(Special Session. ) The Board of Public Works of the City of Richmond , Indiana, met in Special Session in the office of said Board, Friday, April 18, 1919 at 1:30 o'clock P.M. Tajo` of the members of said Board being present Messrs. Taylor, and Peltz. Absent Mr. Johnson. The following pro- ceedings were had, to-wit:- The Board took up the matter in regard to the Petition of Gates R. Davis, et al. , for the improvement of a highway commencing on the Richmond and Newcastle turnpike at the County Line between the counties of Wayne and Henry, in the state of Indiana, and continu- ing thence in a general south-easterly direction through the towns of Hagerstown and Greensfork to the City of Richmond, and in the City of Richmond continuing along part of North-west Fifth Street, Center Street and North-west Second Street , and terminating on North-west Second Street where the same intersects with Richmond, Avenue, all in Wayne County, Indiana, under provisions of the County Unit Road Law, and adopted the following resolution, to-wit: RESOLUTION. - Whereas, a petition signed by more than fifty (50 ) resident freeholders and voters of Wayne County, Indiana, has been address- ed to the Board of-Commissioners of Wayne County, Indiana, and fil- ed in the office of the Auditor of said Wayne County, Indiana, praying that a certain public highway in said Wayne Township, des- cribed as follows: Beginning at a point on the Richmond and Newcastle Turnpike, - said point being on a line between the counties of Wayne and Henry in the State of Indiana;... said line being approximately two miles west of the Town of Hagerstown ; thence in a southeasterly direct- ion along said turnpike to the west corporate limitsof the Town of Hagerstown; thence east along Main Street in said town to Perry St. thence south along Perry Street to the south end of said street ; thence angling east with said Richmond and Newcastle Pilce and con- tinuing along the same to the west corporate line of the Town of Greensfork; thence east along Pearl Street in said Town to the east corporate limits thereof; thence continuing in a general south- easterly direction along said Richmond and Newcastle Pike to a point where it intersects with the Union Pike ; thence south along the Union Pike to the north corporate line of the City of Richmond; - thence continuing south on Northwest Fifth Street in said City to a point where it. interwects with Center Street ; thence east on Cen- ter Street to northwest Second Street in said City; thence south of said northwest Second Street to where it intersects with Richmond Avenue, said last point being the terminus of said highway. Said highway being in total .length of approximately eighteen (18) miles shall be improved under the provisions of the County Unit Road Law by grading, draining, changing and widening said highway where necessary, and paving the same with concrete ; And , Whereas, A part of said highway is within the corporate limits of the City of Richmond, and the said Board of Commissioners has no authority to improve the same in so much thereof as is within the corporate boundariesof said city without the consent being first obtained from the Board of Works of said City so to do; 300 - . Friday, April 18 , 1919. Therefore b.e .it resolved by the Board of Works of the City of Richmond that consent , authority and permission is hereby giv- en to the Board of Commissioners of Wayne County, Indiana, to im- prove that part of said highway petitioned for within the corpora ate limits of .said City of Richmond, the same to be done as pe- titioned for, or as finally ordered by, said Board of Commission ere, provided, howerver, that the established width and grade of - said highway inside of said city shall be in conformity with the width and grade of the streets forming a part of said high- way as already established. Be it further resolved that a certified copy of this Reso- lution be prepared by the Clerk of the said City of Richmond andI/ filed in the office of the County Auditor of Wayne County, Ind. .,T. C. Sell , et al. , for the improvement of a highway commencing at the intersectiioh. of the Commons Road with West Fifth Street in the City of Richmond, Indiana; thence west along the Commons Road to East Haven Avenue; thence north along East Haven Avenue to the tracks of the P. C. C. & St. L. Railroad Company. All in Wayne - County, Indiana, under the provisions of the County Unit Road Law, - and adopted the following resolution to-wit:- . R E S O L U T I 0 N. Whereas, A petition signed by more than fifty ( 50) resident freeholders and voters of Wayne County, Indiana, has been address- ed to the Board of Commissioners of Wayne County„ Indiana, and - filed in the office of the Auditor of said Wayne County, Indiana, praying that a certain public highway in said Wayne Township, described as follows: Beginning at the intersection of Northwest Fifth Street and - the Commons Road in the City of Richmond, Indiana, and thence west along the Commons Road a distance of approximately one mile to the point where the Commons Road intersects with East Haven Ave. - in Wayne Township, Wayne County, Indiana; thence north along . East Haven Avenue a distance of approximately a quarter of a mile to the tracks of the P. C. C. & St. L. Railway Company, where said tracks are immediately south of the Eastern Indiana Hospital for the Insane , part of said highway being in the City of Rich- - mond, part in Wayne Township, and all in Wayne County, Indiana, and said highway being in its total length approximately one and one-fourth ( 1-1/4) miles; shall beimproved under the provisions 111 of the County Unit Road Law by grading, draining, changing and widening said highway where necessary, and paving the same with concrete ; And, Whereas, A part of said highway is within the corporate limits of the. City a Richmond, and the said Board of Commission ere has no authority to improve the same in so much thereof as is within the corporate boundaries of said city without the consent being first obtained from the Board, of Works of said city so to do; Friday, April 18 , 1919. : 301 Therefore be. it resolved by the Board of Works of the City of Richmond that consent , authority and permission is hereby given to the Board of Commissioners of Wayne County, Indiana, to improve that part of said highway- petitioned for within the cor- - porate limits of said City of Richmond, the same to be done as - petitioned. for, or as finally ordered by said Board of Commission ers, provided, however, that the established width and grade of said highway inside of said city shall be inconformity with. the width and grade of the streets forming a part of said highway as already established. Be it further resolved that a certified copy of this Resolu- tion be prepared by the Clerk of the said City of Richmond and - filed in the office of the County Auditior of Wayne County, Ynd. T. C .
