Net Pen Rearing -Update
Muir site approved for two(2) net pens by City Council.
Piers to be driven this fall with decking scheduled for June 1, 1991
Bill Onweiller - People powered path around Payette Lake
Dr. Allen moved to recommend to the City that it support in concept a
bike/walking path through town to connect with the round the lake
plan. In addition, it was recommended that the City acquire through
use(snow removal), an eight(8) foot corridor on both sides of the road
from Shore Lodge to City limits on Warren Wagon Road. Both
recommendations are consistent with the Parks and Recreation Long Term
Plan.

Park Use Policy
Committee asked staff to attach a copy of Boise's Park Use Policy to
the minutes(Article "A"), and keep a copy of Coeur D' Alene's Policy
on hand at City Hall for any member who wishes to look at it. The
City Administrator hopes to have a rough draft of a Park Use Policy by
our next meeting.
Golf Course Old Clubhouse Site
Dr. Allen moved to recommend that City Council;
1. Establish definite boundary lines.
2. Discover approximate accessed value of the property.
3. Do nothing to create a cost at this time.
4. Old clubhouse building should be removed and any profits put
into the park fund.
Second by Allen Muller, unanimously passed.
Idaho Land and Water Conservation Fund Grant
Allen Muller moved to recommend to City Council to have Belts and
Associates prepare a proposal to connect Gentry Parcel to Mill Park
for LWCF and present it to the Committee for review.
Second by Dean Martens, unanimously passed.
Dean Marten moved to recommend City Council have staff prepare a
written accounting as to bond money dollars available and spent. In
addition the written accounting of bond money is to be updated and
handed out at the beginning of each monthly Parks and Recreation
Committee meeting so informed decisions can be made.
Second by Allen Muller, unanimously passed.
Lake Front Park Name
Dr. Allen moved to recommend City Council to authorize a name the park
contest with the Parks and Recreation Advisory Committee as judges.
Second by Allen Muller, unanimously passed.
Recreation Director Report -Craig Baker
1. New Basketball Court has been receiving a lot of use. Lighting of
the entire complex would be very beneficial.
2. Adult Volleyball and Basketball programs are now in full swing.
City Administrator Report
1. Boat Trailer Parking - Committee was advised of $20,000 remaining
in Waterway's Grant that must be used before June 1, 1991 or
remitted.
2. Gentry parcel closed. Now owned by the City.
Sports Marina and Crane
Dr. Allen moved to recommend that City Council investigate the legal
aspects of the Marina lease. Dr. Allen also recommend that City
Council have the crane removed from the water this fall as to not set
a precedent of allowing the view to be blocked.

`A RESOLUTION APPROVING AND AUTHORIZING THE IMPLEMENTATION OF
PARK SYSTEM USE PERMIT POLICIES PROMULGATED BY THE BOISE
CITY PARKS DEPARTMENT GOVERNING THE USE OF BOISE CITY PARKS;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Boise City Parks Department has promulgated
park system use permit policies governing the use of Boise
City Parks; and
WHEREAS, the Board of Park Commissioners has reviewed
these policies and recommends their approval; and
WHEREAS, the Boise City Council at its regular meeting
/ August, 1981, accepted the recommendation of the Board
Park Commissioners and approved and authorized the imple-
mentation of the policies promulgated by the Boise City
Parks Department governing the use of Boise City Parks.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COUNCIL

promulgated by the Boise City Parks Department governing the
use of Boise City Parks, a copy of which, marked Exhibit
"A", is attached hereto and incorporated herein by reference

authorized.
Section 2. That this Resolution shall be in full
orce and effect immediately upon its adoption and approval.

PARK SYSTEM USE/IMPACT PERMIT POLICIES
LEISURE USE PERMITS
1.0 OBJECTIUE
The purpose of the Park Department's Use/Impact Permit Policy is,
in accord with the Boise City Code, to provide opportunities for
the maximum use of parks and reserves with minimizing of use conflicts
by the citizens of Boise in a manner and under conditions which leaves
these areas unimpaired. To provide for the greatest extent of public
utilization without user conflict and park damage, activities requiring
a reserved area and/or attract public participation in a park require
a Park Department permit.
2.0 ORGANIZATIONS AFFECTED
2.1 Park Department
2.2 Park patrons of organized groups requesting use of park facilities
to attract public participation and other park patrons requesting
outdoor facility reservations.
3.0 CONDITIONS
The following standards and conditions shall govern the Department
in evaluating requests for permits.
3.1 The size of the park proposed for use, its carrying capacity,
the parks special facilities and the purpose for which it is
generally used. Park capacity standards state maximums.
3.2 The projected attendance or participation of the proposed use
shall not exceed the park capacity standards.
3.3 The impact the proposed use will have on the park grounds,
facilities and regularly scheduled and informal activities.
3.4 The location of the park within the community, the anticipated
parking requirements and the impact the proposed activity will
have on adjacent property.
3.5 The past performance of the permit applicant(s) with respect
to park property protection and adherence to park and City
regulations.
3.6 Any or all of the above conditions shall be factors in determining
whether a permit is issued and if optional requirements are mandated.
4.0 PERMIT PROCESSING
Permits may be mailed or presented in person to the Park Department
office, 1104 Royal Boulevard.
4.1 Permit requests must be received at least ten calendar days
prior to the proposed event. Fees, when required, shall be
paid in full five calendar days prior to permit day. All
permit requests shall include name(s) of sponsoring party(ies),
date and hours of the event, the purpose of the event and name
of individual responsible for the event. Permit request must
also include brief description of the event and park or park
area proposed for use.
4.2 Under the conditions established in section 3 of this policy,
the department staff shall evaluate the proposed event to
determine the department's burden in maintaining and policing
the park facility and adjacent streets, assuring orderly audience
behavior and sustaining the normal park and neighborhood tranquility.

