Donahue Geschke - Treasurer Mayor Latta opened the meeting at 7:30 p.m. with the pledge to the flag. Roll call was taken, with all Board Members present. W. Sharp moved to approve the New/Old Section of the Agenda with the additions/corrections: Old Business - Executive Session on litigation, to reconvene, New Business Wi11 County Municipal League meeting; remove ~k7 Nutrition Program/Carolyn Baker (to be placed on the 12/15/86 agenda); move American Legion up on Agenda (at beginning of New Business). Seconded by J. Bootz. Voice vote. 6 yes, 0 no. Motion carried. Mayor Latta read the Consent Agenda. J. Dement moved to approve the Consent Agenda (includi.ng minutes of the. meetings of 11/3/86 and 11/17/86). Seconded by J. Bootz. Voice vote. 6 yes, 0 no. Motion carried. Mayox Latta read the notice of the monthly meeting of W~11 County Municipal League, Thursday, December 1_l, 1986 at Frankfurter Hofbrau in Frankfort, Illinois. George Madden/American Legion Marine Post No. 13 spoke to the Board in regard to the flags and banners on the light poles in the downtown area. Mr. Madden expressed his concern of the banners placed on the light poles above the American Flag. He quoted from the rules of the flag .code for flying the American Flacc. This code was passed by the Congress of the United States: - When flags of states, cities or pennant of societies are flown on the same halyard with the flag of the United States of America, the latter should always be at the peak. PLAZNFIELD VILLAGE BOARD OF TRUSTEES December 1, 1986 Page Two Mr. Madden suggested the banners be Lowered and the flag brackets moved above the banner brackets, not to interfere with. the banners. The committee from the Legion attending the meeting were Mr. George Madden, Mr. Ron Carey and Mr. Ralph Stockton. After much more discussion, it was the consensus of the Board that the Street Department and W. Sharp will check into the problem and see that the American flags are raised above the banners. The Village will contact Mr. Curtis Smith Fern Drive/American Legion before moving the flags or banners and the Village, Commerce Association and the Legion will work together to solve this problem. Mark Pusinelli spoke in regard to the cost estimates from Walter E. Deuchler, Inc. for the construction of the Municipal Compliance Plan Project. Each Board Member received a copy of these estimates dated November 10, 1986. The estimated cost of construction for items to achieve compliance for the Illinois EPA are summarized in the "To Achieve Compliance" column. Staff has prioritized additional items which, funds permitting, should be included in the Municipal Compliance Plan project. These additional items are as follows: (a) Center Walkway for Chlorine Contact Tank Item B.1. (b) Parshall Flume - Remote Indicator, Recorder & Totalizer - Item B/2. (c) Chlorine Building - Items E.1 thru E.6. (d) Protective Berm - Item G. Staff recommends that the President and Board of Trustees direct Walter E. Deuchler Associates, Inc. to compile plans and specifications for the Municipal Compliance Plan project. Such plans and specifications would include all items necessary "To Achieve Compliance" plus items (a), (b), (c) and (d) as listed above. J. Dement stated he feels the "Chlorine Walkway" is very necessary. But the "Parshall Flume Remote Indicator" is new and he was not aware this was going to be included. He feels this should be looked into more thoroughly before we commit ourselves to $26,900 plus $5,600 for the totalizer. He would like to be sure that particular item is a workable solution to the problem. He has a concern if this is the cheapest and the most reliable way to do what we want to do and at this stage he is not sure it is true. He is not sure "B" (in the report) the room that is lacking and the laboratory is needed. He feels if the building is not safe, it should be made safe with sensing devices or patching cracks, that should be done. At this time, he feels we should not engineer for new chlorine building. He feels we should do further engineering • before we go with a new building. We are looking at a total of $53,000 far an 8' x 10' chlorine building. Item "D" -- we have discussed this with the engineer and the staff and he is in FLAINFIELD VILLAGE BOARD OF TRUSTEES December 1, 1986 Page Three agreement with the "Protective Berm". He recommends adding on "A-Roads and Walks" and "D-Protective Berm" and the Superintendent and Staff do more research on the Parshall Flume and wait on the engineering for the chlorine tank, we