute the attached Agreement which is attached hereto and made a part hereof as Exhibit A. PASSED THIS 7th DAY OF Ju1v , 1997. c~yc~.~ ~ , Village erk APPROVED THIS 7th DAY OF .7u1v , 1997. ,~"J~~' C~~ ~~ President _ ATTEST: K. ~~ Vilfage CI r OFFICE/PARK-DST.RES EXHIBIT A Page 1 AGREEMENT PROPOSAL July Agreement made this nth day of Jam, 1997, A.D., between the Village of Plainfield, County of Will, State of Illinois, an Illinois Municipal Corporation (hereinafter referred to as "VILLAGE") and the Plainfield Township Park District, a body politic and corporate, County of Will, State of Illinois (hereinafter referred to as "PARK DISTRICT"), pursuant to power granted by Article VII, Section 10, of the Illinois Constitution. WITNESSETH WHEREAS, the Pard District is concerned with the control of motor vehicle traffic and the enforcement of its ordinances on its property; and WHEREAS, it is the desire of the Park District to have ordinances of the Park District and Village of Plainfield and traffic laws of the State of Illinois regulated and enforced on its property by the PLAINEIELD POLICE DEPARTMENT. NOW, THEREFORE, the parties to this agreement, in consideration of the mutual covenants and stipulations set forth herein, agree as follows: ARTICLE 1: The Park District has adopted an Ordinance entitled "An Ordinance Approving and Adopting Park Code" on May ~0, 19$7, which shall be enforced by the Police Department of the Village of Plainfield. ARTICLE 2: The Village shall assign Police Officer(s) who are certified by the Illinois Law Enforcement Training and Standards Board to police parks and/or property owned by the Park District, according to the schedule agreed upon by the parties. This agreement will normally operate from July through June, in accordance with the schedule listed below: MONDAY THROUGH FRIDAY: Van Horn Woods: Close Park gates based on the seasonal hours and make visual check of restrooms, shelters, playgrounds and picnic areas. 15 Minutes SATURDAY/SUNDAY/HOLIDAYS: Van Horn Woods: Open and close park gates based on the seasonal hours and make visual checks of restrooms, shelter, playgrounds and picnic areas. 30 Minutes EXHIBIT A Page 2 SPECIAL PATROLS/ASSIGNMENTS: Officers will be assigned to perform specialized enforcement and/or patrol of parks, events or other activities as requested by the Director of Parks or his/her designate. These patrols may be by squad car, bicycle and/or foot patrol, depending on the needs of the district. 175 Hours EMERGENCY RESPONSES: Respond to all emergencies and/or citizen complaints of incidents occurring within Van Horn Woods and/or other parks within said Village. ARTICLE 3: It is understood by the parties hereto that all salaries, benefits and coverage of and for the members of the Police Department of the Village are to be paid by the Village for services rendered by Police Personnel and the Park District shall in no way be liable therefore. ARTICLE 4: The Village and the Park District shall maintain close liaison pertaining to the work of the Police Department of the Village when governing Van Horn Woods and/or other property owned by the Park District. ARTICLE 5: All Police personnel will work under the orders of the Police Chief of the Village or his designated representative. The Department will provide to the Director of Parks, a monthly activity report. Additionally, a liaison officer will be assigned to work with the Director and/or designate to assist in meeting the goals and objectives of the specialized patrol and/or enforcement program. ARTICLE 6: The Park District agrees to pay the VILLAGE OF PLAINFIELD the sum of $8,787.00 in four (4) equal installments. Said payments shall be for the services rendered per Article 2. The first installment shall be paid on or before August 1, 1997; second shall be on or before November 1, 1997; third on or before February 1, 1998; fourth installment on or before May 1, 1998. EXHIBIT A Page 3 ARTICLE 7: In addition to the services outlined above, special assignments may be required. Such special assignments will be agreed to by the parties. Payment for said services to the Village shall be in addition to the payment made pursuant to Article 6. The Village shall bill the Park District and/or group/organization for services rendered by said special assignment police officer(s)/staff at the following rate: $33.50 -Hourly ARTICLE 8: The Village, through its attorney and normal court date(s), agrees to undertake the prosecution of all ordinances of the Park District. The Village further agrees that the officer(s) issuing said citation(s) shall be in court for the prosecution thereof. Any fines obtained from said prosecution shall be placed in the General Fund of the Vi I lage. ARTICLE 9: That if either party wishes to terminate this agreement prior to the termination date as subsequently set forth, such termination is conditioned upon the withdrawing party sending by Certified Mail, Return Receipt Requested, to the other party at the address set forth below, written notice of such intent at least sixty (60) days prior to withdrawal. ARTICLE 1Q: The term of this agreement shall be for one (1) year from the date thereof. ARTICLE ~ ~: This instrument contains the entire agreement between the parties and no statements, promises or inducements made by either party/or each of either party that is not contained in this agreement may not be enlarged, modified or altered, except in writing and signed by the parties hereto. ARTICLE 12: It is mutually understood and agreed that this agreement shall be governed by Laws of the State of Illinois both as to interpretation and performance. ARTICLE 13: It is understood and agreed by the parties hereto that if any part, term or provision of this contract is by the courts held to be illegal or in conflict with any law of the State of Illinois, the validity of the remaining portion or provisions shall not be affected and the rights and obligations of the parties shall be enforced as if the agreement did not contain the particular part, term or provision held to be invalid. EXHIBIT A Page 4 In witness whereof, the parties have executed this agreement on the day and year first above written pursuant to a resolution or ordinances adopted by the Village Board of the Village of Plainfield, Will County Illinois and the Board of Commissioners of the Plainfield Township Park District, Will County Illinois.