Park schedule -calendar shall be checked to avoid use conflicts.
A permit may be denied, may be authorized on another date,
authorized in another park or park area or may be authorized
with optional requirements to lessen the use -impact burden.
4.3 The department shall complete all review action on a permit
application on or before the third day after the permit is
submitted.
4.4 The department shall process all permits without discrimination
with regard to race, color, religion, ancestry, sex or age of
the permit applicant(s).
5.0 APPLICANT RESPONSIBILITIES
The applicant will be informed of those requirements applicable to
the event being permitted. A charge will be made for department
staff time associated with certain requirements.
5.1 When satisfactory trash disposal containers or sanitary facilities
are not available in the park, the department may require event
sponsors to pay the costs of and/or provide chemical toilet units
and/or garbage containers. The designation of a cleanup committee
or other appropriate conditions to ensure that general public
enjoyment of park properties may also be required.
5.2 Admission fees to permitted events may be charged only in
controlled access facilities.
5.3 The projected noise volume of the event permitted shall not
exceed 62 decibel at 20 feet, with the exception of events at
the band shell. The band shell is the only authorized park
location for amplified music which shall be limited to 62 decibel
at 600 feet.
5.4 Large attendance may require the presence of law enforcement
personnel, the cost of which is to be paid by the applicant.
Crowd control must be handled by Boise City Police, traffic and
other types of control may be provided by volunteers, security
personnel or other. Traffic control officers and/or other
traffic control devices may be required by the department at
the cost of the applicant.
5.5 Sponsors (commercial and other) and applicants for an event
shall not manually distribute any form of advertising or
information including but not limited to flyers, handbills,
flags, banners, bulletins, pennants or other prepared or
manufactured items identifying sponsor interests. Under
certain conditions arranged with the Park Department, non-
product/commercial programs and information sheets may be
passively_ distributed.
Logos, mascots and animated characatures identifying commercial
products may be allowed by a special permit. Signs with sponsor
identification are to be limited to items directly concerned
with conducting the specific permitted event and may he affixed
only to specified facilities.
5.6 Performance bond, impact fees and other charges may be the
responsibility of the applicant. See sections 7 and 8 of
this policy for details.
5.7 Applicant receiving a permit shall have such permit available
for exhibit upon request for the duration of the permitted
event.
5.8 All permits issued by the department shall be subject to all
city ordinances, codes and state law.
6.0 APPEALS
An applicant may appeal a permit denial or fees being charged by
requesting a review by the Park Board, which may at its discretion
sit in special session to address the appeal.
An appeal request must be made in writing to the department director
within three days of issuance of the denial. A reply from the
department indicating the course of action for the appeal will be
provided to the applicant on or before the third day after the
department's receipt of the written appeal. If the Board elects
to sit in review of the appeal, a meeting will be scheduled within
fourteen days of the original date of denial.
7.0 FEES
7.1 Registration - A basic registration fee of $2.50 shall be
charged for all use/impact permits.
7.2 Special service - Proposed events requiring department staff
review for determining event suitability in accord with sections
3 and 4 of the policy, an event that requires review of require-
ments of section 5 and/or requiring a park site orientation
meeting (as determined by the department) shall be charged a
fee of $15.00.
7.3 Additional staff support - An event that requires more than
one orientation meeting, clean-up bond and trash disposal,
set-up assistance and other department staff involvement in
addition to items 1 and 2 of this section shall be charged at
the prevailing rates. An estimate of these charges will be
provided to the applicant.
8.0 BONDS
A refundable performance bond (guarantee) may be required to cover
events that are anticipated to attract large crowds, may create
unusual facility maintenance and/or clean up in addition to regular
park use, to assure payment of a concession fee, to cover possible
damage to park property. A bond may also be required for events
under the band shell noise limitation.
8.1 The bond value shall be in accord with the following schedule
and may cover all or any of the conditions of section 8 of
this policy.
Attendance Bond Amount
100-300 $75.00-$125.00
301-500 $125.00-$175.00
501-1500 $175.00-$300.00
1501-5000 $350.00-$500.00
over 5000 $750.00-2000.00
8.2 The bond may be posted as a cashier or certified check, money
order or other recognized bond instrument.
8.3 Upon verification of applicant's adherence to the site use
conditions of the bond, the full amount of the performance
bond will be returned. For non-compliance to site use
conditions the cost incurred by the department for restoration,
maintenance or clean up will be deducted from the bond amount.
8.4 The performance bond for adherence to the noise limitation at
the band shell shall be a maximum of $250.00 The bond amount
shall be forfeited in full upon violation of the band shell
noise limitation.
9.0 INSURANCE
Liability insurance may be required from applicants proposing events
that pose a risk of public injury or private/park property damage.
9.1 When insurance is required, the department shall set liability
amounts generally at $500,000 bodily and $100,000 property,
which shall not limit the liability of the applicant.
9.2 When insurance is required, the applicant must provide a
certificate of insurance naming Boise City as additional
insured and indemnifying the City from claims arising from
the event at the time event fees are paid.
9.3 A valid certificate may be used for more than one event if
an amendment is made identifying each event and the date of
occurrence
9.4 An appeal for waiver of insurance may be made by following
the Appeal section (#6) of this policy.
10.0 USE CATEGORIES
10.0 Category I - Concessions
General Food Vending - Permit allowed only for permanent park
buildings, mobile concessions or booths specifically constructed
for food preparation and distribution. Booth must have public
access controls and be in accord with district health require-
ments. No bottle beverages are allowed.