might be able to incorporate that with other strucf.ures that might go in at the sewer plant in the future. M. Fusinelli stated J. Dement has made good points but his recommendation is to have the plans. and specs done, go out for bids and if the bids come in too high, we can decide not to do those items with the project. From a cost standpoint, if we do decide to do these items, it would be more cost effective to have the engineering done now. W. Sharp questioned if it is desirable to have the chlorine building separate from other buildings. J. Dement stated, whether it is a radio active material ar noxious gas,. it is advantageous to have it separate. K. Callahan questioned H. Countryman to describe a Parshall Flume. H. Countryman stated a Parshall Flume would give us a total flow at all times and much less maintenance. The calibration can be done by staff instead, of getting factory people out to calibrate it for us. K. Callahan questioned • how does E.P.A. view the reading of our flow? H. Countryman stated they would like to have a total flow picture. J. Dement stated he would like this research done to find out if this device is the better way., J. Bootz questioned if we need the additional building? He was of the understanding that to install the new equipment, they did not have adequate space in the existing building. If we fix the leaks and install an alarm system far chlorine leaks, is there adequate space? H. Countryman stated the need if the new building was to separate the chlorine room completely from the lab area, for safety reasons. J. Peterson questioned the value of the equipment in the lab building? H. Countryman stated approxi- mately $7,000.00 plus the electrical panels. J. Peterson stated a seepage through that wall could be determined in terms of a chemical reaction to our equipment in the lab. H. Countryman agreed. M. Fusinelli stated that was essentially the reason a separate building was proposed. J. Bootz stated the reason for a separate building was for a safety factor for both people and equipment. K. Callahan moved to direct Deuchler Associates to compile the plans and specifications for Municipal Compliance Flan Project to include all the items necessary to achieve compliance plus items (a), (b), (c) and (d) as listed in Deuchler's Estimated Cost Summary with the understanding we . could remove items (b) and (c). Donahue wi11 make phone calls for more information on Parshall Flume Remote Indicator Recorder & Totalizer for the Workshop, December 8, 1986. M. Pusinelli stated all Board Members have received a copy of the proposed Radium Variance Petition dated "November 2S, 1986". This copy contains the following changes from the previous copy: (a) Page 6 - correction of typographical error: USEPA (b) page 18 - addition of item #47 (c) addition of Exhibit 5 Staff recommends that the following steps be authorized by the Presi dent and .Board of Trustees: (1.) Completion of the testing results section on Page 7. These results have not yet been received by the Village. (2) Direct the Village Attorney to review the attached Petition. The Attorney would review it with regard to (a) its content and (b) necessary steps to be undertaken by the Village during the petition submittal process. (3) Direct the Village Engineer to sign this Petition.. (4) Authorize the Village President to execute this Petition and submit it to the Illinois Environmental Protection Agency contingent upon no substantial changes being made to Section 30 (A) thru and including 30 (L). This Section contains the. basis of the Peition. The Attorney may find parts of this Petition which need to be altered in some minor way. However, the staff seeks the authority to submit this Petition to the Illinois E.P.A. if no changes are made which would alter the philosophy stated in Section 30 (A) thru and including 30(L), (found on pages 11, 12 & l3 which is the meat of the Variance). The idea is, if the Village Attorney reviews it and approves it and getting the procedure done with the IEPA there would be no reason to return to the Board as long as section 30 - pages ll, 12 & 13 are intack, that is essentially what we are asking for, we believe it is in final form. D. Gullicksen stated he has lots of problems with this variance. It appears we are sending a blank check to the State. tiae would be telling the State to fill in the numbers and good old Plainfield wi11 have to find the money to comply with this thing and he does not think we • know what we are getting into. We don't know enough