ANY STATUTORY RIGHT TO KNOW (INCLUDING, WITHOUT LIMITATION, ANY

At your request, I have reviewed the plans and documents associated with the
MacDonald Subdivision with regards to its conformance with the Town's development
review application submittal requirements.
Forthe MacDonald Subdivision, the Town's Code of ordinance requires the submittal of
a plat (Section 62 -2), fees (Section 62 -9 and Section 66 -145 (c)(4)), and materials
required bythe Town Manager acting as the Town's planning and building administrator
(Section 66- 145(c)(5)).
In'my December 18, 2012 memorandum regarding this project, I created a list of
documents which would need to be provided in order to confirm compliance with the
Town's Comprehensive Plan, Code of Ordinances, state regulatlons and all applicable
rules and standards.
Below is the list from my December 18, 2012 memorandum and my confirmation in
bold of the submittal (unless provided directlyto the town):
Subdivision Re -Plat Process
1. Application Fee —The Town has confirmed that the application fee was paid.
2. Written and notarized consent of the owner. —The Town has confirmed that the
owner consent was provided.
3. Warranty Deed —The recorded deed was provided.
4. Aerial Location Map —This was provided on the site plan created by William
Wietsma, Architect.
S. A certified boundary survey— Provided by Paul Engle of O'Brien, Sulter &
O'Brien, Inc.
6. Plat Plan -Provided by Paul Engle of O'Brien, Suiter & O'Brien, Inc.
7. A written narrative describing the request and indicate how
the following services will be provided to the site:

11. Provide a statement addressing how the additional dwelling units within the
proposed subdivision addresses the Recreation and Open Space Level of Service
found in the Town's Comprehensive Plan. —No adverse impacts with additional
two dwelling units.