2. 15% of gross revenue use fee (fee may vary for
concessions awarded on bid or on long term contract)

10.2 Category II - Business
Park use by an individual, company or corporation which derives
income or profit (directly or indirectly) by the use of the
park for the location, setting or staging for the business
activity.
A. Requirements:
1. Department permit (registration) (base fee)
2. Liability insurance certificates
*3. Hourly rental charge or flat rate fee
*Hourly rental for requested use initiated by business,
flat rate for City sponsored event.
No direct sales allowed in park.

10.2 Category II - Business (continued)
Above fees apply during regular open park hours. Charge of
$12.00 per hour or part for Department staff time involved in
accommodating the use in the park. Area of use shall not
exceed 400 x 400 ft. Larger area use charge may be negotiated.
10.3 Category III - Other governments. Park use requested by a
governmental agency must be in accord with the purposes of
that agency.

10.4 Category IV - Non-profit organization involved in an event in
which no monetary transaction is conducted in association with
the event.

4. Special services (no cost)
5. Additional support (no cost)
* Department staff time required by the event will be provided at
no cost to the organization.
10.5 Category V - Non-profit organization involved in an event with
which cash flow is generated by the event.
A. Event in which a general sponsor or single organization
operates all activities.
Requirements:
1. Department permit (registration) (base fee)

3. Liability insurance
Options:
1. Police assistance
2. Special services ($15.00 fee)
3. Additional support (fee per costs incurred)
4. Facility reservation fees
B. Event in which individuals or vendors operate activities on
behalf of general sponsor.

4. Vendor $15.00 use fee
10.5 Category V - continued
Options:
1. Police assistance
2. Special services ($15.00 fee)
3. Additional support (fee per costs incurred)

C. Event or program scheduled for a season or other continuous
use.
Requirements:

4. Use -impact fee ($25.00 per program)

2. Additional support (fee per costs incurred)

11.0 PERMIT ISSUANCE
The following activities require the issuance of a use -impact
park permit.
11.1 Vending
1. Sale of merchandise in parks is expressly prohibited
by Code, with the exception of permitted activities.
2. Rental of vendor equipment and supplies, etc. must be
for acceptable leisure use activities and be authorized
by execution of a Park Department concession agreement.
3. Ethnic festivals and other events serving pre-cooked
or prepared foods may distribute these foods from tables
if precautions are taken to prevent spoilage and
contamination. See use category requirements in
accord with sponsor designation.
11.2 Film use - Public Service - Permit - no use charge
Documentary - Permit - no use charge
Spot Commercial- Permit - no use charge
Feature Movie - Permit and hourly rental
11.3 Commercial product demonstration
1. Category requirements
11.4 Pre-schools and camps - with tuition or fees but excluding
local non -profits supported by community donation programs.

12.0 PROHIBITED EVENTS
The following events and activities are not permitted within the
park system.
1. Auctions of new or used -second items
2. Mechanical rides and amusements
3. Product sales other than hand crafts and food
4. Fishing derbies in Ann Morrison or Julia Davis parks
5. Programs involving skydiving, hang gliding, gliders,
parachuting and flying hot air balloons.
Note: City sponsored activities and events are exempted from this policy
and are subject to negotiated fees and charges.
If any part of this policy is held to be invalid,such part shall be separable
and shall not affect the remaining parts of the policy, which will continue
in full effect.