about the variance. J. Dement stated he, K. Callahan, M. Pusinelli and H. Countryman met with the Engineers to get an estimate. If we get a variance for five (5) years, haw much will it cost us to get this completed? The Egnineer was very vague. He gave us two (2) million on up. J. Bootz questioned if we gave this • C7 PLAINFIELD VILLAGE BOARD OF TRUSTEES December 1, 1986 Page Five to the attorney for review, submit the variance, are we bound by it until it comes back and we review it again, and that gives the engineers three (3) to six (6) months to come up with some cost numbers. Mayor Latta stated if we don't get a variance, we can never extend another water main in the Village. M. Psuinelli stated if the IEPA told him, if the Village decides not to sign the order, it is as if we have never applied for our radium variance. After mare discussion --- K. Callanan moved to go with the Staff recommendation of (1) through (4) for the Radium Variance Petition dated November 26, 1986. Seconded by J. Peterson. Vote by roll ca11. Gullicksen, no; Bootz, yes; Peterson, yes; Dement, no; Sharp, yes; Callanan, yes. 4 yes, 2 no. Motion carried. M. Pusinelli reported on the new telephone system. The staff recommends we go with the Centrex System and that the Village approve a seven year monthly line rental rate of $20.26/month/ line for the Centrex System. Motion carried. W. Sharp moved the staff's recommendation to go with the Centrex Telephone System as stated in the memo dated November 17,.1986. Seconded by D. Gullicksen. Vote by roll call. Gullicksen, yes; Bootz, abstain; Peterson, yes; Dement, yes; Sharp, yes; Callanan, yes. 5 yes, 1 abstention. Chief Bennett presented quotes from four (4) auto dealers for purposed purchase of a new squad car. The following are those quotes: 1. Biggers Chevrolet, Inc. 1385 E. Joliet Road Plainfield, IL 60544 19$7 Chevrolet Caprice (State of Illinois Bid) $11,059.33 1987 Dodge Diplomat .$11,595.00 1987 Dodge Diplomat $11,867.00 1987 Ford Crown Victoria $12,554.00 After reviewing these quotes, staff would recommend waiving formal bidding and accept the price quote of Rod Baker Ford for a 1987 Ford Crown Victoria for $12,554.00, and trade in our two (2) 1984 Fords for $800.00 each, making the actual expediture $10,954.00 which is within the expenditures budgeted for that line item of $11,500.00. Baker Ford, with a trade in of our two (2) 1985 Fords, @ $800.00 each, making the actual expenditure of $10,95.00 for a 1987 Ford Crown Victoria. Seconded by J. Bootz. Vote by roll call. Gullicksen, yes; Bootz, yes; Peterson, yes; Dement, yes; Sharp, yes; Callahan, yes. 6 yes, 0 no. Motion carried. M. Pusinelli reported the Village is a member of Southwest Agency for Risk Management (SWARM) o~f which he is a member of the SWARM Board, representing the Village of Plainfield. (Until October 7, 1986, SWARM possessed Errors and Omissions (E & O) insurance coverage for its Board members. The E & 0 coverage expired on October 7, 19$6. This coverage provided protection for SWARM Board members froze damages stemming from an error, act, omission, etc. which may occur during performance of their duties.) This resolution would indemnify him in his actions as a member of the SWARM Board (per J. Harvey). . J. Peterson moved to adopt Resolution No. 870 (the Board agrees to indemnify and protect our SWARM Board member). Seconded by W. Sharp. Vote by roll ca1.1. Gullicksen, yes; Bootz, yes; Peterson, yes Dement, yes; Sharp, yes; Callanan, yes. 6 yes, 0 no. Motion carried. D. Gullicksen introduced the return of the Fart. Otter Case #152-92486V. This was referred back to the Plan Commission for "'finding of facts". He stated we have minutes from 1.979 case of which they approved a 3 foot variance. Mayor Latta stated that approval was for a separate building, not attached to the house. D. Gullicksen stated he could see no difference and made a motion to grant Mr. Otto his 3 foot variance. Seconded by J. Dement. J. Peterson questioned what bearing the 1979 case would have on this case? Attorney Harvey stated it is informational purposes. It was a finding by the Zoning Board at that tune, it was approved and an ordinance was passed. This Board can consider these records but it doesn't have to make the same decision, it's entirely up to this Board as to the decision you wish to make. He stated he is not telling the Board to disregard this record but it's up to this Board as to how much weight they want to give to it. This is a separate petition. Mayor Latta stated there is a motion on the