RESOLUTION NO. 4-2023
A RESOLUTION INCORPORATING A TERRITORY
INTO THE RICH MOND SANITARY DISTRICT
WFIEREAS, Indiana Law pursuant to I.C. 36-9-25-14 allows a Sanitary District, by
resolution, to incorporate new territory into its District upon request by a
petition (lithe owners of un platted land outside the boundaries of a
municipality, if the unplatted land is in the same county; and
WffEREAS, there exist a certain territory on I lenley Road in Wayne County currently
contiguous to the boundaries of the City of Richmond and the Richmond.
Sanitary District; and
WHEREAS, The Richmond Sanitary District has received a request, singed and certified
as correct by the landowners of such territory, Melissa J. Powell and April J.
Jones, to incorporate such territory into the Richmond Sanitary District. Such.
petition is attached to and incorporated in this petition as Exhibit "C" hereto;
and
WITERE,AS, the territory sought to he incorporated includes the 1-billowing, to-wit:
(a) A parcel (1 65 foot x 165 foot) containing 0.625 acres located on the south
west corner of the intersection of Henley Road and South Street in
Wayne County Indiana, which property is more specifically described on
Exhibit"1.3" (Annexation Plat) and Tract IV Exhibit "A" (L,and
Description) attached hereto and incorporated herein by reference; and
WHEREAS, such territory is capable of connection to existing facilities of the Richmond
Sanitary District; and
'WHEREAS, it is in the best interest of the property owners of such area and the Richmond
Sanitary District for such an area to be incorporated into the District territory
and jurisdiction .for the Richmond Sanitary District.
NOW, ITIEREFORE, be it resolved by the Board of Sanitary Commissioners of the
Richmond Sanitary District that:
