RESOLUTION NO. 1149
WAGE RATES FOR WORKERS IN ANY PUBLIC WORKS
VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS
WHEREAS, the State of Illinois has enacted "An. Act regulating
wages of laborers, mechanics and other workers employed in any
public works by the State, County, City or any public body or any
political subdivision or by anyone under contract for public
works", approved June 26, 1941, codified as amended, 820 ILLS 130/1
et seq. (1993), formerly I11. Rev. Stat., Ch. 48, par. 39s-1 et
seq. and;
WHEREAS, the aforesaid Act rrequires that the President and
Board of Trustees of the Village of Plainfield investigate and
ascertain the prevailing rate of wages as defined in said Act far
laborers, mechanics and other workers in the locality of said
Village employed in performing construction of public works, for
said Village of Plainfield.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS:
SECTION 1: To the extent and as required by "An Act
regulating wages of laborers, mechanics and other workers employed
in any public works by State, County, City or any public body or
any political subdivision or by anyone under contract for public
works", approved June 26, 1941, as amended, the general prevailing
rate of wages in this locality far laborers, mechanics and other
workers engaged in construction of public works coming under the
jurisdiction of the Village of Plainfield is hereby ascertained to
be the same as the prevailing rate of wages for construction work
in the Will County area as determined by the Department of Labor of
the State of Illinois as of June 1, 7.996,"x- a copy of that
determination being attached hereto and incorporated herein by
reference. As required by said Act, any and all revisions of the
prevailing rate of wages by the Department of Labor of the State of
Illinois shall supersede the Department's June determination and
apply to any and all public works construction undertaken by the
Village. The definition of any terms appearing in this Resolution
which are also used in aforesaid Act shall be the same as in said
Act.
SECTION 2: Nothing herein contained shall be construed to
apply said general prevailing rate of wages as herein ascertained
to any work or employment except public works construction of the
Village of Plainfield to the extent required by the aforesaid Act.
SECTION 3: The Village of Plainfield Clerk shall publicly
post or keep available for inspection by any interested party in
the main office of this Village this determination of such
prevailing rate of wage. a copy of this determination or of the
current revised determination of prevailing rate of wages then in
effect shall be attached to all contract specifications.
SECTION 4: The Village of Plainfield Clerk shall mail a
copy of this determination to any employer, and to any association
of employers and to any person or association of employees who have
filed their names and addresses, requesting copies of any
determination stating the particular rates and the particular class
of workers whose wages will be affected by such rates.
SECTION 5: The Village of Plainfield Clerk shall promptly
file a certified copy of this Resolution with both the Secretary of
State and the Department of Labor of the State of Illinois.
SECTION 6: The Village of Plainfield Clerk shall cause to
be published in a newspaper of general circulation within the area
a copy of this Resolution, and such publication shall constitute
notice that the determination is effective and that this is the
determination of this public body.

the classifications o! pay set out, the Department will upon being contacted state which neighboring county has such a classilication and
provide such rate, such rate being deemed to exist by ralergnco in this document. Further, if no such neighboring county rate applies to
the teak, the Department shall undertake a special determination, ouch special determination being then deemed to havq existed under this

The governmental organization you direct has the responsibility to establish wage rates annually far
construction projects under your control. By law, this is to occur during the month of June. Ollen the
wage rates established by the Illinois Department of•Labor (IDOL) are automatically adopted by munici-
palities, but there is no legal requirement that your organization do this, and there are several good rea-
sons why it should not.
Landscape industry wage classifications are not recognized in the IDOL rates. And, those rates are not
those that prevail in the landscape industry. What this means is that you, your taxpayers and your con-
tractors spend thousands of unnecessary dollars on landscape projects. The IDOL prevailing wage rate
reflects a misclassification of our work as "laborer" at more than $20 plus more than $4 in fringe benefits.
On March 19, 1993, the U.S. Department of Labor (USDOL) re-established the enclosed landscape
classifications in ten northern Illinois counties based on the results of a lengthy wage survey of building,
residential, heavy and highway projects. These classifications further prove that the rates used by the
State of Illinois are not those that prevail in the industry. In addition, there are in effect bargaining agree-
mentswith both the Production Workers Union and Operating Engineers far landscape work. Today,
everyone faces both budget constraints and greater needs for spending. The Prevailing Wage Act and
Davis-Bacon were established to ensure that the proper wage that prevailed in an industry was paid to
those performing the work. This isn't happening. The IDOL rates are almost two to three times those
set by the USDOL.
We encourage you to exercise your prerogative and responsibility to establish fair and representative
wages rates for your construction projects by using the wages that prevail in the industry. 'vVe know this is
not an easy task and the State is not eager to accept new classifications, i.e., landscape classifications.
But a survey of all landscape work in your area would reveal the rates that prevail in the landscape indus-
try to be far different from those for laborer. This survey process has been successfully tested by a local
governing body (Circuit Court for the 16th Judicial Circuit, Kane County, Gen. No. MR KA ' 84 200). If
