O’Boyle [e-mail to: records@commerce-group.com] Re: GS #2812-6 (Request for Public Records Related to Martin O'Boyle Criminal Case) Request for Public Records Related to Martin O’Boyle Criminal Case 6. All text messages created, sent, or received by Scott Morgan since January 1, 2013. Dear Martin E. O’Boyle [e-mail to: meo@commerce-group.com]: Thank you for your public records request made on August 30, 2020. On September 17, 2020, the Town responded as follows: This subpart of your request identifies the records sought with sufficient specificity to permit the Town to identify the requested records. Records responsive to this request were previously provided to you in response to GS 2704 made by Martin O’Boyle on April 16, 2019 (“all records . . . which mention or refer to Mar[t]in O’Boyle, but limited to the incident at the Town Hall on September 22, 2015 regarding Martin O’Boyle”). Based on our understanding, records responsive to subpart 6 of your request will also be responsive to subpart 8 and included in that estimate. On October 16, 2020, you responded through your Attorney as follows: This request is not limited to any category of information. This asks for all text messages and will require conferring with individuals of the Town as they may have messages that Mayor Morgan may have deleted. The original request can be found at the following link: https://portal.laserfiche.com/Portal/DocView.aspx?id=173216&repo=r-430100cc Subpart six of your request can be found at the following link: https://portal.laserfiche.com/Portal/DocView.aspx?id=173616&repo=r-430100cc The Town now estimates that to fully respond to subpart six of your request will require 43 minutes of administrative support at $48.38 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of producing these documents will exceed your deposit, the Town will provide you with an initial production of responsive records and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with the responsive records and a refund. (43 Minutes @ 48.38 = 34.83) = Deposit Due: $34.83 in cash or check. This estimate does not include reviewing previous responses to public records requests and providing you with those records. If you would like us to include records already publicly available, please let us know and we will update our estimate. Upon receipt of your acknowledgement that you will pay for these records, the Town will use its very best efforts to further respond to your public records request in a reasonable amount of time. If we do not hear back from you within 30 days of this letter, we will consider this request closed. I would like to think that they are going to put the pressure on and tighten the net to try and catch these people who keep coming in the neighborhood. A bit unnerving that they are around in broad daylight. I hope all is well with you. Best, Beau Sun, Jul 12, 12:28 PM Ii ®>(Message 0 Hi Beau. Glad to hear you got your car back. Thats the only one recovered from the new car theft ring that is hitting the barrier island. Several in Ocean Ridge and a handful from Delray taken the same day as your car was taken. I explained to Curtis that cameras in town are ineffective at stopping crime and are expensive and high maintenance as well. Lt. Hasley researched camera costs and their effectiveness in Ocean Ridge and Delray and concluded we should not pursue them even with a financial contribution from the Civic Assn. My own opinion is that we must deter and stop crime in Gulf Stream rather than simply record it. Therefore I asked that our budget for 2021 include another police officer, which will allow for three police vehicles to make rounds instead of the standard two vehicles. That is a 50% increase in police presence to better deter or stop crimes from being committed. The police are also knocking on simply record it. The police are also knocking on doors to remind residents to lock their cars and homes and to stop leaving keys in the cars, which is how all ten cars have been stolen from Gulf Stream since December. We are also placing unmanned vehicles in quasi - hidden locations and , of course, following any late model vehicle with unknown young men in it. Do you have a policy on how long you keep your "Sold " signs up after the sale of a house? Is it a set period of time or until the closing? Every year people complain about it. But nothing specific. Not about you in particular. Just general questions. The Town does not address it and my recollection is that Sold signs typically stay up until closing or when the current owner asks it to be removed. And that's fine. I get asked these things and just like to have an informed answer. 10:28 . 5GE = Candace No set time in any communities and Corcoran does not. It is the property owner who allows or not. Why? Delivered Seems there's no time set time for a builder to leave his sign up, there's no set time that a for sale sign can be up so why should there be a set time for a sold sign to stay up if none of the others types of sign are regulated. Seems to me to be good news for any community. No signs in any of the local townships are regulated. Further concrete information as to date and time will be sent when it becomes available. If you had planned to send in your proxy for the March 24th meeting, please still do so, as it will stand when the meeting is finally held. It does not preclude you from attending the next scheduled meeting - if you are there to vote we just don't count your proxy. Very simple. Thank you for your understanding and cooperation. Ocean Avenue Bridge Town of Ocean Ridge, News and Alerts Sent 05/31/2020 15:09 EDT As many of you may be aware, there have been a number of social media posts that indicate a protest action occurring on East Ocean Avenue near the Ocean Avenue Bridge this evening. Be assured that the Town of Ocean Ridge Police Department and all surrounding agencies are working in concert and are preparing to provide security to the residents of our community. All members of your police department are aware and have been strategically placed within the community to protect the Town and our GD EA residents. In addition to our resources, multiple agencies have partnered together to assist as needed. We ask that each of you take this opportunity to be alert and aware of what is occurring within our county as well as our nation. If possible, please avoid the use of the Ocean Avenue Bridge until tomorrow morning. In an abundance of caution and as always, we ask that you secure your vehicles inside your garage. If you do not have a garage, please remove any valuables from your vehicles and lock the doors. Please continue to use your alarm and lock your doors and windows as you would on any other day. As always, the police department and the officers are well prepared to protect you and your property. MA 811118 GD EA county as well as our nation. Paragraph 5 of Request 2812 noted that we would like all electronic records in their native electronic format. For Subpart 6, we have reviewed what the Town has produced and have found that the production is insufficient. We believe that screenshots of text messages were produced and not the original data. Without the original data we cannot identify the timestamp of certain messages or the identities of the speakers (phone number associated). As such we request that Subpart 6 be produced in its native electronic format as originally requested. Please ensure that all responsive records are produced and if it is easier for you to overproduce (instead of culling messages), then we do not object if it makes the Town’s job easier. Out of an abundance of caution I am noting this is a (5) day notice under Chapter 119.12 for 2812-6. The original request can be found at the following link: https://portal.laserfiche.com/Portal/DocView.aspx?id=173216&repo=r-430100cc Subpart six of your request can be found at the following link: https://portal.laserfiche.com/Portal/DocView.aspx?id=173616&repo=r-430100cc Thank you for your correspondence dated January 26, 2021. The Town responded to your request with screenshots of text messages, as we have always done when requestors seek texts in their original electronic format. You take issue with being unable to identify the timestamp of certain messages, or the identities of the speakers. Pursuant to the General Records Schedule for State and Local Government agencies, “Printouts of electronic communications (e-mail, instant messaging, text messaging, multimedia messaging, chat messaging, social networking, or any other current or future electronic messaging technology or device) are acceptable in place of the electronic files, provided that the printed version contains all date/time stamps and routing information.” If you can identify the text message screenshots that do not contain all date/time stamps and routing information, we will supplement our production. If the above is not sufficient, we will make inquiries to determine whether there is available technology that would provide you with any additional information relative to these messages and, if so, the associated cost to obtain them. Sincerely, Reneé Basel As Requested by Rita Taylor Town Clerk, Custodian of the Records
