HomeMy Public PortalAboutORD-CC-1981-14ORDINANCE NO.I*81 Whereas, The City of Moab recognizes that manufactured homes on permanent foundations in the City would provide many Moab residents, who are priced out of the conventional housing market, with decent, safe and affordable housing, and Whereas, the National Home Construction and Safety Standards Act of 1974, 42 U.S.C. et. seq. establishes federal mobile homes produced after June 15, 1976 to have federal certification. Said Act preempts any stated regulations regarding the manufacture of mobile homes unless the State regulations are identical to federal regulations; and Whereas, improved construction techniques and materials have made manufac- tured houses on permanent foundations virtually indistinguishable from conven- tionally constructed homes and up to 50 percent (50%) less in cost than conven- tionally constructed houses; now therefore, The City Council of the City of Moab does ordain as follows: The City of Moab hereby allows the placement of manufactured housing on permanent foundations in all zones allowing residential development compatible in appearance to homes in the area; and that Chapter 27 of the revised ordinance of the City of Moab is ammended as follows: ARTICLE II: DEFINITIONS (39) A. A manufactured house is a structure transportable in two (2) or more modules which is built on a permanent chassis and designed to be used as a dwelling with a permanent foundation and footing when connected to the required utilities, and includes the plumbling, heating, air-conditioning and electrical systems contained therein. For the purposes of this ordinance, the definition of a manufactured home shall be construed to include mobile homes that are at least twenty-four feet (24') in body width and thirty-five feet (35') in body length and consists of two or more modules and is attached permanently to an approved foundation and footing, provided the units are manu- factured after June 16, 1976 in accordance with the Standards adopted persuant to the National Manufactured Housing Construction and Safety Standards Act of 1974 and stamped approved by HUD (S 5402-6) and contains the State Insignia of Approval. b. A module is a unit of a manufactured house not less than twelve (12) body feet in width and not less than thirty-five (35) body feet in length. 27-3-27 Manufactured Homes Manufactured homes shall be allowed in all zones allowing residential development provided the unit was manufactured after June 16, 1976 and is appropriately stamped and complies with the following: A. CODE COMPLIANCE 1. All manufactured houses shall possess necessary building permits as required by the Moab Building, Plumbing, Electrical and Mechanical Codes and this Ordinance including those required for site preparation, provision of utilities and the construction of accessory structures; 2. Foundations: A11 manufactured houses to be developed on City lots shall be placed on permanent firm foundations, footings and proper blocking support as approved by the city; 3. Roof Load: This requirement for manufactured homes is 30 PSF roof load; Wind Load is 15 PSF; 4. Site Preparation: Properly graded and sloped compacted to ninety percent (907) maximum relative density; 5. Firm Foundation: May be set on concrete pier and footing, or other method approved by the City of Moab; B. DEVELOPMENT STANDARD Prior to the issuance of a building permit for placement of a manufactured house on a permanent foundation, all such houses must meet the following de— velopment standards: 1. Have exterior siding extending to within six inches (6") of dirt or two inches (2") of concrete and consisting of a conventional dwell— ing type exterior material, finished before occupancy. 2. Have a shingled, pitched roof with eaves. 3. Meet all setback and area requirements of this ordinance; 4. Improved permanent access entrance or exits must be installed according to City Standard, (steps, porch and deck, patios, etc.); 5. They do not violate deed restrictions in the area where the unit is to be located. C. PROCEDURE Any person desiring to place a manufactured house on a permanent foundation within City Limits shall make application for a building permit for that purpose with the Moab City Building Inspector and then shall deliver to the Building Inspector an affidavit to have the manufactured house appurtenance to the real property. Upon completion of the installation of the manufactured house on a permanent foundation, the Building Inspector shall cause the affidavit to be filed with the County Assessor.