floor but would Mr. Otto like to speak in regards to his case? Mr. Otto stated he had no further comments. W. Sharp stated he has concern of the safety aspects because a~ gr.ly_ 15' laetween the two (2) buildings, such as in case o~ a fire. One of the reasons for setbacks are for safety purposes besides the look of the neighborhood. PLAINFIELD VILLAGE BOARD OF TRUSTEES December 1, 19$6 Page Seven D. Gullicksen moved to grant a 3 foot sideyard variance to Mr. Otto to construct a one (1) car garage attached to the house. Seconded by J. Dement. Vote by roll call. Gullicksen, yes; Bootz, no; Peterson, no; Dement, yes; Sharp, no; Callanan, no. 2 yes, 4 no. Motion denied. Mr. Otto questioned what the Village plans on doing about his property being zoned I-1. Attorney Harvey agreed the Board could publish for a public hearing after receiving descriptions of all the properties in that area that is primarily residential but zoned I-l and it could be rezoned to Residence A. D. Gullicksen introduced the return of the Leonard Kubinski Case 150-819862.. The recommendation of the Plan Commission by a vote of 4-2 recommends to the Village Board that kennels be authorized in the Village by special use only, and that only in industrial districts. D. Gullicksen requested J. Harvey explain where we are in this case. Attorney Harvey stated he had attended the Plan Commission Hearing in question. The issue came to the Plan Commission and then to the Board with the request from Residence A to B 4 that was unanimously rejected at both levels. It was sent to the Plan Commission level to determine if in effect there is a place for kennels, if there is a zoning classification far kennels in the current zoning ordinance and there was none. Two members of the Plan Commission did not think there was a classification or a place in the present ordinance for it, so they didn't think there should be any necessity for drafting an ordinance. Four members thought that various other ordinances should be looked at and a draft ordinance should be prepared which would possibly allow kennel type operations in industrial districts, which would be issued under a special use class- ification. To view this kind of an issue, should it be allowed at all for any parcel in any part o£ the Village, this Board determines if kennels should be allowed. Mr. Kubinski questioned about B-4 zoning. Attorney Harvey stated in your application you stated you were going to train and storing of animals. In our B-~ zoning, our ordinance applies to animal hospitals. J. Peterson stated he would like to see a written description of kennels in whatever zoned with a special use in industrial district as recommended to us by the Plan Commission but the special use should be defined by the Planner. Seconded by W. Sharp. J. Dement questioned if they would still be interested if they were required to have the dogs in a enclosed soundproof building with no noise or smell. Mr. Kubinski stated he was. After much more discussion- Mayor Latta stated the motion has been made and seconded not to permit kennels in the Village of Plainfield. Vote by roll call. Gullicksen, yes; Bootz, no; Peterson, no; Dement, no; Sharp, yes; Callanan, withdraw. 2 yes, 3 no, 1 withdraw. Motion denied. J. Peterson moved the Board direct the Planner to draft an: ordinance authorizing kennels in the Village by special use only in industrial district only in cooperation with the Plan Commission. Seconded by J. Bootz. Gullicksen, yes; Bootz, yes; Peterson, yes; Dement, yes; Sharp, yes; Callanan, withdraw. 5,yes, 1 withdraw. Motion carried. J. Motion carried. M. Pusinelli stated in reference to Christmas bonuses for Vil7.age employees that are full-time employees are being proposed and part-time are not. The dollar amount is the same as last year. W. Sharp stated he cannot see not to pay part-time people. J. Dement stated we should leave it up to the Administrator. He knows the working staff better than we do. He stated some of the part-time also deserve a bonus for their contribution also. J. Peterson moved to give full--time employees $30.00 and part--time salaried employees $20.00 Christmas bonuses. Seconded by D. Gullicksen. Vote by roll call. Attorney Harvey stated the resolution in question would provide that when a local liquor hearing is held, the review of any Appellate .decision would be based on a review solely of the local Commissioner's record., Without such a Resplution, any appeal of a local commissioner's decision would require a new trial at the Appellate level.
