Special Meeting

MEMBERS OF THE BOARD PRESENT: Mayor Selfridge, W. Sharp, M. Latta, J. Dement,
J. King, G. Ansley. D. Lambert was absent.
OTHERS PRESENT: Village Administrator - J. West, Village Clerk,
V. Kranc, Village Attorney --.T. Harvey.
Mayor Selfridge opened the meeting at 7;00 p.m. with the pledge to the flag.
Roll call was taken, D, Lambert was absent.
Mayor Selfridge stated the purpose of this Special Meeting was to discuss the
Hamilton property.
G. Ansley made a motion to acknowledge receipt of the Plan Commission Report on
the Hamilton case of May 10, 1983. Seconded by J. King. Vate by rail call. Sharp,
aye; Latta, aye; Dement, aye; King, aye; Ansley, aye. 5 ayes, no nays. Mo~.ion
declared carried.
Mayor Selfridge read the Plan Commission report of Case No. 120-510$3FP, a parcel
of property located at the northwest corner of Main and Michigan Streets, which
has been divided into two parcels, one of 5,311.35 sq. ft. on the corner with the
address of 301 Main Street,, and the other a parcel of 5,552.4 sq. ft. with an add-
ress of 904 Michigan Street. The zoning of the entire parcel is B-2. The struc-
ture facing Main Street is used as a day nursery, while the structure facing
Michigan Street is purposed to be used as a beauty salon.
Action Re uested - Charles and Ann Hamilton, petitioners, are the purchases of the
904 Michigan Street property from the owner of the entire parcel, Bob Pottorff.
The parcel was sold to the Hamiltons without being properly subdivided according
to the Village Subdivision Control Ordinance. The deed was recorded and there
exists two separate parcels. The petitioners are requesting final plat approval of
the subdivision.
The Plan Gommissian, after much discussion (mostly about the sewer line for the
Hamilton property, which Village Building Inspector Allan Mauer stated ran through
the Pottorff property), recommended that the Village Board approve the final plat
of subdivision with the condition that Mr. Pottorff gives Mr. & Mrs. Hamilton the
necessary permanent easement for the sewer line. through the property.
Mayor Selfridge called on Attorney James Harvey to tell us where we stand. ~7.
Harvey requested the final plat of survey from the Hamiltons. After reviewing the
final plat, J. Harvey stated - A note on the survey states "an easement for sani-
tary sewer for the benefit of lot one is hereby reserved on, over .arid across lot
two" and "an easement for sanitary sewer for the benefit of lot two is hereby re-
served on, over and across lot one". Mutual easements that would be made as of re-
• cord when this is recorded. The County Clerk has signed stating there are no de-
linquent taxes, both the Hamiltons and Robert Pottorff have signed. The only exe-

cution yet to be made are the signatures of the Chairman of the Plan Commission,
Arlo Simmons, and the Village President.
Mr. Hamilton introduced their surveyor, Dennis Tonnelli, to the Board to answer
any questions. Mr. Tonnelli stated the property was originally recorded in 1835.
M. Latta questioned J. Harvey - rs the easement noted on the plat acceptable for
an easement? J. Harvey - The easement is a general easement. The question is
"is it acceptable tot3~e two owners" and it must be because they have bath signed
it. The easement provides for both property owners to make necessary repairs to
the sanitary sewer when and if necessary. Hamiltons own Lot 1 and Pottorff awns
Lot 2. Mayor Selfridge questioned - If Mr. Pottorff sells Lot 2, will this
easement be on the title to the property? J. Harvey stated -- This easement will
be recorded in the Recorder of Deeds Office and a title search will be done. It
is a permanent easement. J'. Icing questioned if the water service was involved.
?'h.e. Mayor stated that he believes the water service comes off Michigan Street.
M. Latta made a motion to accept this final subdivision plat as requested by the
Hamiltons. Seconded by G. Ansley. Vote by roll call. Sharp, aye; Latta, aye;
Dement, aye; King, aye; Ansley, aye. 5 ayes, no nays. Motion declared carried.
Mayor Selfridge stated the document will be signed.
Meeting adjourned at 7:19 p.m.
