MEMORIAL STADIUM PHASE I IMPROVEMENTS CONTRACT No. WHEREAS, the Borough has publicly advertised for the receipt of bids for the Walter B. Overholt, Jr. Memorial Stadium Phase I Improvements Project; and WHEREAS, the Borough has solicited and received seven (7) bid proposals for the Walter B. Overholt, Jr. Memorial Stadium Phase I Improvements Project as follows: Total Base A & B Bid 1. Your Way Construction, Inc. $ 1,987,550.75 2. Abraham General Construction $ 1,965,293.75 3. Applied Landscape Technologies, Inc. $ 2,048,630.00 4. Flanagan's Contracting Group, Inc. $ 2,048,999.75 5. Tomco Construction, Inc. $ 2,133,648.50 6. The LandTek Group, Inc. $ 2,135,065.00 7. Roman Asphalt Corp. $ 2,280,107.00 WHEREAS, Abraham General Construction, 39 Condit Terrace, West Orange, NJ 07052 has submitted the lowest bid for said contract as evidenced by the response on file with the Borough's Purchasing Department and with the Borough Engineer; and WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award of a contract to Abraham General Construction, in a total amount not to exceed $1,965,293.75, per attached award letter; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. A total of seven (7) bids were submitted, ranging from an apparent low base bid of $1,707,493.50 by Your Way Construction Inc. to a high base bid of $1,916,643.63 by Roman Asphalt Corp. The Engineer's Estimate for the base bid was $1,701,400.00. Please find enclosed a complete Summary of Bids for the Council's review. As a matter of procedure, our office has contacted Abraham General Construction to discuss their bid. Overholt, Jr. Memorial Stadium — Phase I Improvements Page 2 Based on this information, we recommend the following actions: Award of the contract to the low bidder, Abraham General Construction, 39 Condit Terrace, West Orange, NJ 07052 within 60 calendar days, on a unit price basis in the total amount of $1,965,293.75 for base bid items 1 through 35, Alternate Items A -1 through A -13, and B -1 through B -5 inclusive, as available funding permits. The award should be subject to review and approval by the Borough Attorney, including concurrence to waive the minor irregularities, the review of the bid bond and surety from the low bidder, and submission of the required bonds and insurance certificates for the project. 2. Bids and bid securities of the second and third low bidders, Your Way Construction and Applied Landscape Technologies, Inc., be retained and held open, pending execution of the contract agreement by Abraham General Construction. 3. Return of the bid bonds to the remaining bidders. By copy of this letter, we are requesting the Borough Attorney prepare the necessary Resolution of Award. Upon execution, please have four (4) signed and sealed copies of the resolution forwarded to my office for further execution. We trust this is the information you require at this time.
